Judge Afidah Abdul Rahman also ordered Indonesian nationals Andriyanto, 33, Wisnu Zaeni Malik, 21, Udin, 26, Rendi Farizi, 31, Ricky Muhamad Hakim, 22, and Rudi Ramli, 40, to be referred to the Immigration Department upon their release for deportation. The six were charged under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, which provides for a fine not exceeding RM10,000 or imprisonment for up to five years, or both, upon conviction. According to the facts of the case, police and immigration officers conducted a joint raid on an entertainment centre along Jalan Kubu here at around 10pm on May 9, 2025 and detained six men for inspection. Checks revealed they were Indonesian citizens whose social visit passes had expired. In separate proceedings in the same courtroom, Judge Afidah sentenced an Indonesian woman and her two male counterparts to three months' jail each after they pleaded guilty to abusing their social visit passes. Muhammad Mauludin, 30, Mujahidin Adu, 43, and Aliza, 25, were charged under Regulation 11(7) of the Immigration Regulations 1963, punishable under Regulation 39(b) of the same law, which carries imprisonment not exceeding six months or a fine not exceeding RM1,000, or both, upon conviction. They committed the offence at around 4.35pm on May 8, 2025 by working at a restaurant in the Saberkas Commercial Centre here, thus violating their social visit passes. In mitigation, the trio pleaded to the court for a lenient sentence, citing this was their first offence. Magistrate Ashok Linggam imposed the sentence on Zulqimi Sulaiman of Kampung Batu Satu in Kuala Baram after he pleaded guilty to a charge of criminal intimidation, framed under Section 506 of the Penal Code. The Section provides for a jail term of up to two years or a fine, or both, upon conviction. The offence was committed at the family's home in Kampung Batu Satu at around 3.15pm on May 16. According to the charge, Zulqimi pointed a knife towards his sister while threatening to cause injury to her and others. Deputy Public Prosecutor Luqman Hakim Sahrol Bahar prosecuted the case, while the accused was unrepresented.

Judge Afidah Abdul Rahman also ordered Lamisi, 43, to be referred to the Immigration Department for deportation upon his release from prison. The accused was charged under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, which provides for a fine of not less than RM10,000 or imprisonment not exceeding five years, or both, upon conviction. Chinese national in Miri jailed one day, fined RM10,000 for possession of protected agarwood

Photo shows the Miri Court Complex. — Photo by Jenifer Laeng MIRI (May 14): The Sessions Court here today sentenced a Chinese national to one day in prison and fined him RM10,000 in default three months' jail for illegally having protected agarwood (Aquilaria spp) in his possession. Judge Afidah Abdul Rahman convicted online seller Wu Ruxing, 48, of Fujian, China on his own guilty plea to a charge under Section 30(2) of the Wild Life Protection Ordinance, 1998 and punishable under Section 30(2) of the same Ordinance. The Section provides for an imprisonment term of one year and a fine of RM10,000. According to the facts of the case, Wu was found to have in his possession 820 grammes of agarwood, which is listed as a protected species under Part II of the Second Schedule of the Wild Life Protection Ordinance, 1998, without permission from the Controller of Wild Life. He committed the offence here on May 7 at around 1.15pm in a Jalan South Yu Seng budget hotel. In mitigation, Wu's legal counsel asked for leniency as this was his first offence and he was here on a social pass to visit friends. He also claimed to have bought the agarwood for personal use. Meanwhile, prosecuting officer Simon Engka Crown from the State Attorney-General's Chambers and Sarawak Forestry Corporation prosecuting officer Willy Chin Siaw Min argued that the harvesting of such agarwood species, which is listed as a critically endangered species under CITES and protected by the Ordinance, is a serious offence. They pointed out that the offence has a profound ecological impact as the removal of such a rare species disrupts the balance of the ecosystem and threatens biodiversity. They also argued that the possession of such a protected species also undermines ongoing conservation efforts that aim to protect endangered flora and fauna. The prosecution added that due to its high market value, the species is targeted for illegal harvesting, which made a harsher penalty both warranted and necessary.
