As they were approaching the Duta toll plaza, a black Nissan Navara 4×4 pickup truck cut into their lane and sideswiped the motorcycle and caused the couple to crash. In the footage, Faizal can be seen limping after the crash while his wife lay unconscious on the road. The riders on the motorcycle with the dashcam immediately stopped to divert traffic away from the unconscious Suhailiza. High Court raises Nissan Navara driver's jail term to 6 months

PETALING JAYA : The Kuala Lumpur High Court has increased K Darmaraju's jail sentence from 30 days to six months for sideswiping a motorcycle carrying a couple on the PLUS Highway on May 10. Justice K Muniandy handed down the revised sentence after allowing the prosecution's appeal against the magistrates' court's sentence of 30 days in prison, Harian Metro reported. The High Court upheld the RM12,000 fine and five-year driving licence suspension imposed on Darmaraju, who had pleaded guilty to recklessly driving a Nissan Navara in the incident. Deputy public prosecutor Sabri Othman said the initial sentence did not reflect the seriousness of the offence or the Dewan Rakyat's intent to impose heavier punishments for reckless driving in amending the Road Transport Act. He said the crash left pillion rider Suhailiza Shamsudin, 49, permanently disabled and still in the intensive care unit with head injuries, while motorcyclist Faizal Mat, 53, suffered a broken collarbone and ankle. 'The 30-day sentence pales in comparison to the suffering endured by the victims,' Sabri said, adding that public outrage showed the need for a heavier sentence. He added that Darmaraju was speeding and overtook the motorcycle from the right before sideswiping it, causing both victims to be thrown from the vehicle. Darmaraju then fled the scene without offering help. A dashcam recording submitted to the court confirmed the sequence of events involving the Navara. Darmaraju was represented by lawyers S Vinesh and T Daneish. Darmaraju, 32, was initially sentenced to 30 days' jail and fined RM12,000 after pleading guilty to reckless driving under Section 42(1) of the Road Transport Act. From 30 days to six months: Jail term increased for Nissan Navara driver in Duta Toll motorcycle crash
KUALA LUMPUR, May 19 — The High Court here today increased the 30-day jail term to six months for the driver of a four-wheel drive vehicle who crashed into a couple riding a high-powered motorcycle near the Duta Toll Plaza and fled the scene two weeks ago. Judge K. Muniandy made the ruling during a review of the Magistrate's Court's decision to impose a 30-day jail term and RM12,000 fine on K. Darmaraju, 32, for reckless driving on May 13. The judge ordered the six-month jail sentence to commence from the date of arrest on May 11 and upheld the RM12,000 fine. The accused, a car accessories salesman, was also disqualified from obtaining a driving licence for five years. Earlier, deputy public prosecutor Mohd Sabri Othman argued that the 30-day sentence would pass in an instant and the RM12,000 fine had been paid, but the victims had suffered permanent disability and relied on family support and hospital treatment. 'Therefore, the prosecution is seeking a punishment that will serve as a lesson to the accused and to the public. This case should serve as a reminder of the risks, impact and consequences of reckless driving,' he said. Defence counsel S. Vinesh requested that the High Court judge uphold the Magistrate's Court's decision. Darmaraju was charged with recklessly driving a Nissan Navara on the North-South Expressway (PLUS) heading towards the city centre near the Duta Toll Plaza at 2.30pm on May 10. The charge, under Section 42(1) of the Road Transport Act 1987, carries a maximum jail term of five years, a fine of up to RM15,000, disqualification from holding or obtaining a driving licence for at least five years, revocation of a probationary driving licence, and endorsement of the offence on the driving licence. According to the facts of the case, on the day of the incident, the two victims were riding their motorcycle in the far-left lane when a four-wheel-drive vehicle suddenly veered into their path in a dangerous manner and hit them. PETALING JAYA: The Nissan Navara driver who rammed into a motorcycle ridden by a husband and wife, causing them to be thrown off and seriously injured on the North-South Highway near Duta Toll Plaza two weeks ago, has now been sentenced to six months in prison, replacing the original 30-day sentence. The decision was made by Kuala Lumpur High Court judge K Muniandy after reviewing the sentence imposed by the magistrates' court on car accessories salesman K Darmaraju, 32. However, Muniandy maintained the RM12,000 fine and five-year driving license suspension as previously decided. On May 13, magistrate Khairunnisak Hassni imposed a 30-day prison sentence starting from the arrest date on May 11, as well as a RM12,000 fine or 12 months imprisonment if the fine was not paid, after the accused pleaded guilty to reckless driving on the North-South Highway heading toward the city center at around 2.30pm on May 10. 'The RM12,000 fine has already been paid by the accused. The 30-day prison sentence passes in the blink of an eye compared to the suffering of the victims who suffered permanent disabilities and now completely depend on their family and hospital treatment.' Mohd Sabri further said the case should serve as a reminder to the public about the risks, effects, and consequences of reckless driving while emphasising that public interest should be prioritised in such cases. He also asked the court to consider the actions of the accused who drove dangerously by speeding and overtaking the motorcycle from the right side, even though the motorcycle was moving straight in the leftmost lane. 'The accused also left the scene without stopping or providing any assistance after ramming into the motorcycle ridden by the victims.' 'As a result of the collision, motorcycle rider Faizal Mat, 53, suffered a broken collarbone and ankle injuries, while the passenger, Suhailiza, suffered head bleeding, a broken ankle, and fractured right ribs.' 'Both victims were rushed to Sungai Buloh Hospital for further treatment. This incident clearly shows the serious impact of the accused's fast and reckless driving,' he said. He said a witness to the incident also confirmed the accused's behavior based on a one-minute dashboard camera recording showing the Nissan Navara vehicle speeding and hitting the right side of the motorcycle, causing Faizal to lose control while Suhailiza was thrown from the motorcycle. The prosecutor informed that Darmaraju had disregarded the safety of other road users. Kuala Lumpur: A man was reportedly sentenced to 30 days in jail and fined RM12,000 by the Magistrates' Court here today after pleading guilty to reckless driving that seriously injured two motorcyclists on the PLUS Highway. Free Malaysia Today reported that K Darmaraju, 32, admitted to driving recklessly under Section 42(1) of the Road Transport Act 1987, which carries a penalty of up to five years' jail and a fine between RM5,000 and RM15,000. 'He has promised not to repeat this mistake,' his lawyer S Vinesh was quoted telling the court, adding that his client regretted the incident and had apologised to the victims. Vinesh pleaded for leniency, citing Darmaraju's RM2,500 monthly income as a salesman, his recent marriage, and his financial responsibility for his elderly parents. The crash took place around 2.30pm on May 10 before the city-bound Jalan Duta toll plaza when Darmaraju's vehicle hit a motorcycle carrying a middle-aged couple from behind. The victims, who were riding in the left lane, suffered serious injuries including bone fractures; the pillion rider sustained head trauma, a broken ankle, and a fractured rib. Darmaraju fled the scene after the collision and was arrested on May 11. Magistrate Khairunnisak Hassni ordered the 30-day sentence to begin from the date of arrest, and ruled that Darmaraju would serve six months in jail if he failed to pay the fine. In addition to the prison sentence and fine, the court disqualified Darmaraju from holding a driving licence for five years. The lawyer also informed the court that Darmaraju's father was scheduled for an upcoming eye surgery, further highlighting the family's dependence on him.
