Flavored vape is now banned in Utah after federal judge's preliminary ruling

SALT LAKE CITY (ABC4) — Nearly all flavored vape products are now banned in Utah after a federal judge's Monday ruling in an ongoing lawsuit against the state's new e-cigarette law. A law banning all flavored e-cigarette products was set to go into effect at the beginning of 2025 but was put on pause after a judge granted in late December. On Monday, March 24, Federal Judge David Barlow granted a preliminary injunction stating that Utah's newly devised inspection program could violate the Fourth Amendment rights of vapor businesses and ordered the state to temporarily put the inspections on hold. However, the judge said the state could now enforce other portions of the law — including the restrictions on flavored vape. S.B. 61 titled 'Electronic Cigarette Amendments' was passed in the 2024 Utah Legislative Session and bans all flavored electronic cigarette products, with the exception of menthol and tobacco. The bill also creates an online registry managed by the Department of Health and Human Services where retailers will be required to list their e-cigarette products and their nicotine levels and flavors. If a business or individual sells an unregistered e-cigarette product in Utah, they could be subject to hefty fines including $1,000 per product sold, and $100 for every day the product is on the shelf unregistered. The bill sets up an inspection program that would allow state officials to examine the business' books, records, safes, vaults, desks, furniture, and more in search of illegal products. It would also allow for unannounced follow-up examinations if a violation occurred. This inspection program is the part of the bill that Judge Barlow has temporarily banned the state from putting into effect. The remainder of the bill, however, can be enforced until the federal court makes its final ruling. This bill was sponsored by Senator Jen Plumb who said the purpose of the bill was to 'get less nicotine products via flavored vapes into the hands of our children.' Attorney General Derek Brown released a statement following the judge's recent order saying he is 'thrilled that Utah will now be able to better protect children from the harms of tobacco.' 'Our attorneys have worked tirelessly on this case to defend Utah's law, and I am confident their advocacy moving forward will continue to be excellent. Their work is crucial in preventing kids from getting hooked on nicotine,' he said. Beau Maxon, an owner of two local vapor shops, said this bill is going to do the opposite. 'If their intent is truly to protect kids, to protect the youth, then this bill, this ban, does the opposite,' he said. Maxon continued to say the ban will 'prop up a black market' as consumers look for alternative ways to purchase these products. He said the black market 'will sell to anyone' regardless of their age and subjects 'adult consumers to completely unregulated flavored vapor products.' Maxon referenced the SHARP Survey, saying that since flavored tobacco products were required to be sold in retail specialty businesses a few years ago, youth usage of vape in Utah declined. From 2019 to 2023, that youth who had tried vaping declined from 18.9% to 12.2%. Those who had vaped within the last 30 days also declined from 9.7% to 6%. Maxon believes this ban, and the hundreds of Utah businesses that could close because of it, is going to lead to backward progress. 'Every scenario in which products have been banned, it creates a black market, youth use increases, traditional combustible cigarette usage increases,' Maxon said. 'I think the state's going to recognize they made a very big mistake … And my concern is it'll be too late. By the time the state recognizes they've created a problem, it will be too late.'
