Delhi HC closes Hamdard's lawsuit against Ramdev
The Delhi high court on Friday closed the trademark disparagement lawsuit after Yoga instructor and entrepreneur Ramdev told the court that the video containing his remarks of 'sharbat jihad' on Hamdard's Rooh Afza has been taken down from all his social media accounts. Justice Amit Bansal passed the order while dealing with the lawsuit by Hamdard National Foundation India against Ramdev and his Patanjali Foods Ltd over the controversial remarks. Hamdard had sought for a permanent injunction restraining Patanjali from infringing and disparaging its trademark, along with damages up to ₹2 crore. On Friday, Justice Bansal closed the lawsuit after going through the undertakings of Ramdev and Patanjali in their affidavits pledging not to make any statements, social media posts or disparaging videos or advertisements in future regarding Hamdard's popular drink Rooh Afza. The averments in their affidavits were binding on Ramdev and Patanjali, the court remarked. In its petition, Hamdard said that while promoting Patanjali's 'gulab sharbat', Ramdev alleged the money earned from Hamdard's Rooh Afza was used to build madrasas and mosques. On April 22, the court said that Ramdev's remark was indefensible and shook its conscience, prompting the Yoga exponent to assure he would immediately take down the related videos and social media posts. The court asked Ramdev and Patanjali to file their undertaking in affidavits. Days later, however, Hamdard during a hearing on May 1 pointed out that Ramdev had made the same remarks in yet another video, showing no remorse for his conduct. Following the court's reprimand, Ramdev agreed to take down the offending portions of the new video within 24 hours. On May 2, Ramdev and Patanjali agreed to file an affidavit assuring they would not make any statements in future regarding Hamdard's product and sought the closure of the lawsuit. The court had posted the matter to Friday.

Justice Amit Bansal said the averments of Ramdev and Patanjali Foods Ltd. in their affidavits were binding on them and decreed the suit in favour of Hamdard National Foundation India. The court had previously ordered removal of a controversial online content on Rooh Afza and asked Mr. Ramdev and Patanjali to file their undertaking. Mr. Ramdev's remark of 'sharbat jihad' on Hamdard's Rooh Afza, the court said, was indefensible and shook its conscience, prompting the Yoga guru to assure he would immediately take down the related videos and social media posts. Hamdard's counsel had said instead of taking down the objectionable YouTube video in terms of an earlier order, the defendant had only made it private. Mr. Ramdev's counsel, on the other hand, said he had 'great respect for the court' and its directions would be complied with. On May 1, after the court warned of initiating contempt action against Mr. Ramdev, his lawyer assured that certain objectionable content which was subsequently published would also be deleted within 24 hours.

New Delhi: In a relief for yoga guru Ramdev, the Delhi High Court has closed a lawsuit against him. The court passed the order while hearing a case filed by the Hamdard National Foundation India against Ramdev and his Patanjali Foods Ltd over a controversial remark. This comes weeks after the court said Ramdev's "sharbat jihad" remark against Hamdard's 'Rooh Afza' was "indefensible". Hamdard has claimed that Ramdev, in videos to promote Patanjali's "gulab sharbat", alleged that the money earned from Hamdard's 'Rooh Afza' - a concentrated squash - was used to construct madrasas and mosques. Today, the Delhi High Court was informed that Ramdev has filed an affidavit, undertaking that the videos against Rooh Afza have been taken down. Ramdev's counsel informed the court that the affidavit, in compliance with judicial orders, has been tendered by Ramdev and Patanjali. The court sought an affidavit from them on April 22, assuring "not to issue any statements, social media posts or disparaging videos/advertisements in future similar to those which are subject matter of the present suit in respect of products of the competitors." The court also said Ramdev's "sharbat jihad" remark on Hamdard's Rooh Afza was "indefensible" and "shook its conscience". The case was closed after senior advocate Sandeep Sethi, appearing for Hamdard, did not press for any other relief in the suit. On May 1, after the court warned of initiating contempt action against Ramdev, his lawyer assured that certain objectionable content, which was subsequently published, would also be deleted within 24 hours.
