Next hearing in Mathura case on July 4

Prayagraj: In the matter of Krishna Janmabhumi-Shahi Eidgah dispute, Allahabad High Court on Friday fixed July 4 as next date of hearing. The controversy is related to Mughal era Shahi Eidgah mosque in Mathura which is alleged to have been built after demolishing a temple at Lord Krishna's birthplace. Justice Ram Manohar Narain Mishra is hearing 18 suits filed by Hindu side, seeking possession of land, removal of the eidgah structure, restoration of temple and a permanent injunction. On Friday counsels for Hindu side argued on application in which prayer was made that Shahi-Eidgah be mentioned as 'disputed structure'. On August 1, 2024, the HC had rejected applications of Muslim side challenging maintainability of suits of Hindu worshippers and held that all suits of Hindu worshippers were maintainable. The court held that these suits were not barred by Limitation Act, Waqf Act and Places of Worship Act1991, which prohibit conversion of religious structure as existed on August, 15,1947. The controversy is related to the Mughal era Shahi Eidgah mosque in Mathura, which is alleged to have been built after demolishing a temple at the birthplace of Lord Krishna. Justice Ram Manohar Narain Mishra is hearing 18 suits filed by the Hindu side seeking possession of land and removal of the Shahi Eidgah structure, restoration of temple and a permanent injunction. Limitation clause sparks concern even as second Waqf survey details are yet to be notified in Telangana

Even as protests against the Waqf Amendment Act, 2025 continue, and more are scheduled to be held in Hyderabad, including the Telangana March seeking a withdrawal of the legislation on April 26, the Telangana government is yet to publish the details of the second Waqf survey. According to those familiar with the matter, the second Waqf survey, which was completed earlier this year, enumerated approximately 13,400 properties. However, unlike those listed in the first survey, these comprise much smaller land parcels. 'These smaller properties are like chillas, which are hardly of any size. However, the survey details are yet be finally published. At this point, there is no question of encroachment in the second Waqf survey because these properties are small. The issue of encroachment arises in relation to the first survey, after which it was found that over 75% of Waqf lands were encroached upon,' a senior official of the Telangana State Waqf Board (TGSWB) said. According to official data, the first Waqf survey listed 33,939 institutions spread over a total of 77,538 acres. Of this, 57,423 acres were found to be encroached upon. However, sources within the Board speculate that the extent of encroachments may have increased since then to about 80% being encroached. Now, with the new waqf legislation applying the Limitation Act, a move the Union government maintains will reduce prolonged litigation, members of the All India Muslim Personal Law Board (AIMPLB) have expressed concerns that this would enable encroachers to remain in possession of waqf land. Speaking at a public meeting organised in New Delhi on Tuesday (April 22) to oppose the new legislation, Hyderabad parliamentarian Asaduddin Owaisi, who is also a member of the AIMPLB, quoted a document on waqf properties which he said was released by the Bharatiya Janata Party (BJP), and stated that a majority of properties were encroached upon. 'We want to ask the Prime Minister that when you have admitted that 70% of waqf properties have been encroached upon, you making encroachers owners by applying the Limitation Act. I am certain that in several States, they have already been made owners through land mutation,' he said. A TGSWB official noted that with the Limitation Act now being applied, encroachers could seek ownership through adverse possession. If this happens, cases could be filed in civil courts rather than the Waqf Tribunal. However, this also raises other challenges, he said, even as he claimed that the case would not be as simple. These include establishing limitation, paying court fees, and filing appeals in case the Waqf institution or Board receives an adverse order.

PM Modi's Saudi Visit Won't Impact Waqf Law, Say Government Sources

Last Updated: PM Modi is visiting Saudi Arabia on April 22 and 23 at the invitation of the Crown Prince and Prime Minister of the Kingdom of Saudi Arabia, Mohammed bin Salman Prime Minister Narendra Modi's two-day visit to Saudi Arabia is unlikely to have any bearing on the Waqf Amendment Act, said top government sources. Modi is visiting Saudi Arabia on April 22 and 23 at the invitation of the Crown Prince and Prime Minister of the Kingdom of Saudi Arabia, Mohammed bin Salman. The Waqf Amendment Act addresses internal governance and transparency issues. This amendment repeals contentious provisions like Section 40 (arbitrary property claims) and 'Waqf by user'. It enhances accountability by subjecting Waqf tribunals to the Limitation Act (1963) and allowing High Court appeals. ' Saudi Arabia 'Saudi Arabia rarely comments on the internal affairs of partner nations unless they directly impact Saudi citizens, investments, or religious sites. Despite global criticism, Saudi Arabia maintained silence on India's Citizenship Amendment Act, prioritizing energy ties. Saudi Arabia has largely avoided taking sides, framing it as a bilateral India-Pakistan matter," said sources. The act is aimed at curbing corruption and empowering marginalised groups such as Muslim women which aligns with Saudi Arabia's own reforms like women's driving rights and Riyadh has no incentive to oppose such measures. The Waqf Act applies to Sunni and Shia trusts equally. Saudi Arabia, a Sunni-majority state, has no sectarian stake in this reform. INDIA-SAUDI TIES ' Saudi Arabia is India's second-largest trading partner, with $43 billion in bilateral trade, primarily in oil and gas. The visit emphasises strengthening strategic, economic, and energy partnerships, reflecting long-term goals rather than domestic legislative developments such as the Waqf Act," said sources. Modi had highlighted opportunities for Saudi investments in India's infrastructure, logistics, and tech sectors under the Viksit Bharat 2047 initiative. Similarly, the Saudi Vision 2030 reflects Indian contributions with projects such as NEOM and Riyadh Expo 2030. 'The growing defence cooperation, including joint military exercises and counterterrorism efforts, underscores mutual trust," said sources. Also, the India-Middle East-Europe Economic Corridor connectivity project, launched during the 2023 G20 Summit, aims to boost commerce and energy integration, with Saudi Arabia as a key partner. SAUDI & OTHER COUNTRIES While Pakistan remains a close ally, Saudi has increasingly prioritised India due to its economic leverage $3.7 trillion GDP and energy demand. Riyadh cannot afford to alienate India by criticising domestic laws, especially when Pakistan's economy ($350 billion GDP) offers limited strategic value. In 2019, Saudi Arabia had ignored Pakistan's objections to Modi's Riyadh visit, giving a clear signal on its neutrality on Kashmir. Despite China's persecution of Uyghur Muslims, Saudi Arabia deepened partnerships with $ 50 billion refinery deals. Saudi-Israel normalisation talks continue despite Israel's policies in Palestine.
