WASHINGTON (AP) — A woman who spit on the top federal prosecutor for the nation's capital during a videotaped interview pleaded guilty on Thursday to assault charges. Emily Gabriella Sommer, 32, of Washington, D.C., is scheduled to be sentenced on Oct. 10 for assaulting then-acting U.S. Attorney Ed Martin Jr. and two law-enforcement officers who arrested her several days after she spit on Martin. Sommer pleaded guilty to three counts of assaulting public officials, according to U.S. Attorney Jeanine Pirro's office. A trial for Sommer had been scheduled to start next Monday. Instead, U.S. District Judge Jia Cobb accepted Sommer's guilty plea and will sentence her. On May 8, a Newsmax reporter was interviewing Martin on a sidewalk outside his office when Sommer approached him. 'Are you Ed Martin? You are Ed Martin,' Sommer said before lunging at him and spitting on his left shoulder, according to prosecutors. As she walked away, Sommer swore at Martin and called him 'a disgusting man.' 'My name is Emily Gabriella Sommer, and you are served,' she said. Sommer later took credit for the spitting incident in a message replying to a social media post by Martin. The encounter occurred on the same day that President Donald Trump pulled Martin's nomination to remain U.S. Attorney for the District of Columbia. Martin faced bipartisan opposition in the Senate after a turbulent stint in the nation's largest U.S. Attorney's office. A key Republican senator said he could not support Martin for the job due to his support for rioters who stormed the U.S. Capitol on Jan. 6, 2021. Martin roiled the office with a series of unorthodox moves, such as firing and demoting subordinates who worked on politically sensitive cases. Trump replaced Martin with former Fox News host Jeanine Pirro, who was confirmed by the Senate on Aug. 2. When U.S. Marshals Service deputies went to arrest Sommer at her apartment on May 22, she spit in a deputy's face and kicked him, prosecutors said. 'How is that spit? Taste good? I was just getting over a cold sore. I hope I gave you herpes,' Sommer told the deputy, according to prosecutors. Sommer also kicked a second deputy during her arrest and told another deputy, 'I would put a bullet in you if I had it. I would put a bullet in every one of you right now,' prosecutors said. During her initial court appearance in May, Sommer repeatedly disrupted the hearing with outbursts. Deputies picked her up and carried her out of the courtroom after one of her interruptions prompted a magistrate to suspend the hearing. Sommer later apologized to the magistrate for her courtroom conduct.

The foul-mouthed woman who spat on a former acting US Attorney is headed for a guilty plea in court. Emily Gabriella Sommer, 33, of the District of Columbia, was arrested on May 22 following an incident earlier that month in which she allegedly assaulted former US Attorney Edward R. Martin Jr. On May 8, Sommer - whilst walking a dog - approached Martin, who was mid-interview at the time. She yelled, 'Are you Ed Martin?' and then, 'You are Ed Martin!' at the official before seemingly lunging at him and spitting. Sommer then continued walking as she screamed: 'You are a disgusting man. F**k you, Ed Martin... My name is Emily Gabriella Sommer, and you are served,' according to the arrest affidavit. Martin was being interviewed in front of the US Attorney's Office in Washington, DC, at the time and the camera captured the entire exclehange. Later that day, Martin posted on X that he was 'thrilled to meet with the prosecutors, investigators and paralegals' on his Violent Crime and Narcotics Trafficking Section. An X account that is believed to belong to Sommer responded to the post saying, 'ED, that was me that spit in your face today...' The post continued: 'A pleasure to hawk a dehydrated, pithy white foam spit into your face. I only apologize that this city left me so dehydrated and unable to get water that I couldn't produce more to stain and drip down your face.' A criminal complaint was filed in US District Court in connection with the incident and Sommer was charged with three counts of assaulting, resisting or impeding a federal officer. Sommer made her first court appearance on May 22, and it reportedly did not go smoothly. She allegedly became 'agitated' when she learned prosecutors would seek a more serious assault charge that could send her to prison for up to eight years, according to Law & Crime. The 33-year-old allegedly spat on and kicked two US marshals while she was being removed from the courtroom, earning her two additional assault charges. The US Justice Department (DOJ) argued in June that Sommer had broken conditions of her release by targeting Martin on social media. She allegedly harassed him with comments such as: 'You mad, bro? You got fired, and then caught a loogie to the shoulder...' Days later Sommer was arrested at her DC apartment for allegedly defacing her neighbor's property. The suspect allegedly spray-painted the neighbor's front door with their name followed buy the word 'Spy,' according to police. It is also alleged that she attacked the neighbors door with a 'metal rod'. Sommer was placed in police custody in June and ordered to undergo a mental health evaluation. Sommer pleaded not guilty to all charges on July 30. Court records show a change of plea hearing for Sommer is set for Thursday afternoon before US District Judge Jia Cobb. Martin is known to be a controversial figure in Washington, DC. He has suggested that the 2020 presidential election was stolen and has also fired prosecutors and FBI investigators who worked on January 6 insurrection cases.

Ms. Sommer, who was walking a dog on a leash, approached Mr. Martin, asked him 'Who are you?' using an expletive, and then spat on him. As she walked away, she told Mr. Martin 'You are a disgusting man.' Later that evening, a social media account — '@EmilyGabriellaS' with the username 'leftits' — then repeatedly confronted Mr. Martin in the replies to his social media posts, mocking him and claiming responsibility for the incident. Mr. Martin stepped down from his position as the interim U.S. attorney earlier this month after it became clear his work for Jan. 6 rioters would stop him from getting confirmed by the Senate. He is now the self-described 'captain' of the Justice Department's 'weaponization' group, among other roles, leading President Trump's campaign to carry out retribution against his perceived enemies. He often appeared to do just that in his role as the top prosecutor in Washington, and it was one of the obstacles in his ultimately doomed path to Senate confirmation to be the capital's permanent U.S. attorney. According to the criminal complaint submitted in federal court, U.S. marshals interviewed a witness at Ms. Sommer's home, who identified her as the person who spat on Mr. Martin. In a statement on Thursday, the Justice Department announced that they had arrested and charged Ms. Sommer with one count of assaulting, resisting, or impeding a government official. Although spitting is considered a form of assault in most U.S. jurisdictions, prosecutors do not usually pursue assault cases for spitting unless there is some aggravating circumstance. In 2020, for example, a New York woman was charged with assault of a federal employee for spitting on a postal worker and claiming to have been infected with the coronavirus. A study published in 'Forensic Science International' in 2021 found that 'spitting is generally considered more of a nuisance than a truly violent act,' adding that one of the exceptions would be potential exposure to an infectious disease.
