Manchester man charged in 2024 fatal crash in Londonderry
A Manchester man was arrested Wednesday and charged in connection with a fatal October crash in Londonderry. Felly Mizenga Felly Mizenga Londonderry Police said Felly S. Mizenga, 54, was charged with negligent homicide (a Class B felony), vehicular assault (a Class A midemeanor), hands-free violation, yellow/solid line violation and failure to yield. Police said the crash, between Mizenga's 2019 Toyota Highlander and a 2024 Harley-Davidson motorcycle driven by Brian Marcoux of Dracut, Mass., occurred just after noon on Oct. 12 on Rockingham Road (Route 28) near the Manchester line. Marcoux, 53, was taken to Elliot Hospital, where he was later pronounced dead. Police said Mizenga remained at the scene and cooperated with investigators. After Wednesday's arrest, Mizenga was released on personal recognizance. He is scheduled to be arraigned on June 11 in Derry District Court.

Investigation continues after child attacked by 2 dogs near New Hampshire playground
An investigation continues Thursday after two people, including a child, were attacked by two dogs near a playground in New Hampshire on Wednesday. Emergency crews responding to a report of an assault in progress in the area of 458 Lake Avenue in Manchester around 12:15 p.m. found an 8-year-old boy and a man who had been bitten by two dogs, according to authorities. The child was rushed to Elliot Hospital with serious arm injuries. The man, who investigators say tried to stop the attack, was also taken to the hospital for evaluation. It's unclear if the owner of the dogs will face charges in connection with the incident. Police didn't release any additional details. This is a developing story. Manchester sergeant found 'legally justified' in fatal shooting of man on Bridge Street
Feb. 25—A Manchester police officer was justified in his use of deadly force in shooting a man who fired a gun at him during a dispute on Bridge Street in June, Attorney General John Formella announced Thursday. Manchester Police Sgt. Daniel Whelan shot and killed Andrew E. Smith, 56, on June 28, 2024, after Smith fired a Beretta Model PX4 Storm, configured in a .40 S&W caliber, at Whelan, a report released Tuesday by the Attorney General's Office says. "Based on the investigation of this deadly force incident, Attorney General John M. Formella finds that the use of deadly force by Sergeant Whelan against Mr. Smith on June 28, 2024, was legally justified," the report concludes. According to the report, just after 9:30 a.m. on June 28, Whelan was driving south on Beech Street in Manchester in a marked police cruiser when he reported seeing Smith walking on the sidewalk. As he drove by, Whalen told investigators he saw Smith "extend his arm and gesture with his hand as if he was shooting a gun" at him. Whelan told investigators he was alarmed by Smith's conduct and believed that Smith had intended to "inflict fear and alarm." He continued driving, but circled the block to stop and detain Smith for suspicion of criminal threatening. Whelan circled the block and parked his cruiser on the north side of Bridge Street a few minutes later, crossed Bridge Street to the sidewalk on the south side of the street, and met Smith walking eastbound on the sidewalk in front of the apartment building at 195 Bridge St. According to the report, Whelan asked Smith multiple times if he could speak with him. Smith eventually stopped after being told by Whelan that he was being detained. "As Sergeant Whelan was speaking with Mr. Smith, he asked him to remove his right hand from his vest pocket," the report says. "Initially, Mr. Smith complied with Sergeant Whelan's request. Sergeant Whelan then asked Mr. Smith if he was armed, and Mr. Smith stated that he was. Sergeant Whelan again instructed Mr. Smith to keep his hand visible, however, Mr. Smith responded by reaching his right hand back into his vest pocket." According to the report, after Whelan attempted to stop Smith from pulling anything out of his pocket, "Smith fired a single shot in the general direction of Sergeant Whelan from a pistol concealed inside his right vest pocket." "Sergeant Whelan responded immediately by drawing his weapon and firing four shots at Mr. Smith causing fatal injuries," the report states. Investigators determined after Smith fired his first shot, his pistol jammed, preventing the gun from firing further shots at Whelan. Whelan called for backup after discharging his firearm and began rendering medical aid until paramedics arrived and transported Smith to the Elliot Hospital, where he was pronounced dead. Whelan has served as a police officer since March 2006, beginning his career as a patrol officer with the Litchfield Police Department from March 2006 to May 2010 before joining the Manchester Police Department in May 2010. He was promoted to the rank of sergeant in November 2020 and was assigned as a patrol supervisor at the time of the shooting. pfeely@
