Chennai: Madras High Court has permitted the termination of the 28-week pregnancy of an 80% disabled survivor of rape. The court said that although the 24-week limit permissible under the Medical Termination of Pregnancy Rules, 2003, had been crossed, the victim is entitled to medical termination of pregnancy. In view of the fact that the survivor is 80% disabled, her mother noticed only recently, by which time 24 weeks had elapsed. Therefore, the outer limit of 24 weeks need not be held as a barrier in this case, said Justice D Bharatha Chakravarthy said. The only consideration that must be made is the one suggested by a medical board. If the experts say termination is possible then it shall be done, notwithstanding the rules, the court stated. The court then directed the Dean of the Government Medical College Hospital, Chengalpet, to constitute a medical board at the earliest to examine all the risk factors and render an opinion. The termination should be performed immediately if that is the expert opinion or if it is not advisable, the petitioner should be informed, the judge added. The court passed the order on a plea moved by the mother of the victim. According to the petitioner, the victim was affected by chronic neurological conditions, and both her hands and limbs were completely paralysed. As of Oct 6, 2022, a disability certificate stating 80% permanent physical impairment was issued to the victim. On April 10, the petitioner, noting symptoms such as bloating of the stomach, became suspicious. Upon inquiry, she found out that a neighbour had sexual intercourse with her daughter and threatened to kill her if she revealed it to anyone. MSID:: 121441690 413 |

CHENNAI: The Madras High Court held that conferring titles like Mr India, Ms India, or South India for winners of bodybuilding competitions is not violative of the provisions of the Emblems and Names (Prevention of Improper Use) Act. Justice D Bharatha Chakravarthy said in a recent order that as far as the sport of bodybuilding is concerned, it is common knowledge that whoever wins the competition is called Mr or Ms South India or India or World. That is common and specific to the sport. He stated this does not in any manner mean that it is the use of any national emblem or name of the country for any trade, business, or profession. It is synonymously used to refer to the title winner of such bodybuilding competitions. The judge pointed out that the law only prohibits the use of the nation's name or emblem in any trade, business, calling, or profession, or in the title of any patent, or in any trademark or design without the previous permission of the government. The orders were passed while dismissing the petitions filed by the Puducherry Bodybuilders & Fitness Association praying for restraining a group of individuals from conducting the bodybuilding competitions and conferring such titles to winners.

'OCI card valid ID for legal heirship': Madras HC

CHENNAI: The Madras HC has ruled that the Overseas Citizen of India (OCI) card/ booklet is a valid identity document that could be used for obtaining legal heir certificate in India. Justice D Bharatha Chakravarthy, in a recent order, said as per the Union government's notification, state governments should ensure the OCI registration booklets of Overseas Indians are treated as valid identification for any services. The ruling was given on the petition filed by Manel Amrithkala, an OCI, seeking a direction to the Egmore tahsildar to process her application for legal heir certificate by accepting the OCI card/booklet as identification document as her husband, Dr S Subramaniam, died on March 5. The petitioner said she has been living abroad and do not possess an Aadhar card or any other locally issued ID. The online portal for legal heir certificate is not accepting their application. The judge directed the tahsildar to process her application in accordance with the law and pass appropriate orders within four weeks by treating the OCI card/ booklet as an identity document.

This does not in any manner mean that it is the use of any national emblem or name of the country for any trade, business, or profession. It is synonymously used to refer to the title winner of such bodybuilding competitions. The sport is conducted to encourage physical fitness among individuals, the judge added. The law only prohibits the use of the nation's name or emblem in any trade, business, calling, or profession, or in the title of any patent, or in any trademark or design without the previous permission of the govt, he said. "I do not see the conferring of such titles for winners of the sport in any manner violative of Section 3 of the Act,"v he added. The court passed the order while dismissing a plea moved by the Puducherry Bodybuilders & Fitness Association seeking to restrain a group of private individuals from conducting the sport and conferring such titles to winners. According to the petitioner, an advertisement was issued regarding the sport event containing the words Mr India and Mr South India, which is violative of Section 3 of the Emblems and Names (Prevention of Improper Use) Act.
