MP high court issues notices over petition challenging section 12.4 of school teachers recruitment rules 2024
Bhopal/Jabalpur: The MP high court issued notices to the state govt and other respondents in response to a petition challenging the legality of Section 12.4 of the Primary and Middle School Teachers' Recruitment Rules-2024.
Appearing for the petitioner, Dinesh Garg, Advocate Aryan Urmalia said that Section 12.4 is not only against the MP Teachers' Recruitment Rules-2018 but is also in violation of Articles 14 and 16 of the Constitution, which guarantee equality and equal opportunities to all citizens. The rule stipulates that a candidate from any of the reserved classes, on securing less than 90 marks in the eligibility test, will only be eligible to appear in the teachers' recruitment test from his reserved category and not as a general candidate.
This is against the Supreme Court guidelines, which clearly state that any candidate from a reserved category would be eligible for selection from the general category if he scores marks at par with the marks of meritorious candidates from the general category.
This rule doesn't allow candidates from EWS, OBC, SC, and ST sections to be selected as general candidates despite scoring higher marks than the cut-off marks of the general candidates. Following initial arguments, the court of Justice Vivek Jain issued notices to respondents, including the state govt, seeking a response.
