Promotion of staff in limbo as HC hearing deferred without new date
Bhopal: The promotion of state govt employees, already held up for nearly a decade, has hit yet another legal hurdle. A scheduled hearing in the MP high court on July 15 was postponed without a new date being fixed, leaving the fate of thousands of staff in limbo once again. On July 7, the high court restrained the govt from implementing the newly framed law, the Madhya Pradesh Public Service Promotion Rules, till further orders. The promotion of the govt staff has remained halted since 2016, due to a case in the Supreme Court against the now-scrapped promotion norms. SAPAKS, an umbrella organisation of general category, OBC and minority govt employees that went to the court against the new promotion rules, doubted the govt's intention on the issue. Its president KS Tomar said: "When the issue was pending in the apex court, why did the govt made new promotion rules in haste, and tried to restart the promotion process, sidelining the interests of general category employees. Our timely intervention by approaching the court stalled the govt's ill motives." Uma Shankar Tiwari, state secretary of Tritya Varg Karamchari Sangh, also questioned the govt's motive. "The govt would have first withdrawn its petition from the apex court, and then started the process if it really wanted to restart promotion of govt employees that had been stalled for the past nine years," he said. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like No annual fees for life UnionBank Credit Card Apply Now Undo Top bureaucrats, part of the govt process to draft the new promotion rules, said they had the same view that govt should first withdraw its case from the apex court. They, however, said legal opinions suggested that the govt could make new rules despite the matter being in the Supreme Court, due to which the govt decided to go ahead on the issue. On April 8, CM Mohan Yadav announced that the process for promotion of nearly 4 lakh employees will be carried out soon. On June 17, the state cabinet approved the Madhya Pradesh Public Service Promotion Rules, 2025, ensuring the representation and protection of interests of the reserved categories. Provisions in the new promotion rules include 20% reservation for Scheduled Tribes (ST) and 16% for Scheduled Castes (SC). SC and ST public servants will also have the opportunity for promotion based on merit as per new rule. Hearing separate petitions challenging the legality of the newly farmed rules, the high court on July 7 issued notices, and deferred the hearing of the case to July 15.

Madhya Pradesh High Court notice to State govt. over recently notified promotion rules
The Madhya Pradesh High Court has issued a notice to the State Government over the rules for the promotion of government employees notified last month. A Division Bench of acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf on Monday (July 7, 2025) issued the notice while hearing a batch of petitions filed by various government employees who have challenged the constitutional legality of the Madhya Pradesh Public Service Promotion Rules, 2025. The State Government, on June 17, had approved the rules that had been pending for about nine years, with Chief Minister Mohan Yadav saying that the interests of employees from all categories, including the Scheduled Castes and Scheduled Tribes, were taken care of while framing the rules. The petitioners also sought an interim stay on the Rules. However, the Court has sought the government's response, asking it to clear its stance on the matter before the next hearing, scheduled for July 15. The court also asked the government to clarify the differences between the fresh rules and the existing rules notified in 2002. The provisions under the new rules include 20% reservation for the ST and 16% for the SC communities, while the employees from the two communities will also be eligible for promotions based on merit. Multiple petitions have challenged the provision of reservation in the new rules, citing that the matter of reservation in promotions, made in the 2002 rules, is currently pending in the Supreme Court. Cabinet Minister Kailash Vijayvargiya, who had briefed the media about the decision taken at a Cabinet meeting, had said that the rules had been made after consultations with the Law Department on various decisions of the Supreme Court and the High Court so that the process of promotions does not face any legal hurdles.

The govt is aware of the grounds on which the promotion rules will be challenged in court, and officials mentioned they have also done their homework. The promotion of the state govt employees has been on hold since 2016. Over a lakh of govt employees have retired while waiting to get promotions.
