SEPANG: A farmer was fined RM15,000 by the Sessions Court after he pleaded guilty to posting offensive comments about the royal institution on Facebook. Mohammad Faisal Mohd Yusof, 37, will be jailed for six months if he fails to pay the fine. Sessions Court judge Ahmad Fuad Othman sentenced Mohammad Faisal after he changed his plea to guilty when the case was mentioned today. Before handing down the sentence, the judge advised the accused to be more careful with social media. "You deleted the comment, but look what has happened, it persists even after deletion. You're still young, you need to think long and hard," he said. Mohammad Faisal was charged with knowingly making and initiating the transmission of offensive comments with the intent to annoy others using his Facebook account, "Mohd Faisal Yusof". The post was made at 12.40am on Feb 9 and was seen by the Malaysian Communications and Multimedia Commission (MCMC) at 1.40pm on the same day. The charge, under Section 233 (1) (a) of the Communications and Multimedia Act 1998, carries a maximum fine of RM50,000 or up to one year in jail, or both. The offender may also be fined a further RM1,000 for each day the offence continues after conviction.

He was charged with knowingly posting and initiating the transmission of offensive comments via the Facebook account 'Mohd Faisal Yusop' with intent to annoy others. The post was allegedly uploaded at 12.40 am on Feb 9 and came to the attention of the Malaysian Communications and Multimedia Commission (MCMC) at around 1.40 pm the same day at MCMC Tower 1, Jalan Impact, Cyber 6, Cyberjaya. The charge, framed under Section 233 (1) (a) of the Communications and Multimedia Act 1998 and punishable under Section 233 (3) of the law, provides a maximum fine of RM50,000 or imprisonment for up to one year or both, upon conviction. MCMC deputy public prosecutor Fadhli Ab Wahab proposed bail of RM15,000 with one surety, citing the accused's failure to attend the case mention on April 30, which resulted in a warrant of arrest being issued.
