Mumbai: Bombay high court on Thursday directed Maharashtra Real Estate Regulatory Authority (MahaRera) to within four weeks restore hybrid hearings permitting parties to opt for physical or virtual appearance. "Access to justice is not merely about providing virtual access, but ensuring that parties also have the right to appear physically," said Justices Revati Mohite Dere and Neela Gokhale. A petition by Mayur Desai urged the high court to direct MahaRera to expeditiously pass a final order in execution/non-compliance proceedings pending since March 2024, as well as to restore hybrid hearings as was practised prior to the Covid-19 pandemic. MahaRera's advocate said if parties desire to appear physically, they may apply to the respective bench which may consider their request. The judges said the authority's continued insistence on virtual-only mode though all courts have adopted hybrid model is "concerning". They also directed that Rera shall consider revisiting a April 2025 circular and standard operating procedures particularly regarding mechanism for urgent listing of matters, execution of non-compliance of orders, mentioning of cases and pronouncement and publication of reserved orders. Eight years after its formation in 2017,the state's real estate regulator, MahaRera, is still grappling with a significant backlog of unresolved complaints. Of 29,374 complaints filed so far, 7,310 remain pending, prompting calls from homebuyers, legal experts, and activists for faster redressal and stricter enforcement of orders. Although MahaRera has resolved 21,888 cases and holds online and offline hearings, the increasing number of unresolved cases has alarmed consumer groups. They stressed the need for appointment of more adjudicating officers and setting up of regional benches to manage the growing caseload. MahaRera has registered over 50,000 real estate projects — the highest among state regulators — with nearly 50% of them located in Mumbai Metropolitan Region and Pune. However, stakeholders argued that this operational scale has not been matched by adequate capacity to address consumer grievances. Currently, MahaRera has one chairperson, two members, and three adjudicating officers. Activist Godfrey Pimenta of the Watchdog Foundation pointed out that this limited setup cannot cope with the volume of complaints. Shirish Deshpande, chairman of Mumbai Grahak Panchayat, added that section 20 of Real Estate Regulatory Authority Act gives the state full freedom to appoint more MahaRera chairpersons and establish additional benches. "It's been eight years since MahaRera was established, and yet we are witnessing an alarming backlog of cases, which is deeply disappointing for those who once supported its creation," he said. He explained that complaints typically fall into two categories: "First, is when homebuyers are seeking exit from the project and demanding refund with interest due to delay in getting possession. Second, is when homebuyers want to continue with the project despite delays but want interest on the amount they have paid as per section 18 of the Act. Mumbai: The number of projects registered with MahaRera has surpassed 50,000, which takes the state to the top spot in terms of highest number of projects registered with regulatory authorities across the country. A total of 50,162 housing projects are registered with MahaRERA, which completed eight years of existence, making Maharashtra the only state in India to cross the 50,000 registered residential projects mark. Maharashtra is followed by Tamil Nadu with 27,609 housing projects and Gujarat with 15,322 projects. Among districts in Maharashtra, Pune has the maximum number of projects (12,788) registered, followed by 6,746 in Thane district, 5,907 in Mumbai suburbs, and 5,360 in Raigad district. According to the statistics provided on the Ministry of Housing and Urban Affairs website, a total of 1,44,617 housing projects have been approved by RERA bodies across the country. The state was one of the first to set up the regulatory authority to regulate the real estate sector in 2017, under the Real Estate (Regulation and Development) Act, 2016. While MahaRera was established in March 2017, full-fledged operations of MahaRera started on May 1, 2017. Mumbai Metropolitan Region (MMR) has the highest number of residential projects at 23,770. In MMR, the Mumbai City district registered 1,284 projects, while Mumbai suburban district registered 5,907 projects, Thane 6,746, Raigad 5,360, Palghar 2,899, Ratnagiri 1,087, and as many as 487 projects were registered in Sindhudurg other districts, Nashik district had 3,854 registered projects, while Nagpur district registered 2,497 projects. Union territory Dadra Nagar Haveli registered 180 projects, while Daman registered 52 projects. MahaRERA chairman Manoj Saunik said until a few years ago, the real estate sector was largely limited to MMR or Pune, but now it is expanding across state.

Nagpur: The Maharashtra Real Estate Regulatory Authority (MahaRera) will launch its upgraded Project Application Portal on May 5 to facilitate smoother registration of housing projects and streamline the processes for seeking extensions or corrections by developers. According to MahaRera, developers who have already submitted applications for project registration, extension, or correction through the existing portal need not reapply. Their requests will be processed without disruption under the current system. The revamped portal is solely for registered developers and promoters. In a statement, MahaRera clarified that the existing procedures for homebuyers and real estate agents will remain unchanged. To ensure efficiency in the approval process, MahaRera has advised all developers — both existing and new entrants — to update their profiles on the portal with accurate and current information. The updates can be done free of charge. The initiative forms part of MahaRera's ongoing digital reforms to enhance transparency and improve user experience across the real estate regulatory ecosystem.

Maharashtra appoints 12 officers to speed up Rs 912 crore MahaRERA recovery for buyers

NAGPUR: In a major step to aid distressed homebuyers, the Maharashtra Govt appointed 12 senior recovery officers to expedite the enforcement of recovery warrants issued by the Maharashtra Real Estate Regulatory Authority ( MahaRera ) against errant builders. The appointments, made under district collectors in six key districts, are intended to accelerate the compensation process under provisions of the Maharashtra Land Revenue Code, 1966. According to state revenue department sources, the initiative follows sustained pressure from homeowners facing prolonged delays in securing dues despite favourable MahaRera orders. Acting on assurances made by revenue minister Chandrashekhar Bawankule , the state issued a govt resolution on April 22, committing to clearing all pending recovery cases within three months. Under Section 40(1) of the Real Estate (Regulation and Development) Act, MahaRera is empowered to issue recovery warrants enabling property attachment and compensation recovery. Although these provisions are applicable to both developers and buyers, the bulk of the 1,342 warrants issued so far target defaulting developers. However, district collectors, primarily in Mumbai , Thane, and Pune, acted on only 316 warrants to date, leading to mounting concerns among aggrieved buyers. According to MahaRera data, Rs912.11 crore was sanctioned across the state as compensation to homebuyers. Of this, Rs222.13 crore was recovered, while Rs689.98 crore remains outstanding. Notably, six districts — Mumbai City, Mumbai Suburban, Thane, Pune, Palghar, and Raigad — account for Rs684.56 crore of the pending amount. Mumbai Suburban alone represents Rs325.43 crore, followed by Pune at Rs177.37 crore. Nagpur showed comparatively better performance, with Rs9.66 crore recovered out of the Rs10.9 crore awarded across 20 cases, reflecting a higher efficiency rate than other regions. Sources from MahaRera told TOI that the newly designated officers, comprising senior revenue officials, will focus on faster enforcement of warrants, property attachments, and structured reporting to the state govt and MahaRERA. The state resolution outlines specific responsibilities for coordinating officers to streamline recovery operations and enhance accountability. "The move also aligns with central govt guidelines issued on January 1, 2024, emphasising the need for stronger enforcement of real estate regulations to safeguard consumer interests. The state's directive, digitally authenticated under the authority of the governor, marks a renewed commitment to delivering long-overdue relief to thousands affected by stalled projects and regulatory non-compliance," they said. While the appointments sparked cautious optimism among homebuyers' groups, the real test will lie in the effectiveness and speed with which the new recovery officers can act on pending cases.
