Madras High Court Stays Student's Rustication Over ‘Jai Bhim, Free Palestine' Graffiti

Last Updated: The court observed that the action taken by the institution, if allowed to stand, would cause 'too much hardship' to the student, who is at the 'fag-end of his career' The Madras High Court has stayed the rustication of a postgraduate student of the Rajiv Gandhi National Institute of Youth Development (RGNIYD), who was expelled after allegedly painting graffiti reading 'Jai Bhim" and 'Free Palestine" on hostel walls. The bench of Justice TV Thamilselvi passed an interim order on May 29 in favour of the petitioner, S Aslam, a second-year Master of Social Work (MSW) student at the Sriperumbudur-based institute. The court observed that the action taken by the institution, if allowed to stand, would cause 'too much hardship" to the student, who is at the 'fag-end of his career". The controversy began on May 24 when graffiti was discovered in the boys' hostel. The following day, Aslam was rusticated through an administrative order issued by the Director of RGNIYD. According to Aslam, he was served a notice via WhatsApp merely an hour before the enquiry meeting and was denied an opportunity to present his defence or respond to the specific charges against him. Aslam contended in his plea that the enquiry process was biased and motivated. He alleged that the Assistant Registrar, Avinav Thakur (Respondent No. 6), who was part of the enquiry committee, harboured personal vendetta against him and other students for exposing an alleged sexual assault case pending against him in Jharkhand. The student claimed that Thakur influenced the disciplinary proceedings and, with the support of the hostel warden, orchestrated the action taken against him. Labelled as engaging in 'anti-national activity", Aslam argued that the rustication order was a violation of his right to dignity under Article 21 of the Constitution. He maintained that the institute neither provided him the list of charges nor considered his documentary evidence. Moreover, his plea to be allowed to take his final exams and complete his internship reportedly received no response from the administration. Taking note of these allegations and the academic stage of the student, the high court granted interim relief. The court directed the institute to reschedule examinations, issue him a hall ticket, allow participation in the block placement programme in the Department of Social Work, and include him in the official WhatsApp group to ensure educational continuity. Chennai: In a reprieve to a post-graduate student of Rajiv Gandhi National Institute of Youth Development, who was suspended for graffitiing 'Jai Bhim' and 'Free Palestine' in his hostel room, Madras high court stayed his suspension. Justice T V Thamilselvi also directed the institute to permit S Aslam to appear for exams and the internship programme. The court passed the interim order on a plea moved by the second-year MSW student challenging the suspension order dated May 25. According to the petitioner, on May 24, Avinav Thakur, assistant registrar, visited hostel premises with the warden and assistant warden and found 'Jai Bhim' and 'Free Palestine' graffiti on the wall. An inquiry committee was constituted. Since the petitioner and some other students exposed a pending sexual assault case against Kumar in Jharkhand, he influenced the committee and forced some students to depose against him, the petitioner said. Without providing an opportunity to the petitioner, the committee arbitrarily suspended him, the petitioner's counsel said, adding that if he is not permitted to attend the internship programme, it would be of irreparable loss to the petitioner. Recording the submissions, the court passed the interim order considering the welfare of the petitioner. The court directed the institute to issue a hall ticket to him so he can attend the exam and also permit him to attend the block placement programme in the social service department. The court then adjourned the hearing to June 25.

