HC orders CB-CID probe into assault of convict prisoner
Madurai: Madras high court on Monday ordered the CB-CID to investigate the case concerning the assault on a convict prisoner by police personnel in Trichy Central Prison. A division bench of justice A D Jagadish Chandira and justice R Poornima passed the order while hearing a habeas corpus petition filed by M Angammal of Madurai, mother of the convict prisoner M Harikarasudhan. The petitioner stated that her son, Harikarasudhan, was arrested by the SS Colony police in Madurai for offences under the NDPS Act in 2020. In 2024, the I additional NDPS special court in Madurai convicted and sentenced him to 14 years of imprisonment. He was lodged in Madurai Central Prison, where he completed Class X. She mentioned that her son was transferred to Trichy Central Prison six months ago for his studies since he applied to pursue an ITI course. On July 26, her son was beaten up by deputy jailor, Manikandan using a lathi when he was lying in his prison cell. She claimed that several other police personnel came to the cell and assaulted her son, causing him severe injuries. On July 28, when their lawyer visited the prison for an interview, Harikarasudhan showed him the injuries. Undo Hence, the petitioner moved court seeking action against the police personnel. Earlier, the court called for a report from the Trichy principal district judge, who is the chairperson of the district legal services authority. According to the report, while Harikarasudhan was reading a newspaper, Manikandan came to the block for usual rounds and asked Harikarasudhan to stand and inquired why he did not go to work. Harikarasudhan, without standing, replied while sitting on the floor. Angered by this, Manikandan slapped him. Harikarasudhan retaliated by slapping Manikandan. Thereafter, Harikarasudhan was dragged from the prison block and assaulted by Manikandan and other prison personnel. The doctor's report confirms that Harikarasudhan sustained injuries and was referred to the prison hospital on July 27. Subsequently, treatment was provided to him. Admittedly, it is a case of assault and ill-treatment of a prisoner by prison staff inside the prison, the court observed. Case filed against Tiruchy jail deputy jailor, 22 others for attacking convict
TIRUCHY: The KK Nagar police on Saturday registered a case against deputy jailor Manikandan, head warder Arunkumar, another unnamed prison official, and 20 guards of Tiruchy Central Prison for allegedly assaulting a convict, M Harikarasudhan. The case was filed after a complaint was registered by M Angamal, mother of the convict, with the DIG (prisons). An inquiry report by the principal district judge of Tiruchy confirmed the allegations, which were also reviewed by the Madurai Bench of the Madras High Court. Following this, the jurisdictional police station, which is KK Nagar police station, registered a case under seven BNS provisions, including Section 115(2) for voluntarily causing hurt, Section 117(2) for voluntarily causing grievous hurt, and Section 127(2) for wrongful confinement. Harikarasudhan, a Madurai native serving time at Tiruchy Central Prison, was transferred from Madurai Central Prison in October 2024 to pursue an ITI course after completing Class 10 in custody. He was convicted in a ganja case last year. His mother alleged that he was assaulted last month and denied visits from family and lawyers, prompting her to file a habeas corpus petition. On August 7, Justices A D Jagadish Chandira and R Poornima, citing an inquiry report by a district court judge, sought detailed records from prison authorities. They then set aside a privilege withdrawal imposed on the convict in violation of prison rules and allowed Angammal to meet Harikarasudhan, permitting him to file a complaint in the KK Nagar police station. The matter will be heard on August 11.

Prisoner assault: Madurai Bench of Madras HC seeks report, records from prison officials
MADURAI: Hearing a habeas corpus petition alleging assault on a convict by Tiruchy Central Prison officials, the Madurai Bench of the Madras High Court on Thursday sought a detailed status report from the prison authorities, along with documents, such as jailor daily report book, the convict's treatment records, and the service register of the deputy jailor concerned. A bench of justices A D Jagadish Chandira and R Poornima gave the direction after perusing the inquiry report, submitted by the Principal District Judge of Tiruchy, which confirmed the above allegations. Petitioner M Angammal -- mother of the convict, M Harikarasudhan -- sought action against erring officials. During the hearing on Thursday, the judges noted that following the incident, the deputy jailor was placed under compulsory wait and Harikarasudhan was imposed with a punishment of withdrawal of privileges. Finding that the punishment on the prisoner was imposed without following the procedure under rules 303 and 304 of the Tamil Nadu Prison Rules, the judges set aside the same and permitted Angammal to visit her son. Also, they added that Harikarasudhan is at liberty to file a complaint before the DIG, Tiruchy prison, which could be forwarded to the jurisdictional police for registering a case. The matter was adjourned to August 11 for the filing of the above reports and documents.
