Immigration courts dismissing cases of Venezuelan migrants sent to El Salvador: Attorneys

The immigration cases of some of the Venezuelan migrants who were deported to El Salvador under the Alien Enemies Act in March have been dismissed, their attorneys said, raising concern from advocates and lawyers who say the move is a violation of due process. For more than two months, John Dutton, a Houston-based immigration attorney, fought to keep one of his client's immigration case open. Henrry Albornoz Quintero, who was detained in Dallas in January after showing up to a routine check-in with Immigration and Customs Enforcement, was deported to the notorious CECOT prison in El Salvador in March. After Quintero was deported, Dutton continued to show up to his client's immigration hearings where he says the government attorneys declined to answer questions about his client and pushed for dismissal. Quintero's case was dismissed "due to a lack of jurisdiction," Dutton said. "There's just nothing [the judge] could do," Dutton said. "Henrry is not here because the president shipped him out of the country. What's an immigration judge going to do to stop that?" Dutton previously told ABC News that Quintero's wife, who entered the U.S. with him last year, had a baby in April. MORE: Trump administration asks SCOTUS for permission to deport nearly 200 Venezuelan migrants Michelle Brane, the executive director of the immigration support group Together and Free, told ABC News that her team has tracked at least 15 immigration cases of migrants who were sent to CECOT that were recently dismissed. Some of the cases include active pending asylum applications. Brane said she believes immigration courts should "administratively close" the cases, which would allow them to be reopened "if and when" the person is brought back. "Dismissing as opposed to administratively closing is sort of making an assumption that these people will never come back," Brane said. "And I think that's premature and certainly based on the court decisions, so far, they should be brought back to receive some kind of due process." If the Venezuelan migrants were to be brought back, there is no process for reopening their immigration cases, Brane said. The Department of Homeland Security did not respond to ABC News' request for comment. Mark Prada, an attorney representing a 24-year-old Venezuelan, said he was able to have his client's case administratively closed. "I was able to cut the head off the snake before it could poke out of its hole," he told ABC News. Isabel Carlota Roby, an attorney for the Robert F. Kennedy Human Rights organization, told ABC News that at least seven of the 10 men her group represents had some form of legal protection in the U.S., including Temporary Protected Status or pending asylum applications before being deported to CECOT in El Salvador. MORE: Judge hears arguments over fate of CECOT detainees Roby said her group represents them internationally -- filing habeus petitions in El Salvador and other types of advocacy -- but does not represent them in U.S. immigration court. However, she said many of them have had their cases dismissed recently. She told ABC News that most of the migrants her group represents do not have immigration attorneys. "They basically represented themselves in court and presented their own asylum cases," Carlota Roby said. "Most of them simply were deported and their cases were just left behind and that was it." "They were denied due process, they are disappeared, and they are now in this legal limbo where they remain in a prison with no legal protections, excluded from the protection of the law, and they don't know if they'll ever have a chance at a fair trial," she added. The Trump administration invoked the Alien Enemies Act -- an 18th century wartime authority used to remove noncitizens with little-to-no due process -- to deport more than 200 alleged migrant gang members to CECOT by arguing that the Venezuelan gang Tren de Aragua is a "hybrid criminal state" that is invading the United States. An official with the ICE acknowledged that "many" of the men deported on March 15 lack criminal records in the United States -- but said that "the lack of specific information about each individual actually highlights the risk they pose." Many of their families have also denied gang involvement. The government is temporarily barred from removing migrants under the proclamation after the Supreme Court extended its injunction last month and remanded the case to the 5th U.S. Circuit Court of Appeals to resolve the question of how much time should be afforded for detainees to contest their removals. Some attorneys told ABC News they are appealing the dismissals. The lawyer for Jose Franco Caraballo Tiapa, a 26-year-old Venezuelan migrant who was seeking asylum in the U.S., and was detained after showing up to his routine check-in with ICE, filed an appeal after his client's case was dismissed. "The dismissal results in what can be construed as a violation of due process, as he was not given the opportunity to be heard on his asylum claim," said Martin Rosenow. Lindsay Toczylowski, the attorney who represents Andry Hernandez Romero, a gay makeup artist who was sent to CECOT in El Salvador, said in a statement that her client was denied due process. "DHS is doing everything it can to erase the fact that Andry came to the United States seeking asylum and he was denied due process as required by our Constitution," Toczylowski said. "The idea that the government can disappear you because of your tattoos, and never even give you a day in court, should send a chill down the spine of every American." In the statement posted by Immigrant Defenders Law Center, the group said the dismissal of Hernandez's dismissal is "not the end." The group said it will file an appeal and continue its advocacy to bring the 32-year-old back to the U.S. Immigration courts dismissing cases of Venezuelan migrants sent to El Salvador: Attorneys originally appeared on