THE PUNE Rural Police, who are investigating the murder case involving the discovery of the partially-burnt bodies of a woman and two children near Pune–Ahilyanagar Highway, have expanded their probe to include missing persons cases from across Maharashtra and other states. Officials said they are examining cases with profiles matching the victims in an effort to establish their identities. The Pune Rural police had on Sunday launched a murder probe after the partially-burnt bodies of a woman, estimated to be aged between 25 and 30, and two children — believed to be her own -aged around two and four years were discovered at Khandale village near the Pune-Ahilyanagar Highway close to Ranjangaon town in Shirur taluka in the morning. Initial findings by police suggested that the victims might have been murdered elsewhere and their bodies transported and set on fire at the spot where they were discovered. 'As part of the probe, we are now looking into all the missing persons cases registered across Maharashtra and other states, with profiles matching the victims in an effort to establish their identities. Dedicated teams are looking at this database.' said an officer who is part of the probe. The Pune Rural police had on Monday released details of the woman's tattoos. The Initial probe and the autopsy has revealed the three were murdered by inflicting injuries to their heads before being set on fire to destroy the evidence. The detailed examination of the body of the woman has revealed that she had multiple tattoos. The woman was wearing a yellow sari with a floral design and was wearing a mangalsutra. Police have said that on the front of the right hand of the woman, there was a tattoo of a heart shape followed by a heartbeat sign in the form of an ECG line followed by words mom and dad in english. The right hand also has the words Jai Bhim written in Marathi. On the back side of right hand there is a tattoo with the name Kartik in Marathi in addition to two heart signs with letters R and S written in those hearts and the name Rajratan in english. On the left hand there is a tattoo of floral design. Police have also said that DNA analysis tests have been sought as part of the investigation. Samples for the same have been collected by the forensics team.

Three students of the Rajiv Gandhi National Institute of Youth Development (RGNIYD) have been rusticated and barred from writing semester exams this year for allegedly defacing the hostel walls with graffiti. Slogans 'Free Palestine' and 'Jai Bhim' were apparently written on the walls last week. An order from the institute stated that disciplinary action was initiated following the findings of a committee. The students belong to the second year of Master of Social Work programme. The order said a student was involved 'in gross misconduct within the hostel premises, specifically, the defacement of hostel property with content of an anti-national nature'. The student was given an opportunity to present his case before the committee on May 23. But the committee ruled that there was sufficient ground to conclude that he was involved. He was asked to vacate the hostel and rusticated from the institute with immediate effect. Aslam S, Sayeedh M. A., and Nahal Ibnu Abullaise -- all second-year MSW students -- issued a statement on Monday in which they said the institute had taken the decision less than 24 hours before their semester examinations. While denying their involvement, they maintained that the slogans were 'neither anti-national nor unlawful' but 'reflect democratic values and human rights, and such expressions fall well within the bounds of the Indian Constitution'. They demanded withdrawal of their rustication and a fair inquiry claiming that they were not allowed to examine the witnesses. They also alleged that the authorities had selectively inspected rooms. They said the authorities had found a paint roller and disposable plate with colors the students had used for 'academic field action project' which were falsely cited as evidence. The students further said they felt the inquiry process was 'deeply flawed'. They claimed they were not shown any evidence of their involvement, 'were not allowed to question or cross-examine any witnesses or reports' and were 'given no opportunity for legal or academic representation, nor sufficient time to prepare defense'. Despite repeated calls and messages to the proctor of the institute there was no response.

CHENNAI: Three students of the Rajiv Gandhi National Institute of Youth Development (RGNIYD) functioning under the Union Ministry of Youth Affairs and Sports in Sriperumbudur have alleged that the institution has arbitrarily rusticated them on the charge of defacing hostel property with 'content of an anti-national' nature. Aslam S, Sayeedh M A, and Nahal Ibnu Abullaise were pursuing second and final year of Master of Social Work (MSW) at the institute and were supposed to write their final exam on Monday. However, they were served rustication letters on Sunday, suspending them from the institute and expelling them from hostel. Institute authorities could not be reached for a comment until Monday night. Messages and calls to institute Director Subrata Hazra and Disciplinary Committee Chairperson S Suresh were not answered. Students claimed the institute had 'planned' the episode. Targeted for stir against staff: Rusticated students The students added that this was done to disallow them from writing the exam. 'We have been targeted by the administration for taking lead in a recent protest demanding the resignation of a senior administrative staff against whom sexual harassment charges have been leveled,' Nahal told TNIE. According to Nahal, on May 22, a few hostel officials noticed slogans such as 'Free Palestine' and 'Jai Bhim' written on the hostel wall, following which they inspected the hostel. However, Nahal contended that the inspection was limited to only a few rooms on a single floor. Acknowledging that they found some empty beer bottles and fabric colors in their room, Nahal alleged the authorities immediately jumped to conclusion and took action against the three and four more students in the room.
