Man Charged With 52 Sexual Offences Against Daughter In Melaka
MELAKA, Aug 12 (Bernama) -- An electrical goods technician was charged in the Ayer Keroh Sessions Court here today with 52 counts of committing incest, physical sexual assault and recording pornographic videos of his biological daughter since May. According to the charges, the 41-year-old man is accused of committing the offences at a house in Taman Tambak Paya Harmoni, Melaka Tengah, against his 18-year-old daughter between May 12 and Aug 6. When the charges were read before Judge Haderiah Siri, the accused pleaded not guilty to all counts. Of the total charges, 17 were framed under Section 376B of the Penal Code for committing incest, which carries imprisonment of not less than 10 years and up to 30 years, and whipping, if convicted. For the other 34 charges, the accused was charged under Sections 14(b) and 14(a) of the Sexual Offences Against Children Act (SOACA) 2017, read together with Section 16(1) of the same Act. The offences under those sections carry a penalty of imprisonment of up to 20 years and whipping, while Section 16(1) of SOACA 2017 provides for imprisonment not exceeding five years and a minimum of two strokes of the cane. One charge was also brought under Section 7 of SOACA 2017 for producing child pornography by recording two images of his daughter naked in a bathroom at the same location on July 9. If convicted, the accused faces imprisonment of up to 20 years and not less than five strokes of the cane. The prosecution, led by Muhamad Ehsan Nasarudin, proposed bail of RM20,000 for each charge with additional conditions including prohibition on contacting the victim and witnesses, reporting to the nearest police station every two weeks and surrendering his passport to the court.

MELAKA: A technician was charged at the Sessions Court here today with 52 counts of incest, physical sexual assault, and filming his daughter nude. The 41-year-old man pleaded not guilty to all the charges after they were read out to him before Judge Haderiah Siri. He was charged with 17 counts of incest and 34 counts of physical sexual assault against his daughter, who is now 18. He also faces one count of filming his daughter nude. For the 17 counts of incest, the man was charged under Section 376B of the Penal Code. For the 34 charges of physical sexual assault, he was charged under Sections 14(a) and 14(b) of the Sexual Offences Against Children Act 2017. Additionally, he was charged under Section 7 of the same Act for creating child pornography by filming his biological daughter nude. All the offences were allegedly committed at a house here between May 12 and Aug 2. Deputy public prosecutor Muhamad Ehsan Nasarudin proposed bail of RM20,000 for each charge. In his plea, the man claimed he was unable to pay the amount because his savings had been taken by his wife. The court granted the accused bail of RM90,000 for all charges, subject to additional conditions. These conditions include refraining from interfering with the victim and prosecution witnesses, reporting to a police station once every two weeks, and surrendering his passport to the court. He faces 17 charges of incest with his daughter, allegedly committed at a house in Melaka Tengah between May 12 and Aug 2. He is also accused of 17 counts of touching his daughter for sexual purposes, and another 17 counts of making her touch a part of her own body or that of another person for sexual purposes, at the same date, time and place. Additionally, he was charged with producing child pornography by taking two nude photographs of the victim in a bathroom at the same location at about 7am on July 9. Deputy public prosecutor Ehsan Nasarudin proposed bail of RM20,000 for each charge, subject to the conditions that the accused not tamper with the victim or prosecution witnesses, report to a police station twice a month, and surrender his passport to the court until the case has been concluded. Unrepresented, the accused asked for a lower bail, saying he had only RM8,000 in savings, which had already been taken by his wife before she left with their children.
