The event saw significant participation from Sarva Khap representatives, professionals, and community members, particularly from Sonipat and Rohtak, who expressed their commitment to saving Haryana's youths by joining the awareness campaign. The initiative was announced during an international seminar titled 'Combating Drug Menace, Donkey Route Migration, and Crime in Haryana: Role of Sarvakhap Panchayats, NGOs, and Professionals', held at the YMCA in New Delhi Saturday. New Delhi: The Haryana Professional Forum, a collective of professionals hailing from Haryana and working within or outside the state, has launched a statewide campaign to tackle the escalating issues of drug addiction, crime, and illegal migration to countries like the US through the 'donkey route'. The Khap panchayats have joined them too. The forum is led by a group of convenors including IPS officer and Delhi Police Special Commissioner Sagar Preet Hooda and Supreme Court lawyer Prateek Som. Speaking to ThePrint Monday, Som said the forum plans to divide the state into clusters, assigning groups of professionals to specific areas to conduct meetings with youths and raise awareness about the dangers of drug addiction, crime, and illegal migration. Som highlighted the interconnected nature of these issues, noting that drug addiction often leads to petty crimes as individuals seek money to fund their habits. 'When one doesn't get their dose of drugs due to a lack of money, they resort to small crimes. Once they land in jail, they become hardened criminals and often join crime gangs,' Som explained. He emphasised the need to educate youths about the health and societal consequences of drug addiction, warning that a failure to address it could lead to early death due to drug-related illnesses or criminal activities. The campaign also seeks to address the issue of illegal migration through the 'donkey route,' a term used to describe the dangerous and illegal journey undertaken by many youths to reach countries like the USA via unauthorised routes. This year alone, 111 youths hailing from Haryana were deported from the US, 'bringing shame to the state known for its rich cultural heritage of Doodh Dahi Ka Khana' (a diet of milk and curd), the forum said. The forum plans to educate young people about the risks involved in such migrations, encouraging them to instead pursue legal pathways by acquiring in-demand skills and passing required exams like International English Language Testing System (IELTS) to migrate legitimately. Som clarified that the campaign is entirely volunteer-based and involves no financial contributions. 'Those who want to contribute will have to give their time,' he said, stressing the importance of community involvement. While government agencies like the police and local administration are doing their part, real change requires awareness among youths, he said. 'Unless the youths are made aware of these issues, such efforts are unlikely to bear fruit.' Som highlighted the alarming statistics surrounding drug addiction in Haryana. A recent report revealed that seven districts bordering Punjab—Sirsa, Fatehabad, Panchkula, Ambala, Kurukshetra, Kaithal and Hisar—along with Yamunanagar account for 86.70 percent of drug cases reported in the state over the last five years. Health department officials admitted that the lack of checks on vehicles crossing these borders is a primary reason for the easy availability of drugs. According to health department data, between 2019 and 2023, 14.80 lakh people visited outpatient departments (OPDs) for drug addiction in Haryana, with 12.90 lakh of them from these eight districts. 'The time has come for us to think about our families and society. The positive impact of the Green Revolution is fading, and today's youth are drifting away from agriculture in pursuit of a better lifestyle. We must step in before the situation worsens with drugs, crime, and gangs taking over,' he said. Hooda called for better coordination between Sarva Khap Panchayats, local administration, and professionals to raise awareness about the dangers of drugs, crime, and illegal migration. He urged parents to stay connected with their children, spend quality time with them, and encourage legal pathways for those aspiring to go abroad, such as pursuing higher education through legitimate means. Global Haryana Chamber of Commerce Chairman Balinder Kundu (USA chapter) and Karamjeet Singh Mann (Canada chapter) joined the seminar online, sharing their perspectives on illegal migration. Kundu and Mann highlighted the exploitation by agents who lure youths with false promises, often leading them to sell their land and take massive debts to fund their journeys. 'These youths end up living like labourers, hiding from authorities, with no contact with their families and no legal means to move freely due to the lack of valid visas or passports,' they said. IELTS ‘scam': Mehsana court sets aside trial court order, sends case to DGP directing probe by ‘honest, competent officers'

In a twist in the alleged 2022 IELTS scam being investigated by the Mehsana District police, the Mehsana Sessions court on Friday quashed and set aside the order of a trial court that allowed a 'B' Summary report — a final report of the police in a case where no evidence has been found to support allegations — to be filed in the case in April last year. The Sessions Court has now passed orders for sending the case to the Director General of Police for 'appointing honest and competent police officers' for further investigation in the case. Mehsana Additional Sessions Judge Chirag Pawar was hearing a Revision Application of the Mehsana District Superintendent of Police challenging the order of the trial court that allowed the 'B' Summary report filed by the Investigating Officer (IO), Deputy Superintendent of Police Dinesh Chauhan, in the case in April 2023, citing 'insufficient evidence against the accused'. The order of the Additional Sessions court, dated May 9 and made available on Monday, noted that the previous and original IO, BH Rathod, had filed a 'detailed objection and para-wise explanation against the Summary Report of DySP Chauhan and prayed to reject' it, seeking further investigation, when the Chief Judicial Magistrate Court (the trial court in the case) issued a notice to him. The case pertains to an FIR lodged in September 2022 at the Mehsana City B Division police station — now under the Commissioner of Police, Mehsana — by the then Police Inspector of Special Operations Group (SOG) of the district, Rathod, following a month-long investigation in the alleged racket related to the International English Language Testing System (IELTS). The FIR was lodged against 44 accused under Indian Penal Code (IPC) Sections for criminal breach of trust, cheating, forgery and criminal conspiracy, among others. In its order, the court has noted that the