1 2 Chennai/Madurai: Madras high court on Monday dismissed a public interest writ petition by a former superintendent of police seeking direction to the Tamil Nadu govt to select the next director-general of police in strict compliance with the guidelines set by the Supreme Court. The first bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan observed that it cannot interfere in the administrative functions of the state while the incumbent DGP is set to retire only on Aug 31. According to petitioner Damodaran, the Supreme Court issued detailed guidelines regarding the appointment of a DGP to a state. According to these guidelines, a list of officers with at least 30 years of service must be sent to the Union Public Service Commission (UPSC) at least six months before the incumbent DGP's retirement. Although there are at least eight eligible officers in the state, the Tamil Nadu govt had not initiated any such process so far. With the assembly elections scheduled for next year, the DGP appointment holds significant administrative importance, he added. Noting that the petition is premature, the bench observed that a fresh petition can be filed if the eventual appointment of a new DGP violates Supreme Court guidelines. In a related development, Madurai bench of the Madras high court issued notice to authorities, on a similar PIL seeking a direction to the govt in the matter of appointment of new DGP of Tamil Nadu.

The Madras High Court on Monday (August 4, 2025) decided to wait for the orders to be passed by the Supreme Court on Wednesday (August 6) on an appeal preferred by the Dravida Munnetra Kazhagam (DMK) against the High Court's July 31 interim order prohibiting the use of the name of any living personality in the nomenclature of government schemes. Appearing before the first Division Bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan, senior counsel Vijay Narayan, representing All India Anna Dravida Munnetra Kazhagam (AIADMK) Member of Parliament Shanmugam, said, the DMK had filed an appeal and made a mention before the top court on Monday. The Supreme Court had agreed to take up the appeal for hearing on Wednesday, the Bench was told. Immediately, the Chief Justice decided to adjourn a modification/clarification petition filed by the Tamil Nadu government before the High Court to Thursday (August 7), since it was the same interim order that had been taken on appeal to the top court. Senior counsel Abhishek Manu Singhvi and Advocate General P.S. Raman tried to persuade the Chief Justice's bench that the clarification/modification petition filed by the State government could be heard by the High Court dehors the appeal filed by the DMK before the Supreme Court. However, the Chief Justice felt it would be better to await the top court's decision. The Bench had passed the interim orders on July 31, following a public interest litigation petition filed by Mr. Shanmugam questioning the use of Chief Minister M.K. Stalin's name in the public outreach programme titled 'Ungaludan Stalin.' After the release of the order on August 1, the Tamil Nadu government sought a clarification that it would not apply to 'Ungaludan Stalin' and 'Nalam Kaakkum Stalin' schemes. Since the Chief Justice's bench agreed to hear the modification/clarification petition on August 4, the government went ahead and launched the 'Nalam Kaakkum Stalin' scheme on August 2. This prompted Mr. Shanmugam to file a contempt of court petition too, through his counsel K. Gowtham Kumar, against Public Department Secretary Rita Harish Thakkar and Health Secretary P. Senthil Kumar on Monday. In the meantime, the DMK preferred an appeal against the High Court's interim order and also obtained permission from the top court to get it heard on August 6.

The Madras High Court on Monday (August 4, 2025) dismissed a public interest litigation (PIL) petition filed by a retired Superintendent of Police seeking a direction to the Tamil Nadu Chief Secretary and Home Secretary to initiate the process of appointment of Director General of Police/Head of Police Force (DGP/HoPF). First Division Bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan refused to entertain the PIL plea on the ground that the tenure of the incumbent DGP/HoPF Shankar Jiwal had not come to an end so far and therefore, it was premature on the part of the petitioner to approach the court. In his affidavit, the petitioner N. Dhamodharan, 74, submitted he had retired from service as the Superintendent of Police in Special Branch-Criminal Investigation Department (SB-CID), after serving in the Police department for 35 years and hence, he was highly interested in the efficient functioning of the department. He said, the Supreme Court had laid down broad guidelines for the appointment of DGP/HoPF of every State and Union Territory (UT) in the country in the well-known 2006 Prakash Singh's case. The guidelines were issued to avoid complaints of short tenure and frequent transfer of the officers heading the police force. Pursuant to Supreme Court orders, the Union Public Service Commission (UPSC) issued elaborate proceedings related to the composition of the empanelment committee and insisted that the State government's proposal be sent at least three months before the retirement of the incumbent DGP/HoPF. Stating Mr. Jiwal was due to retire from service on August 31, 2025, the PIL petitioner claimed that the State government had not forwarded the proposal along with a list of eligible officers to the UPSC so far despite a specific representation made by him in this regard on June 6, 2025. The petitioner further alleged the State government was deliberately delaying the initiation of the process of appointment of DGP only to make an officer in the rank of Additional Director General of Police (ADGP) as DGP/HoPF (in-charge), especially when the Assembly elections were fast-approaching. According to him, eight officers in the rank of DGP were available in the State, and the names of all those officers should be sent to the UPSC's empanelment committee, which would select three of them on the basis of merit and then ask the State government to appoint one of them as DGP/HoPF.

The Madras High Court has directed the Tamil Nadu government not to use photographs of former chief ministers, ideological leaders and insignia of political parties in the advertisements for welfare schemes, reported Bar and Bench on Saturday. A bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan also barred the government from naming or rebranding schemes after living persons, according to The Indian Express. The court delivered the order on Thursday while hearing a public interest litigation by All India Anna Dravida Munnetra Kazhagam MP C Ve Shanmugam. Shanmugam had sought directions to stop the Dravida Munnetra Kazhagam government in Tamil Nadu from using Chief Minister MK Stalin's name in public outreach programmes, such as Ungaludan Stalin (With You, Stalin), and Mudhalvarin Mugavari (chief minister's Address). The AIADMK MP claimed this violated Supreme Court guidelines and the Government Advertisement (Content Regulation) Guidelines, 2014. These government-funded welfare programmes featured 'the name of the incumbent chief minister in the nomenclature of the scheme' and included 'pictorial representations/photographs of certain ideological leaders and former chief ministers' linked to the Dravida Munnetra Kazhagam, Shanmugam's counsel, Vijay Narayan, was quoted as telling the High Court by The Indian Express. On the other hand, the advocate appearing for the Tamil Nadu government told the court that the material presented before the court is 'not government publications at all'. 'We are inclined to pass an interim order to the effect that while launching and operating government welfare schemes through various advertisements, the name of any living personality, photograph of any former chief minister/ideological leaders or party insignia/emblem/flag of (DMK) shall not be included,' the court said in its order. The bench also held that including the names of political leaders in the name of a government scheme is not allowed, reported Bar and Bench. The matter will be heard next on August 13.
