‘Justice delayed… is dignity diminished': Karnataka HC slaps Rs 2 lakh fine on Govt officials over delaying para-swimmer's cash reward

The Karnataka High Court on Monday directed officials of the Department of Youth Empowerment and Sports to pay an international-level disabled swimmer more than Rs 1.26 lakh as a pending cash award, and imposed a fine of Rs 2 lakh on them. In the order, Justice M Nagaprasanna also directed the department's officers to bear the sum of Rs 2 lakh in litigation expenses personally. The petitioner, Vishwas K S, is a swimmer with multiple medals at the international level who had lost his arms at a young age in an accident. Based on a 2013 Karnataka Government notification granting cash awards to international para-swimmer medalists, he had approached the Department of Youth Empowerment and Sports in March 2018 for a cash award of Rs 6 lakh. After failing to receive the full amount despite multiple representations, he approached the High Court. His counsel argued Vishwas had been subjected to inhumane treatment as he was not given his dues as a disabled person, and was entitled to equal treatment. The opposing counsel said he was paid Rs 4.6 lakh, which was the actual amount due, and pointed out that the association he represented had been disqualified from April 2015 to June 2016. The bench observed that although a different notification governing such awards was issued in 2017, the swimmer's events took place during the pendency of the 2013 government notification. Under this, he would be eligible for Rs 4 lakh for two international silver medals, and another Rs 2 lakh for international bronze medals in various events. 'The association's suspension or its subsequent revocation cannot deprive a deserving athlete of his rightful reward… It is the said sportsperson's effort during the sporting event that they would win a medal for the nation or the state, as the case would be, which would entitle them to get such cash rewards….focus must not be on bureaucratic technicalities, but on the living human spirit that triumphed against colossal odds,' the bench said. '…for having driven a disabled person to bear the brunt of litigation, the officers of the State must be mulcted with payment of exemplary costs. The costs are to be imposed as a caution or to serve as a reminder to the officers of the State that justice delayed, especially to those who overcome the gravest of odds like the petitioner, is not only justice denied, but dignity diminished,' the bench added.

Mysuru: The Department of Youth Empowerment and Sports has undertaken the construction of state-of-the-art football grounds near Chamundi Vihar Stadium in Mysuru. It has identified 3.4 acres behind the Chamundi Vihar Stadium, with the initial stage of works costing Rs 70 lakh. This will be the first football ground initiated by the department to promote football. Currently, the department conducts various sports activities like athletics, hockey, volleyball, and even indoor games like gymnasium and wrestling, apart from football, at Chamundi Vihar Stadium. As there are no dedicated football grounds, the department has been conducting football tournaments and league matches for over 20 teams in association with the District Football Association at the university sports grounds and other available grounds across the city. Plan to conduct tourneys throughout the year The construction of football grounds near Chamundi Vihar Stadium has brought cheer to thousands of football enthusiasts in the city. The department plans to conduct tournaments throughout the year after the completion of the works. By constructing permanent public football grounds, the department has initiated measures to conduct yearlong football promotion activities, like organising state-level and national-level football tournaments, and separate tournaments for children below 14 and 16 years old, as well as for people above 16 years. It also plans to conduct training camps and summer camps for the public to use the ground to play football once all the work is completed. Assistant director of Youth Empowerment and Sports Affairs Bhaskar Nayak said that works related to the construction of public football grounds started after completing the necessary tender procedures. Works on the new public football playgrounds at the back of Chamundi Vihar Stadium will be completed in 11 months, he said. District Football Association secretary L Manjunath said as there are no football grounds set up by the department, the association has conducted football tournaments for 20 batches from Dec to May every year at university playgrounds and other grounds available in the city. Now, the construction of a public football grounds facility not only helps the association to conduct yearlong events along with the department but also benefits the general public and football enthusiasts, he said. He also appealed to the govt to stop handing over stadiums and such playgrounds to private agencies, even for public utilities. Instead, the department must use them exclusively for sports activities.

World Bicycle Day celebrations in Mysuru

Several bicycling enthusiasts participated in the Tiranga cycle rally, organised in Mysuru on Sunday as part of the World Bicycle Day celebrations. The rally, which was flagged off from Chamundi Vihar stadium in Mysuru around 7 a.m., reached Deputy Commissioner's office before returning to the stadium by 7.45 a.m. It was organised by the Department of Youth Empowerment and Sports, Amateur Cycling Association, Mysuru District Administration, Mysuru Zilla Panchayat, and Mysuru Athletic Club. The objective of the programme was to encourage people to set aside at least 30 minutes every day for their health and promote the use of bicycles as a means of transport to maintain good health, a statement noted. A number of sportspersons, students, cyclists, and general public participated in the rally.
