Paedophile's sentencing delayed after CPS fail to complete court order on time
The sentencing of an Isle of Wight paedophile has been delayed after the Crown Prosecution Service (CPS) failed to prepare a sex offender's order on time. Barry Leigh, of Whitcombe Road in Carisbrooke, appeared before the IW Magistrates' Court on Friday, August 8, for sentencing. The 71-year-old previously admitted distributing indecent photographs of children in Ryde between October 4 and 12, 2023. At the previous hearing, the court heard that Leigh had instigated a conversation with an undercover police officer and sent them two Category C images of children. Prosecutor Rhys Evans said Leigh was due to be sentenced for the indecent images offence, but his Sexual Harm Prevention Order (SHPO) had not been prepared in time by the CPS. The court heard that Leigh's SHPO will be a 'meaty' order and will help safeguard people and prevent further crime. Without the completed order, which will become active after Leigh's sentencing, it would be impossible to continue the sentencing, Mr Evans said. Magistrates were asked to order the forfeiture and destruction of Leigh's HP Laptop and Apple MacBook. Leigh was granted unconditional bail ahead of his new sentencing date on August 27.

"Reckless" care worker caught on video masturbating in car after client visit
A national shortage of ADHD medication after Brexit and Covid was blamed for an Isle of Wight care worker's 'reckless' decision to masturbate in his car after a client visit. James Gilbert, of Mill Hill Road in Cowes, attended the IW Magistrates' Court for sentencing on Friday, August 8. The 25-year-old admitted committing an act of outraging public decency. The court heard that Gilbert had been working in his role as a care worker on November 25 last year, and, following a visit to a client's home, he was seen masturbating in his car on Wellington Road in Carisbrooke. At a previous hearing, the court heard that Gilbert told officers during an interview that he was 'letting off steam' and considered his car a private space. Oscar Vincent, defending, said the person who had filmed the act had made a 'concerted' effort to video his client, implying that the offence had not been committed in full public view. The court heard that, following Brexit and the Covid pandemic, Gilbert's ADHD medication had been changed to an alternative due to a national shortage. Reading a letter from a doctor, Mr Vincent told magistrates the medication change caused 'unusual behaviour' of which Gilbert had no control. Magistrates instead described it as 'reckless behaviour,' and handed Gilbert a nine-month community order, which includes eight rehabilitation days. He must also pay a £120 fine, £114 surcharge and £85 in court costs.

Arrest warrant for woman accused of fleeing Cowes crash scene
A warrant has been issued for the arrest of a 27-year-old woman from Kent who is accused of failing to stop at the scene of a crash on the Isle of Wight. Sharley Coster, of Silverhurst Drive, Tonbridge, was due to appear before IW Magistrates' Court on Friday, August 8, to face three driving-related charges. The court heard that Ms Coster did not attend the scheduled hearing. In response, magistrates issued a warrant for her arrest, which is backed for bail. It is alleged that a Jeep, reportedly being driven by Ms Coster, was involved in a collision with a Nissan Qashqai. Police confirmed at the time that no injuries were reported. The Jeep involved did not remain at the scene, but officers later located the vehicle in Binstead a few hours later, according to police statements made at the time. Ms Coster is accused of the following offences: Failing to stop after a road accident Driving without due care and attention Failing to provide information relating to the identification of the driver of a vehicle when required A new court date has been set for August 29, when Ms Coster is expected to attend and submit her pleas.