Bitter Kevin Costner makes shock jibe at Yellowstone

Kevin Costner has made a shock jibe about Yellowstone, the series he acrimoniously departed last year amid a rumored rift with creator Taylor Sheridan. During an interview with Entertainment Tonight, Costner - who first began playing patriarch John Dutton in 2018 - mused the characters 'all should be in prison'. 'Well it's modern day ranching. Yellowstone was able to capture that really so beautifully. I mean, it's a bit of a soap opera,' the actor, 70, told the outlet. 'I mean, we all should be in prison,' he said, seemingly alluding to all the killings occurring in the show. Kevin's character John was unexpectedly killed in a murder-for-hire plot during the premiere of Yellowstone's season five part two in a death several fans interpreted as a final 'F U' from Sheridan amid their rumored spat. Last year, in an exclusive video obtained by the Oscar winner said of the show's finale: 'I'm not thinking about [the Yellowstone finale], I don't think I've given it any thoughts, we'll just let it go.' News first started to spread about Costner potentially leaving the show in 2023, amid rumors of a rift between the actor and series creator Taylor Sheridan. Costner's attorney Marty Singer denied rumors that Costner refused to film on the show for more than just one week in Season 5 Part 2. 'The idea that Kevin was only willing to work one week on the second half of Season 5 of Yellowstone is an absolute lie,' Singer said last summer. 'It's ridiculous — and anyone suggesting it shouldn't be believed for one second,' he added. The filming conflicted with Costner's plans to direct his first movie in 20 years - Horizon - the first in a planned four-part Western movie series. Costner ultimately confirmed in June 2024 that he would not appear at all in Season 5 Part 2, in a video he posted to Instagram. 'I want to reach out and let you know that after this long year and a half of working on Horizon and doing all the things that's required, and thinking about Yellowstone, that beloved series that I love, that I know you love, I just realized that I'm not going to be able to continue Season 5B or into the future,' Costner said. 'It was something that really changed me. I loved it. And I know you loved it. And I just wanted to let you know that I won't be returning and I love the relationship we've been able to develop and I'll see you at the movies,' he added. Costner's 'soap opera' remarks echoed previous comments director Quentin Tarantino made about the show that did not sit well with fans, with the iconic filmmaker dismissing the series as little more than a 'soap opera.' The online drama kicked off in December 2024 after the Pulp Fiction creator was asked to compare movies with modern TV shows during an appearance on The Joe Rogan Experience podcast. While Tarantino admitted that some recent TV series are 'pretty good,' he argued they are never as 'compelling' as feature films and used Yellowstone as his prime example. 'I didn't really get around to watching Yellowstone the first three years or so. Then I watch the first season, and I'm like, "Wow, this is f****** great!" I've always been a big Kevin Costner fan, he's f******wonderful in this,' Tarantino recalled. 'And I get really caught up in the show, I'm having a great time watching. And the first season, I'm kind of talking like, "Oh, this is like a big movie."' He continued: 'While I'm watching it, I'm compelled. But at the end of the day, it's just a soap opera.' And just to drive the point home, he added, 'You don't remember it five years from now,' which, naturally, set fans of the hit show on fire. The backlash came fast and furious, with Yellowstone lovers flooding social media to defend their beloved series and call out Tarantino for his 'dismissive' take.

Yellowstone was abruptly cancelled three seasons too soon because of Kevin Costner's exit

The popular Paramount+ Western series Yellowstone ended after five seasons in December 2024, and fans were left wondering if concluding the Dutton family saga at this point had always been part of the plan. Turns out, that wasn't the case. According to a new report from Bloomberg, co-creator Taylor Sheridan had initially planned to roll out three more seasons starring Kevin Costner, Luke Grimes, Kelly Reilly, and Wes Bentley. However, the plan fizzled out after the sudden and shocking departure of Costner. Kevin Costner's exit ended Yellowstone future Season 5 of Yellowstone showed the family reeling from the aftermath of John Dutton's murder, and in a shocking twist by the end of the season, we see Sarah, Jamie Dutton's girlfriend, who played a big role in John Dutton's cold-blooded murder, meet her brutal end. Though the show concluded with a cliffhanger, leaving the question of who hired shooters to kill Sarah unresolved, the hopes for the show's renewal were dashed by the makers. As Bloomberg puts it, 'Yellowstone ended about three seasons before Sheridan had hoped because of a conflict with Costner.' But if you've been following the drama for a while, this news probably won't surprise you, as Costner has been vocal about not seeing eye to eye with Sheridan. The duo reportedly had bad blood for months, which ended on a sour note, mostly because of scheduling and contractual conflicts. In one interview with Deadline, Costner even mentioned how, at the time, he was working on Horizon, his own Western project. Because the Yellowstone character was the one he loved the most and always prioritised, when the shooting schedule demanded his presence, he revealed that he left the filming and arrived on the Yellowstone set only to find 'there was no script' at all. He ended up walking away. The show had to continue without its main character, John Dutton. However, according to Costner, the narrative spread in the media was completely spun. 'What you read in the end was that I said, 'Well, look, I'm doing my movie. If you want me to work a week because you want to kill me or whatever else, I can give you a week,' ' Costner told Deadline. 'I really didn't have that week to give them, but I said, I'll do that. And then they [spun that] into, I only wanted to work a week.' The end of John wasn't some grand farewell either. He was written off quietly, without much fuss, which left a lot of fans upset. Back in May 2023, Costner even told Deadline he was prepared to sue the studio. 'I made a contract for seasons five, six, and seven. They wanted to redo that one, and instead of seasons 6 and 7, it was 5A and 5B, and maybe we'll do six.' But instead of getting season 6, the show hit a break midway through season 5, and after a long break, it came back with a rushed ending. And just to remember how big Yellowstone had gotten: the Season 4 finale brought in over 10 million viewers. What happens next in the Yellowstone universe? Sheridan might have shut the door on Yellowstone, but a lot of spinoffs are already in the works. According to Collider, Dutton Ranch (with Beth and Rip, played by Kelly Reilly and Cole Hauser) is dropping later this year. A Kayce Dutton spin-off starring Luke Grimes has locked a 2026 window. The Madison, another new show with Michelle Pfeiffer, Kurt Russell, and Matthew Fox, is also in the lineup alongside a prequel. Two other spin-offs, titled 1923 and 1883, have already aired.
