Court grants bail to Rahul Gandhi in defamation case over remarks on Savarkar

Nashik: A court of additional chief judicial magistrate Rupali Narwadia on Thursday granted bail to Congress MP Rahul Gandhi in a defamation case filed against him for his remarks on Hindutva ideologue Vinayak Damodar Savarkar during Bharat Jodo Yatra in 2022. "Rahul Gandhi was allowed to appear before the additional chief judicial magistrate R C Narwadia through video conferencing on Thursday. The Leader of Opposition in the Lok Sabha pleaded 'not guilty'," said his lawyer Jayant Jaybhave. They then moved a bail application. "The court allowed bail for Gandhi on a bond of Rs 15,000," added Jaybhave. Jaybhave added that a revision plea was filed in the sessions court of judge P M Badar regarding the quashing of the defamation case. "We have filed a revision plea on some merits that we have presented to the court. The court will study, and is likely to give its judgment soon," said the lawyer. Nashik-resident Devendra Bhutada, through his lawyer Manoj Pingle, filed the criminal defamation case under sections 500 (defamation) and 504 (intentional insult with intent to provoke breach of the peace) of the Indian Penal Code. Pingale also said that from July 29, the court will start recording evidence in which Bhutada will be asked to put forth his case, and the statements will be recorded by the court.

Mumbai: A court in Maharashtra's Nashik city on Thursday granted bail to Congress leader Rahul Gandhi in a defamation case filed against him for remarks about Hindutva ideologue and freedom fighter V D Savarkar during the Bharat Jodo Yatra in 2022. Appearing through video link before additional chief judicial magistrate R C Narwadia, RahulGandhi, the leader of opposition in the Lok Sabha, pleaded 'not guilty'. Nashik-resident Devendra Bhutada, through his lawyer Manoj Pingle, has filed the criminal defamation case under sections 500 (defamation) and 504 (intentional insult with intent to provoke breach of the peace) of the Indian Penal Code. After RahulGandhi pleaded not guilty, his lawyers sought bail. The court allowed the plea on a bond of Rs 15,000, said advocate Pingle. The complainant, director of an NGO, alleged that Gandhi, at a press conference in Hingoli and in a speech during his yatra in November 2022, made statements that harmed Savarkar's reputation. "The speech of the accused along with press statements try to ruin the reputation of the complainant's idol Swatantryaveer Savarkar and his contribution to the society along with his noble work in the pre-independence period," the complaint said. Gandhi said that "Savarkar prayed for release with folded hands and later on promised to work for the British government", it alleged. Gandhi is also facing a defamation case in Pune, filed by Savarkar's grandnephew, over his statements about the late Hindutva ideologue.

Nashik city unit chief of Sena (UBT), Bala Darade, slammed Rahul for calling Savarkar 'mafi-veer' and said that he will pelt stones at Congress leaders' convoy if he ever visits Nashik. "We are proud that we live in the birthplace of Swatantrya-veer Savarkar. Rahul Gandhi's statement about Savarkar, calling him 'Mafi-veer', was insulting," Darade told a Marathi news channel on the occasion of the birth anniversary of the Hindutva ideologue. "We condemn it strongly. We will blacken Rahul Gandhi's face if he comes to Nashik. If we cannot do that, we will pelt stones at his convoy," he added. Congress, however, strongly objected to Darade's remarks and said that Congress workers are capable enough of tackling such threats. "Rahul Gandhi's father, late Rajiv Gandhi, and grandmother, late Indira Gandhi, sacrificed their lives for India's unity. Congress and its leadership are not afraid of such threats," he told reporters. "Rahul Gandhi did not make derogatory remarks against Savarkar," Congress Maharashtra unit chief Harshwardhan Sapkal said. "His comments contain historical references. In the 2024 assembly elections, the Mahayuti coalition of BJP, Shiv Sena and NCP won 235 of the 288 seats, with BJP securing 132 alone. Shinde's Sena secured 57 seats and Ajit Pawar's NCP got 41 seats. On the other hand, it was a disappointing show by the Maha Vikas Aghadi (MVA), which was hoping for a grand comeback. Uddhav's Sena got 20 seats, Congress 16, and Sharad Pawar's NCP secured 10 seats.
