Nirmiti Kendra is public authority under RTI Act: Karnataka HC

Bengaluru: The Karnataka high court has ruled that Nirmiti Kendra, established by the state govt and controlled by govt officers, qualifies as a public authority under Section 2(h) of the Right to Information Act. Additionally, it imposed a cost of Rs 50,000 on the petitioner, Nirmiti Kendra at Medahalli in Chitradurga, for its refusal to disclose information. The Nirmiti Kendra had moved the HC against the State Information Commission's Aug 29, 2017 order to provide information sought by applicant HR Thimmaiah, the president of Bharath Krishik Samaj, Hiriyur, Chitradurga district. The information commission had also imposed a penalty of Rs 25,000 on the kendra. The Medahalli Nimriti Kendra refused to furnish information, arguing that as it was not a public authority, it was not subject to the RTI Act. "In that view of the matter, the finding and conclusion of the Karnataka Information Commission and the direction issued to furnish the document sought cannot be faulted. It is not expected of a governmental authority and the officers of the Nirmiti Kendra, who are govt officers, to have taken such a stand that a Nirmiti Kendra would not come within the purview of the RTI Act. All the govt offices and departments are subject to the RTI Act and are required to make available the information sought," ruled the HC. "The attempt made by the officers to suppress such transparency leaves much to be desired and does not inspire confidence. By way of such conduct, Nirmiti Kendra avoided the disclosure of information. I'm of the opinion that the costs would also have to be imposed on Nirmiti Kendra," Justice Suraj Govindaraj noted. Mangaluru: A state-level Indian Organ Donation Day will be observed at Yenepoya Medical College Auditorium, Deralakatte, on Aug 1. DHO Dr HR Thimmaiah said on Wednesday that the event will be inaugurated by health and family welfare minister Dinesh Gundu Rao. Assembly speaker UT Khader will preside, while minister for medical education and skill development Dr Sharanprakash R Patil will participate. The event is organised by the State Organ and Tissue Transplant Organisation (SOTTO) – Jeevan Sarthakathe—under the Directorate of Health and Family Welfare Services. As of July 30, Karnataka recorded 43,221 organ donation pledges. The Mangaluru division — comprising Dakshina Kannada, Udupi, Uttara Kannada, Davanagere, Chikkamagaluru, and Shivamogga — ranks fourth in the state, he said. Between 2017 and June 30, 2025, the state registered 979 organ donations, which include 1,481 kidneys, 812 livers, 251 hearts, 129 lungs, 25 kidney-pancreas pairs, 11 small intestines, 44 liver-kidney combinations, 396 heart valves, 1,494 corneas, 106 skin donations, and two hands. The Mangaluru division alone facilitated 141 organ donations since 2019. U Tired of too many ads? go ad free now dupi/Mangaluru: A 65-year-old cancer patient from Belle village in Kaup taluk passed away at a private hospital in Manipal on Tuesday. He was confirmed to be Covid-19 positive. The patient was suffering from cancer and was admitted to the hospital recently. During his treatment, he tested positive for Covid-19. Officials from the revenue and health departments visited the victim's house to raise awareness about precautionary measures against Covid-19 among villagers, and instructed them to follow SOPs. Official sources said that the last rites will be performed as per Covid-19 SOPs on Wednesday. Meanwhile, three female patients aged 64, 57, and 29 years, who tested positive for Covid-19 in Dakshina Kannada in May, recovered successfully and were released from medical care. Dakshina Kannada DHO Dr HR Thimmaiah said that the centre has already assured the public not to panic as the Covid variant is very mild. As per the govt directive, the district will conduct Covid tests for all the severe acute respiratory infection (SARI) and 5% of the influenza-like illness (ILI) cases. Samples of all positive cases will be sent for genome sequencing. The department has decided to conduct tests only at the laboratory of Wenlock District Hospital in Mangaluru. All hospitals, including private hospitals, will have to send samples to Wenlock hospital only. All hospitals, from district hospitals to public health sub-centres, will conduct a dry run demonstrating preparedness on Wednesday, he said. Govt hospitals in the district are well prepared with sufficient medicines, oxygen beds, oxygen cylinders, ICUs, ventilators, masks, test kits, and PPE kits. Hospitals also have oxygen plants to ensure an uninterrupted supply of oxygen, the DHO said.
