'Creator' of Flamin' Hot Cheetos loses PepsiCo, Frito-Lay lawsuit

May 29 (Reuters) - PepsiCo (PEP.O), opens new tab won the dismissal of a lawsuit by a former executive who said the food and beverage company defrauded and defamed him by denying that he invented Flamin' Hot Cheetos. In a decision on Wednesday, U.S. District Judge John Holcomb said Richard Montanez, who retired from PepsiCo in 2019 to become a full-time motivational speaker, did not show that PepsiCo and its Frito-Lay unit intentionally reneged on a promise to tell the "true story" of how he created the popular spicy chips. The Santa Ana, California-based judge also said PepsiCo did not defame Montanez by allegedly refusing in 2023 to assist in a documentary about his life unless it debunked his claim. Holcomb said the actual malice standard for defamation, requiring knowledge of falsity or reckless disregard for the truth, was appropriate based on Montanez's describing himself as "part of the cultural canon" through two best-selling books and a hit movie directed by Eva Longoria. Lawyers for Montanez did not immediately respond to requests for comment on Thursday. Camille Vasquez, a lawyer for Purchase, New York-based PepsiCo, declined to comment. Montanez began in 1976 as a Frito-Lay janitor in Rancho Cucamonga, California, and rose to become PepsiCo's vice president of multicultural marketing and sales. He said he sparked what became Flamin' Hot Cheetos around 1989, when took unflavored Cheetos home to experiment with seasonings and "drew inspiration" from elote, a Mexican grilled corn seasoned with chili powder. PepsiCo introduced Flamin' Hot Cheetos in 1992, and made it a multibillion-dollar brand. Montanez said he once booked 35 speaking engagements annually at $10,000 to $50,000 each but lost most bookings after a Los Angeles Times article in May 2021 in which Frito-Lay rejected the "urban legend" that he invented the snack chips. Frito-Lay later said its comments were misconstrued, and it had no reason to doubt Montanez's efforts to create new Cheetos products. The newspaper defended its reporting. Montanez's story about Flamin' Hot Cheetos was told in Longoria's 2023 film "Flamin' Hot" and in two memoirs. The case is Martinez v PepsiCo Inc et al, U.S. District Court, Central District of California, No. 24-01792.

The FX docuseries Welcome to Wrexham , which follows Ryan Reynolds and Rob McElhenny's ownership of Welsh soccer team Wrexham AFC, has been renewed for a fifth season. FX has also set a summer premiere for Necaxa , a new docuseries from the Welcome to Wrexham producers. Following their success with Wrexham AFC, Reynolds and McElhenny bought a stake in Mexico's Club Necaxa. That July, FX greenlit a Wrexham -style docuseries about the soccer team, which Eva Longoria also has a stake in. Per a new synopsis, Necaxa sees Longoria work to 'reignite the soul of one of Mexico's oldest and most storied football clubs' with Reynolds and McElhenny's help. The series follows 'a turbulent, transformational time marked by staff shake-ups, career-defining injuries and the relentless grit of a football team determined to defy expectations and deliver hope to its city of Aguascalientes, Mexico. Once a powerhouse in Mexican football, Club Necaxa has spent decades navigating instability including relocations, relegation battles and near-constant reinvention. Though its legacy has flickered in and out of the national spotlight, a passionate core of diehard supporters continues to believe, clinging to the dream that their beloved 'Rayos' will one day rise again.' Season 5 of Welcome to Wrexham will follow the club's upcoming debut in the EFL Championship after its third consecutive promotion. Welcome to Wrexham, the documentary charting the ownership of Ryan Reynolds and Rob McElhenney, has been renewed for a fifth series. Broadcast in the U.S. on FX and on Disney+ in the UK, the show has proved a huge hit since first airing in 2022. A fourth series is currently midway through it's run, charting the 2024-25 EFL League One season that ends in Wrexham clinching an unprecedented third consecutive promotion. Advertisement This latest success means Phil Parkinson's side will be competing in the Championship come August, meaning the club will be just one level below the Premier League. After confirmation that a fifth series has now been commissioned, the Welcome to Wrexham cameras will once again follow the team, the players and the supporters through the 2025-26 season. Also confirmed on Wednesday are details of a new TV spin-off docuseries venture involving Reynolds and McElhenney. Necaxa will focus on the Mexican club of the same name, effectively an extension of the 'Welcome to…' franchise after Wrexham's two Hollywood owners were brought on board by Eva Longoria last year to help revive the fortunes of the Liga MX outfit in a similar vein to what has happened in north Wales. Like Welcome to Wrexham, the bilingual show promises plenty of behind-the-scenes access along with a focus on supporters and the local community, as well as an ownership team headed by Desperate Housewives star Longoria. As for the Welsh club, news of a fifth series is another huge boost. Welcome to Wrexham has helped transform a previously provincial football club into a global brand that has now soared from the National League to the Championship. The club receives no money from the show. But it has long been considered by the hierarchy as Wrexham's 'biggest commercial asset' due to how the spotlight afforded by the show has lured a host of big money sponsors on board. United Airlines, SToK Cold Brew Coffee, Meta and HP are among the list of companies that have helped Wrexham's annual revenue soar in recent years to £26.7 million in the last available set of accounts for the 2023-24 financial year. Those figures also revealed how 52 per cent of income now comes from overseas, the vast majority from North America. Last month, she returned to our screens with a brand new season, Searching for Spain, which takes her all over the country to explore the vast regional scope of its cuisine and learn about her Spanish ancestors. Lale sits down with the actor and television host to find out how she chose the destinations for each episode, her most memorable meals in places like San Sebastián and Andalusia, and how food can be an entry point to connecting more deeply with history—and each other. Lale Arikoglu: Hi there. I'm Lale Arikoglu and welcome to an episode of Women Who Travel, where we are traveling around Spain with Eva Longoria. Eva's new CNN show, Searching for Spain, is a follow-up to her series, Searching for Mexico, which ran in 2023. Eva Longoria: So I didn't know Spain as well, and so the difference is like Mexico, I felt like I was at home. Spain really felt like a fish out of water and I was really curious and engaged in the history of gastronomy in the country, but also the history of the ingredients and how things ended up there and colonization and how did that help, and Franco's dictatorship and how did that have an effect on food. But I do live part-time in Spain. I live in Marbella in the South, so unfamiliar with the south, but everything else, I was just visited very, very superficially. And so to go to Spain in this way, with the show, really dig in deeply was a gift. With the CNN research team, they really look at food stories. I mean, that's what drives this series is like, is there a food story there? So sometimes there'll be regions that are very popular, but there's no food story. So that's kind of the lens in which we look at each region and there's obvious cities and regions. We went to Madrid being its own episode and Catalonia being its own episode, Pais Vasco, the Basque Country being its own. And then after that, just trying to find the stories and the history and what would be visually beautiful, what people and chefs we wanted to follow. What was daunting was speaking Castilian Spanish, because I didn't grow up speaking Spanish. I spoke Spanish in the Mexico series because I'm Mexican, but to go to the mother country of Spain and to speak Castellano, which is very different than Mexican Spanish, that was daunting. So I was like, oh God, I hope I'm going to be able to understand and communicate because when you speak the language, you really can ask the right questions and absorb the answers. And so that's what was terrifying, but it was great. I did well.
