Tipperary planners block home extension over ‘unauthorised' structure concerns
Homeowner Ken Hassett sought to convert the garage of his Bansha Road home into living space, raise its roof height, and connect it to the main house by removing internal walls.
However, the local authority refused to grant permission for the development on a number of grounds, including that the planning status of the garage is 'unclear' and that a grant of planning permission would set an 'undesirable precedent'.
In its letter, outlining the reasons for refusing the development, Tipperary County Council planners said that 'the planning status of the existing domestic garage is unclear and it appears that same may be unauthorised development'.
"The proposed development would therefore set an undesirable precedent for other similar development,' the refusal letter added.
Planners also raised concerns about the potential for overlooking of neighbouring properties, and the lack of natural light would not satisfy the standards for new dwellings, saying that the development would be contrary to the Tipperary Town and Environs Development Plan.
"The development will result in overbearing impacts on No. 7 Mountain View to the south and will overlook the rear amenity space to be shared with No. 1 Mountain View to the north,' planners said.
"The planning authority considers that the proposal will result in negative impacts on the residential amenity of these properties and is therefore contrary to the land use zoning objective for the site,' they added.
Planning files also noted that this was the second time this exact planning application came before the local authority, with the first application being refused for the same reasons.
"This application is not materially different to [the previous application] and there is no acknowledgment of the first application save for the colour of the site notice and a variation to the development description.
"No proposals to address the shortcomings under [the previous application] have been set out under this application,' planners added.
