Delhi HC closes Hamdard's lawsuit against Ramdev
The Delhi high court on Friday closed the trademark disparagement lawsuit after Yoga instructor and entrepreneur Ramdev told the court that the video containing his remarks of 'sharbat jihad' on Hamdard's Rooh Afza has been taken down from all his social media accounts.
Justice Amit Bansal passed the order while dealing with the lawsuit by Hamdard National Foundation India against Ramdev and his Patanjali Foods Ltd over the controversial remarks. Hamdard had sought for a permanent injunction restraining Patanjali from infringing and disparaging its trademark, along with damages up to ₹2 crore.
On Friday, Justice Bansal closed the lawsuit after going through the undertakings of Ramdev and Patanjali in their affidavits pledging not to make any statements, social media posts or disparaging videos or advertisements in future regarding Hamdard's popular drink Rooh Afza. The averments in their affidavits were binding on Ramdev and Patanjali, the court remarked.
In its petition, Hamdard said that while promoting Patanjali's 'gulab sharbat', Ramdev alleged the money earned from Hamdard's Rooh Afza was used to build madrasas and mosques.
On April 22, the court said that Ramdev's remark was indefensible and shook its conscience, prompting the Yoga exponent to assure he would immediately take down the related videos and social media posts. The court asked Ramdev and Patanjali to file their undertaking in affidavits.
Days later, however, Hamdard during a hearing on May 1 pointed out that Ramdev had made the same remarks in yet another video, showing no remorse for his conduct. Following the court's reprimand, Ramdev agreed to take down the offending portions of the new video within 24 hours.
On May 2, Ramdev and Patanjali agreed to file an affidavit assuring they would not make any statements in future regarding Hamdard's product and sought the closure of the lawsuit. The court had posted the matter to Friday.

Patanjali Foods Ltd on Sunday junked reports of Patanjali Ayurved Limited receiving notice from the Ministry of Corporate affairs, saying it has not received any communication. In a stock exchange filing, Patanjali Foods said its sister concern Patanjali Ayurved is not being investigated by the Centre. 'Pursuant to Regulation 30(11) of the SEBI (Listing Obligations and Disclosure Requirements) Regulations, 2015, based on confirmation from Patanjali Ayurved Limited, we may clarify that Patanjali Ayurved Limited has not received any communication from Ministry of Corporate Affairs('MCA') for the proposed investigation by MCA as appearing in mainstream media,' the filing noted. Patanjali Ayurved is exploring legal options to address the issue, the company said. 'Their legal counsels are examining appropriate action in this regard,' Patanjali Foods said. In a report on May 30, Bloomberg reported that yoga guru Baba Ramdev's company Patanjali Ayurved is under the scrutiny of Centre due to 'suspicious' activities. The Centre has asked Patanjali Ayurved to explain some transactions deemed suspicious, according to the report quoting people familiar with the matter. As per the report quoting unnamed sources, the Union Ministry of Corporate Affairs sent a notice to the company after the federal economic intelligence wing found transactions it said was abnormal and dubious. The sources quoted by Bloomberg did not however reveal the exact amount of transactions involved in the case. They cited early stages of investigation as the reason. The company will have about two months to respond to the notice, according to the report. The corporate affairs ministry will further confirm if the company committed any corporate governance breaches and fund diversion. While Patanjali Ayurved is a closely held company, its unit Patanjali Foods Ltd. is publicly traded. Speaking to ANI, Baba Ramdev said that India is well aware of how to protect its borders and its nation. 'We have killed them (terrorists) by entering 100-200 kilometres inside their home. India launched Operation Sindoor on May 7 in response to the terror attack in Jammu and Kashmir's Pahalgam, which claimed 26 lives, including one Nepali citizen. Yog guru Baba Ramdev further said that India is, by nature, a Hindu nation. Delhi Transport and Health Minister Pankaj Kumar Singh on Friday promised to induct 4000-plus electric buses in the city by the year-end and promised to unveil a Yoga-based plan to manage diabetes in the coming months. "Pollution is a focus area for our government, and all departments are jointly taking steps to tackle it. At the transport department, we are determined to replace the ageing CNG buses with electric vehicles," he told IANS on completing 100 days in office. He highlighted the implementation of health schemes like Pradhan Mantri Vaya Vandana Yojana (PMVVY) for the elderly, Ayushman Mandir, Ayushman Card, and check on irregularities in drug supply as some of the achievements of the health department in the first 100 days of the government. "The Ayushman scheme, whose benefits should have reached people long ago, was blocked by Arvind Kejriwal's government. We have supplied cards and enrolled beneficiaries through door-to-door drives," he said, adding that about 2.31 lakh beneficiaries have been issued health cards under the two schemes. The Minister hit out at the previous Aam Aadmi Party (AAP) government for indulging in publicity rather than serving the people on the ground. "We could not find anything positive in the functioning of the previous government. There are scams in almost everything related to drinking water, road, pollution, Yamuna-cleaning, transportation, hospital drug supply," he said, adding that, under the previous government, just five medical superintendents were running the affairs of all major hospitals in the city. Hitting out at the AAP government and its legislators, he said, "They did not perform and indulged only in the blame game. We are focused on delivering on the promises that we made." Describing diabetes as a common ailment affecting people, he said, "We are working on a new plan named 'Diabetes-plus with yoga'. Very soon, we will share information with the public," he said, adding that the health department is focusing on the smooth functioning of free dialysis centres.
