PETALING JAYA: The defence team for Ismanira Abdul Manaf, the mother of Zayn Rayyan Abdul Matin, closed its case today after presenting five witnesses. The court has scheduled the verdict for October 31. Defence counsel Haresh Mahadevan informed the court that no further witnesses would be called following the testimony of child psychologist Dr Noor Aishah Rosli. Judge Dr Syahliza Warnoh set September 8 for written submissions, September 22 for oral replies, and October 31 for the final verdict. Ismanira was ordered to enter her defence on July 21 after the prosecution established a prima facie case. She testified over three days, maintaining her innocence. Dr Noor Aishah testified that WhatsApp messages exchanged between Ismanira and her husband were normal expressions of frustration from a mother caring for an autistic child. She stated, 'From a psychological perspective, these should not be viewed as an intention to commit a crime. If you ask anyone, it's common for messages to a spouse to contain harsh words, but without any intent behind them.' She described the messages as emotional venting rather than evidence of abuse, adding, 'I find these kinds of conversations reflect a marital relationship. The language may appear harsh, but it's just surface-level, idle talk meant only to release emotions.' The prosecution was led by deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi. Ismanira's defence team included Haresh Mahadevan, Ramzani Idris, and Lavanesh Haresh. Zayn Rayyan was reported missing on December 5, 2023, and his body was found the next day near his home at Apartment Idaman, Damansara Damai. An autopsy revealed injuries consistent with self-defence. Ismanira and her husband, Zaim Ikhwan Zahari, had pleaded not guilty to neglecting their son under Section 31(1)(a) of the Child Act 2001, which carries a maximum penalty of RM50,000, 20 years' imprisonment, or both. PETALING JAYA, Aug 5 — The defence team for the mother of Zayn Rayyan Abdul Matin, charged with neglect resulting in physical harm to her six-year-old autistic son, closed its case today after calling five witnesses. Defence counsel Haresh Mahadevan, representing Ismanira Abdul Manaf, 30, informed the court that the defence was closing its case following the testimony of child psychologist Dr Noor Aishah Rosli, 49, who took the stand today. 'The defence has no further witnesses, and we close our case today,' he said. Judge Dr Syahliza Warnoh then fixed Sept 8 for written submissions from both parties, Sept 22 for oral replies and Oct 31 for the verdict on whether to convict or acquit Ismanira. On July 21, the court ordered Ismanira to enter her defence after the prosecution established a prima facie case against her at the close of its case. She testified in her own defence over three days, beginning July 21. Earlier, Dr Noor Aishah testified that the following WhatsApp messages were normal expressions from a mother caring for an autistic child: 'haishhh stress nak mati' ( I'm so stressed I could die) 'budak ni elok je takde pun aku pukul… sebenarnya aku tepuk punggung masing-masing je tapi aku cakap perkataan berlasah sebab aku tengah geram dan marah sangat-sangat' (The kid's fine, I didn't actually hit him… I just smacked his bottom, but I said 'beat up' because I was feeling really annoyed and angry). 'From a psychological perspective, these should not be viewed as an intention to commit a crime. If you ask anyone, it's common for messages to a spouse to contain harsh words, but without any intent behind them,' she said. She described the messages as Ismanira's way of expressing affection for her son while venting to her husband, who was at work at the time. Dr Noor Aishah said the texts were emotional outbursts, light-hearted remarks, and not to be taken seriously, with no indication of malicious intent. 'I find these kinds of conversations reflect a marital relationship. The language may appear harsh, but it's just surface-level, idle talk meant only to release emotions,' she added during examination-in-chief by Haresh. Today's proceedings were conducted by deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz and Nur Sabrina Zubairi, while Haresh, Ramzani Idris and Lavanesh Haresh appeared for Ismanira. On July 21, Judge Syahliza ordered Ismanira to enter her defence after ruling that the prosecution had established a prima facie case against her. Her husband, Zaim Ikhwan Zahari, 30, was discharged and acquitted of the same charge. On June 13 last year, Zaim Ikhwan and Ismanira, both aged 30, pleaded not guilty in the Sessions Court to a charge of neglecting their six-year-old autistic son in a manner likely to cause physical harm, along PJU Damansara Damai between noon on Dec 5 and 9.55 pm on Dec 6, 2023. They were charged under Section 31(1)(a) of the Child Act 2001, which is punishable by a maximum fine of RM50,000, imprisonment of up to 20 years, or both upon conviction. Zayn Rayyan was reported missing on Dec 5, 2023, and his body was discovered in a stream near his home at Apartment Idaman, Damansara Damai, the following day. He was believed to have been murdered, and an autopsy revealed injuries to his neck and body, consistent with self-defense. — Bernama

(Bernama pic) PETALING JAYA : The mother of Zayn Rayyan Abdul Matin told the sessions court today that a WhatsApp message she sent her husband on the day their son went missing, which included the phrase 'don't care whether live or die', was in reference to herself – and not Zayn. During examination, Ismanira Abdul Manaf's lawyer Haresh Mahadevan asked her to clarify the meaning of the message. 'Those words were about me,' she said. 'I wasn't referring to my son. I was panicked, sad and rushing around trying to find him. 'I really needed my husband's attention, so I sent him that message to get him to immediately come home and help me.' Ismanira, 30, was testifying in her defence against a charge of neglecting her six-year-old autistic child in a manner likely to cause him physical harm. The offence allegedly occurred at PJU Damansara Damai between noon on Dec 5, 2023, when the boy was said to have gone missing, and 9.55pm the following day, when his body was discovered in a stream near his home at Apartment Idaman at Damansara Damai. On Monday, Ismanira's husband Zaim Ikhwan Zahari, 30, was acquitted of the same charge after the prosecution failed to prove a prima facie case against him. Previously, an analyst from the police forensics lab, Zaidi Abu Hassan, testified that he had extracted WhatsApp messages from two phones allegedly belonging to the couple which included the said message. They were all sent on the day Zayn went missing. Zaidi said that he extracted the messages using a mobile data recovery software known as XRY. The defence team also comprises Ramzani Idris and Lavanesh Haresh. Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz and Nur Sabrina Zubairi are appearing for the prosecution. The trial before judge Syahliza Warnoh continues.

PETALING JAYA : The mother of Zayn Rayyan Abdul Matin told the sessions court today that police forced her to confess to the murder of her autistic son during the investigation into his death last year. Ismanira Abdul Manaf, 30, said she was pressured into admitting guilt when she was brought before a magistrate for a remand order. Under examination-in-chief by her lawyer Haresh Mahadevan, Ismanira claimed that officers coerced her into confessing before magistrate Zhafran Rahim Hamzah. 'I told the magistrate I was not willing to be there before him. The police forced and threatened me to admit to the murder. 'The magistrate recorded a not guilty plea,' she said in court today. She also claimed that during the 13-day remand period, police were unhappy with her answers despite her giving her full cooperation. 'They created a story saying that I found my son, then killed him. I denied it, but they weren't satisfied.' Ismanira claimed she was beaten and threatened by the officers who were unhappy with her denial during the interrogation, which allegedly took place at a safe house. She also alleged that while some officers had pressured her to confess, others were sympathetic. 'Some told me they knew I was innocent, but they had to follow orders. They asked me to be patient until the remand ended,' she said. Ismanira was ordered to enter her defence yesterday while her husband, Zaim Ikhwan Zahari, was acquitted of the same charge. Ismanira and Zaim were charged last year with neglecting Zayn in a manner likely to cause him physical harm.
