Court Allows Kejriwal Plea For No Objection Certificate For Passport Renewal

New Delhi: A Delhi court on Wednesday allowed the plea of former chief minister Arvind Kejriwal seeking a no objection certificate for the renewal of his passport. On May 28, Kejriwal told the court his passport expired in 2018, and he was seeking renewal for 10 years. The court of special judge Dig Vinay Singh, allowing the plea, said that the court had "no objection" if Kejriwal's passport was renewed for 10 years as per rules. The judge, however, made it clear that this order of the court shall not in any manner "fetter the discretion of the passport authorities" in granting or refusing the renewal of the passport under the Indian Passports Act and the relevant rules. Observing that the "no objection" granted through this order shall remain in force for a period of three months within which Kejriwal may get his passport renewed, the court said, "It goes without saying that the present order is not granting any permission to the applicant to travel abroad, and if he ever desires to travel abroad for any purpose, he shall have to file an appropriate application seeking such permission. " The court on May 29 issued notices to ED and CBI, directing them to file their responses by June 4. CBI opposed the plea by the former CM by filing a formal reply. ED did not file any formal reply but made only oral submissions to the effect that the renewal of the passport should not be granted for a complete 10 years. The court noted that at present, Kejriwal is not seeking any permission to travel abroad, obviously as he may not be planning to travel abroad in the immediate near future, but that too cannot come in the way of granting permission to the applicant for renewal of the passport for a complete 10 years. After all, the bail conditions already prescribe that the applicant shall not travel abroad without formal permission of the court, the judge said.

New Delhi: A Delhi court on Wednesday said it had "no objection" if the passport of former Delhi chief minister Arvind Kejriwal, an accused in the Delhi excise policy cases, was renewed for 10 years. Special Judge Dig Vinay Singh passed the order in the alleged scam-related corruption and money laundering cases, being probed by the CBI and the ED respectively, considering that Kejriwal would have to take formal permission of the court before travelling abroad. "Presently, the applicant is not seeking any permission to travel abroad, obviously as he may not be planning to travel abroad in the immediate near future, but that too cannot come in the way of granting permission to the applicant for renewal of the passport for complete 10 years. After all the bail conditions already prescribes that the applicant shall not travel abroad without formal permission of court," the order said. The judge added, "The applications preferred by Arvind Kejriwal for renewal of his passport is allowed and this court has 'no objection' if the passport ... of the applicant, namely, Arvind Kejriwal is renewed for 10 years as per rules." Both the CBI and the ED opposed Kejriwal's plea. While the ED said the renewal of passport should be not granted for a full 10 years, the CBI said the norms followed in different courts of CBI relating to such matters was that the renewal permission was granted for five years. The judge, however, clarified that the order should not in any manner fetter the discretion of the passport authorities in its grant or refusal of the renewal under the Indian Passports Act and the relevant rules. Kejriwal's counsel argued that his passport expired in 2018 and he has moved the application seeking its renewal for 10 years. The money laundering case stems from the CBI's FIR which was lodged after Delhi Lt Governor V K Saxena recommended a probe into the alleged irregularities in the implementation of the policy. According to the CBI and the ED, irregularities were committed while modifying the excise policy and undue favours were extended to the licence holders. The Delhi government implemented the policy on November 17, 2021, and scrapped it by the end of September 2022 amid allegations of corruption.