case was transferred for investigation to DySP Chauhan 'suddenly, vide an order' dated February 2, 2023, and on April 28, 2023, Chauhan filed a 'B' Summary report in the court of the Chief Judicial Magistrate of Mehsana, concluding 'that there is insufficient evidence against the accused'. The court considered the arguments put forth by the Mehsana District Government Pleader, VB Barot, who emphasised on the objections raised by Rathod and submitted that DySP Chauhan 'did not make proper investigation' and that the 'learned Chief Judicial Magistrate Mehsana exceeded his jurisdiction by calling upon the (DySP Chauhan) to collect further evidence in support of the summary report', praying for directions for the investigation to be handed over to 'other competent officer'. The court noted that Advocate RG Goswami, privately engaged by DySP Chauhan, made submissions that the officer had 'made detailed investigation and found that there is no sufficient evidence' in support of the alleged IELTS scam. The court noted that when a trial court makes 'jurisdiction error or error of law' in passing an order, the Revisional Court can 'interfere in the said order' but 'cannot reexamine' the evidence as if it is the proceedings of an appeal. Sending the case back to the trial court 'for passing appropriate order for further investigation', the Sessions court said that the case should be assigned to 'other competent and honest Police officer through the Director General of Police of Gujarat state, who can make detailed and proper investigation in the case.' During the course of the arguments, Mehsana district government pleader Barot also suggested that the court could also direct the Central Bureau of Investigation (CBI) to probe the case. To this, the court order stated, 'This Court cannot direct to make investigation of the case by CBI… it is required to be noted that District Government Pleader, representing the Police Agency of State… if he has lost faith in Police agency of the State of Gujarat then that would be a very sorry state of affairs, which needs to be viewed very seriously…' The court further said, 'Having considered the seriousness of offence, which involved illegal migration of youth from State of the Gujarat to the foreign countries without qualifying necessary IELTS Examination and without fulfilling necessary criteria for obtaining visa of foreign countries, the present Revision Application is required to be allowed by sending the case back to the (learned) Trial Court for passing appropriate order of further investigation…' The court also said that the observations made in the May 9 order were 'only for the purpose of deciding the Revision Application' and the Investigating Officer appointed by the DGP shall investigate the case 'without being influenced by the observations made in this judgment'. How the 'scam' was unearthed The racket was allegedly unearthed after six youngsters from Gujarat, who were nabbed by the US border authorities in March 2022 during a foiled attempt to enter the US from Canada, failed to answer basic questions in English, asked by a US judge during a court hearing. It then came to light that the ineligible students had allegedly received help to acquire high scores in the international English proficiency test to travel to Canada on student visas and then try and illegally enter the US. While four of those six students were from different parts of Mehsana district, two were from Gandhinagar and Patan. The scam was investigated based on a letter from the US Consulate General to the Commissioner of Police of Mumbai, who then sent the communication to then SP Mehsana. Rathod was handed a 'confidential investigation'.

Ahmedabad: A sessions court in Mehsana district rejected a closure report, which was accepted by a magisterial court, and ordered the state DGP to have the investigation conducted by "an honest and competent" police officer into the alleged IELTS scam .The scam was uncovered, and an FIR was filed in 2022 after four youths were caught crossing the Canada-US border. When they were produced in a US court and questioned, they expressed their inability to understand English and sought the help of translators. They officially cleared the International English Language Testing System (IELTS), required to study abroad. This incident led the US Consulate General here to bring the alleged malpractice to the police authorities' attention. He cited a news report published in TOI in May 2022 about the prevalent malpractice in securing IELTS a preliminary inquiry, an FIR was lodged with the Mehsana B Division police station against 45 persons. The investigation was conducted by deputy superintendent of police (DySP) Dinesh Chauhan, who filed a B summary (closure report) in a judicial magistrate first class (JMFC) court in April 2023 on the grounds of insufficient evidence in this case. The JMFC court on Oct 9, 2024, accepted the closure Mehsana superintendent of police, Achal Tyagi, objected to this development, and the police challenged the summary report before a sessions court, where the district govt pleader Vijay Barot pointed out an inadequate probe by the investigator and urged the court to transfer the investigation to the CBI in the interest of Chauhan hired a private lawyer to defend his decision to close the case and strongly opposed the prosecution's bid to reopen the investigation by getting the closure report hearing the case, additional sessions judge Chirag Pawar rued the situation where the public prosecutor, who was representing the police, sought a CBI probe. "It is required to be noted that district govt pleader is representing the police agency of state in the court of law and therefore, if he has lost faith in the police agency of the state of Gujarat then that would be a very sorry state of affairs, which needs to be viewed very seriously."The court did not accept the demand for a CBI probe, citing jurisdiction limitations. "However, having considered the seriousness of the offence which involved illegal migration of youth from state of the Gujarat to the foreign countries without qualifying necessary IELTS examination and without fulfilling necessary criteria for obtaining visa of foreign countries, the present revision application is required to be allowed by sending the case back to the trial court for passing appropriate order…", the court order sessions court has sent the matter back to the JMFC court for passing appropriate order of sending "the case to the Director General of Police of the Gujarat State for appointing honest and competent police officer to the rank of police inspector or DySP for making further investigation of the case on all the aspects within specific time and also to inquire into the aspect that why DySP Dinesh Chauhan submitted 'B' summary report without obtaining sanction and approval of higher authority," the order stated.
