Lorry driver fined ₹11,500 for assaulting PSI on Mangaluru road

The second Additional District and Sessions Court, Dakshina Kannada, overturned the acquittal order of lower court to impose fine of ₹11,500 on a lorry driver for assault of police sub-inspector (PSI), Mangaluru South Police Station, on U.P. Mallya Road in Mangaluru in July 2013. Judge V.N. Jagadeesh, on June 25, convicted Kiran Johnson Pereira, 31, of Farangipet, for offences punishable under sections 506 (criminal intimidation), 323 (voluntarily causing hurt) and 332 (voluntarily causing hurt to deter public servant from duty) of Indian Penal Code (IPC) and under Rule 69 read with section 177 of Indian Motor Vehicle (IMV) Act. The judge imposed fine of ₹5,000 each for offences under sections 332 and 506 of IPC, and ₹1,000 for offence under section 323 of IPC. The lorry driver was asked to pay fine of ₹500 for the offence under Rule 69 read with section 177 of IMV Act. In the judgement the judge observed that there was evidence to show that the lorry driver on July 29, 2013, drove his vehicle on the road where Deputy Commissioner has barred movement of heavy vehicles between 8 a.m. and 8 p.m. On being questioned by the PSI discharging duty on the road, the lorry driver assaulted the PSI, gave a life threat to the officer. After the driver was assaulted by people, he abandoned the vehicle and ran away, the judge noted. The second Judicial Magistrate First Class (JMFC) Court, Mangaluru, on December 29, 2023 acquitted the lorry driver. Allowing the appeal filed by the State, Judge V.N. Jagadeesh said the finding recorded by the trial court was contrary to the evidence available in the case. The judge directed the trial court (2nd JMFC) to secure presence of the accused to pay the fine amount. The entire fine amount of ₹ 11,500 should be remitted to the government, the judge stated.

Bengaluru: Close on the heels of the ban on bike-taxi services, Bengalureans complained about rising incidents of "autocracy" with several incidents of autorickshaw drivers fleecing the commuters with faulty meters. Cracking the whip on such errant drivers, Bengaluru Traffic Police booked over 1,000 cases Saturday and collected Rs 4.9 lakh in fine from autorickshaws and other traffic violators in the west division. Based on the commuters' ordeal, TOI published a report on traffic violations in its June 20 edition. During the day-long drive against errant autorickshaw drivers in and around Majestic, Ananda Rao Circle, KSR Railway Station, MG Road, Church Street, Cubbon Park and surrounding areas, 180 cases were booked under various sections of the Indian Motor Vehicles (IMV) Act and fine worth Rs 89,700 was collected. The highest number of cases (84) was booked against auto drivers not wearing the khaki uniform, resulting in a fine of Rs 42,000. Similarly, 52 cases were booked against those demanding excess fare and Rs 21,600 was collected in fine. As many as 44 auto drivers were booked for refusing to go for hire and a fine worth Rs 21,600 was collected, according to BTP officials. "An auto ride between Nadaprabhu Kempegowda Metro Station in Majestic and Freedom Park would normally cost Rs 50. But Saturday, auto drivers charged Rs 75-100. In a major safety enforcement initiative, the Bengaluru Traffic Police conducted a special drive on Monday morning to check for drunk driving among school vehicle drivers. The three-hour operation, held between 7:00 AM and 10:00 AM, resulted in 58 school drivers being booked for driving under the influence of alcohol. A total of 4,559 school vehicle drivers were tested across the city during the surprise checks. Of those, 58 were found to have consumed alcohol and were immediately prosecuted under the Indian Motor Vehicles (IMV) Act. The driving licences of the errant drivers have also been sent to RTOs for suspension. In an official statement earlier, Bengaluru Police said, 'The vehicles in which the driver was found driving under influence of alcohol have been seized, and the permits of such vehicles have been recommended for cancellation by concerned RTOs.' The police assured citizens that these enforcement measures are part of a larger effort to enhance safety on city roads, especially for school-going children. 'Special drives will continue to make the city roads safer by stringent enforcement of traffic rules,' the statement added. In recent months, several school buses have been flagged for traffic violations and reckless driving. Following multiple complaints from parents and school authorities, the Bengaluru police intensified their vigilance. Officials also confirmed that such surprise checks will be conducted regularly across the city and warned that licences of drivers found violating rules will be cancelled.