New Delhi, June 4 (UNI) A Delhi Special Court on Wednesday granted permission for the renewal of passport of former Delhi Chief Minister Arvind Kejriwal, an accused in the Delhi excise policy case. Special Judge for MPs/MLAs cases Dig Vinay Singh after the hearing said, "The application by Arvind Kejriwal for renewal of his Passport is allowed, and this Court has 'no objection' if the Passport no. P 9686868 of the applicant, namely, Arvind Kejriwal is renewed for 10 years as per rules." The court said, "These are two different applications preferred by the accused Arvind Kejriwal in the above-mentioned two matters, separately, seeking 'no objection' for renewal of his Passport for another 10 years. The Passport is stated to have already expired and as per rules of the Passport authorities without there being a 'no objection' granted by the Court where criminal trial is pending, a Passport cannot be renewed." CBI opposed the request of Kejriwal by filing a formal reply, the Directorate of Enforcement has not given any formal reply, but had made only oral submissions to the effect that the renewal of Passport be not granted for a full 10 years. It is submitted on behalf of CBI that the norms followed in different Courts of CBI relating to such matters is that the renewal permission is granted for five years, it said. The 'no objection' granted vide this order shall remain in force for a period of three months from today within which the applicant may get his Passport renewed. It goes without saying that the present order is not granting any permission to the applicant to travel abroad and if he ever desires to travel abroad for any purpose, he shall have to file appropriate application seeking such a permission." The Special Court had earlier issued notice to the Enforcement Directorate and Central Bureau of Investigation on the application of Kejriwal, who sought a no objection certificate (NOC) for renewal of his passport. Counsel for Kejriwal earlier submitted before the court that his passport has expired in 2018 and he has moved the application seeking its renewal for 10 years. In this matter the corruption case linked to the now-scrapped Delhi Excise Policy 2021-22 is being investigated by the CBI, and money laundering case registered under the provisions of Prevention of Money Laundering Act(PMLA) is being investigated by the ED. Central Bureau of Investigation registered the First Information Report (FIR) under section 120B of Indian Penal Code (IPC) read with Sections 7, 7A & 8 of the Prevention of Corruption Act (PC Act),1988, while the Enforcement Directorate registered Enforcement case Information Report (ECIR) under section 3&4 of the Prevention of Money Laundering Act(PMLA). Mr. Kejriwal's passport expired in 2018, and he wanted to get it renewed for 10 years. Special Judge Dig Vinay Singh, on May 29, had issued notice to Enforcement Directorate (ED) and Central Bureau of Investigation (CBI), probing the excise policy case, seeking their replies. Responding to the notice, the CBI opposed Mr. Kejriwal's request, stating that the norms followed in different courts of the CBI regarding such matters are that renewal permission is granted for five years. The ED, in its oral submissions, also made the similar point. The counsel of Mr. Kejriwal submitted that renewal permission be granted for a full 10 years as the AAP leader, in any case, has to seek permission to travel abroad. A Delhi court Wednesday granted a no-objection certificate (NOC) to former Delhi Chief Minister Arvind Kejriwal to renew his passport. The AAP chief is an accused in the corruption and money laundering cases linked to the alleged Delhi excise policy scam. 'In such circumstances, applications preferred by Arvind Kejriwal for renewal of his passport is allowed and this court has 'no objection' if the passport of the applicant, namely, Arvind Kejriwal is renewed for 10 years as per rules,' said Special Judge Dig Vinay Singh of Rouse Avenue Court in his June 4 order. While the Central Bureau of Investigation (CBI) had opposed the request, submitting that as per norms, renewal permission for five years should be granted, the Enforcement Directorate did not give a formal reply and stated orally that the renewal of the passport should not be granted for 10 years. The CBI, which is investigating the corruption case in the matter, was represented in court by Special Public Prosecutor (SPP) and Senior Advocate D P Singh. The ED, which is investigating the money laundering case, was represented by SPPs N K Matta and Simon Benjamin, along with advocate Faizan. Kejriwal, whose passport had expired in 2018, had sought a 10-year renewal. He was represented in court by advocate Mudit Jain. 'It is, however, made clear that the order of this court shall not in any manner fetter the discretion of passport authorities in grant or refusal of the renewal of passport under the Indian Passports Act and relevant rules. The 'no objection' granted vide this order shall remain in force for three months from today, within which the applicant may get his passport renewed,' the court said. 'It goes without saying that the present order is not granting any permission to the applicant to travel abroad, and if he ever desires to travel abroad for any purpose, he shall have to file an appropriate application seeking such permission,' it added. As per the central agencies, Kejriwal's role in the excise policy 'scam' allegedly involved receiving 'bribe money' from the 'South Group' (business persons from South India) in exchange for granting favours to them when the now-scrapped policy was being drafted. The CBI had alleged that Kejriwal ensured Rs 90 lakh from the 'bribe money' would be given to each of the 40 AAP candidates during the 2022 Goa Assembly polls. Kejriwal was arrested by the ED on March 21, 2024. On June 26, 2024, he was formally arrested by the CBI. He was granted interim bail by the Supreme Court in the ED money laundering case on July 12, 2024. The Supreme Court later granted him bail in the CBI case on September 13, 2024.
