Badaun temple-mosque case: Next hearing fixed for July 5 as debate on maintainability continues
MEERUT A court in Badaun on Wednesday set July 5 to hear the Neelkanth Mahadev Temple-Shamsi Jama Masjid case. The matter, which earlier fell under the jurisdiction of the fast-track court, was transferred to the court of Suman Tiwari, civil judge (senior division) here and hearing was held during the day. The petition was originally filed by Mukesh Patel on behalf of Akhil Bharat Hindu Mahasabha, alleging that the Shamsi Jama Masjid in the city was constructed over the remnants of a fort that belonged to King Mahipal, and that within its premises stood the Neelkanth Mahadev Temple. Contradicting this claim, the Jama Masjid Management Committee argued that no such temple ever existed at the site. In recent weeks, the case gained momentum, with the courtroom shifting its focus to the core procedural question: Is this case admissible in court, or not? The upcoming hearing on July 5 is expected to address this legal question in depth. On the previous hearing date, Judge Pushpendra Chaudhary, who had recently taken charge of the fast-track court, had heard preliminary arguments from both sides. However, he deferred further proceedings to allow himself time to examine the case files thoroughly. According to Ved Prakash Sahu, counsel for the Hindu side, the judge will soon determine whether to reopen arguments or proceed from where the previous arguments had left off. The case has seen several procedural delays. Notably, advocates representing the Jama Masjid Committee failed to appear on multiple scheduled dates. Earlier, judge Amit Kumar, then presiding over the FTC, had given the Muslim side a final opportunity and set a hearing for February 11, which was disrupted by a lawyers' strike. The case was later adjourned to March 10, but due to judge Amit Kumar being on leave, it was again deferred to March 20. On that day, Anwar Alam, lawyer for the Jama Masjid Committee, submitted a petition citing a Supreme Court directive that lower courts cannot adjudicate on such matters. This led the additional civil judge (senior division) to assign a new date, April 2. However, further delays ensued when judge Amit Kumar was transferred to Bhadohi district, and it took time for a new judge to assume charge. As a result, another hearing was held on April 21, bringing the case to its current stage. With the legal focus now shifting to the question of jurisdiction and maintainability, all eyes are on the July 5 hearing, which may determine whether the case proceeds to trial or is dismissed at the threshold. As per the petition, in the year 1175, Muslim ruler Shamsuddin Altamash (Iltutmish) converted the temple into the Jama Masjid. The Hindu side submitted a gazetteer written during the British era and a 144-year-old ASI report to the court. On the other hand, the Muslim side claimed that they presented a consolidation document in court, which records the ownership of this land in the name of Jama Masjid.

‘All big talks of drain cleaning, tractor-mounted pumps': Residents slam authorities after rain leads to water-logging, power cuts in Gurgaon
A few hours of overnight rain and thunderstorm led to waterlogging and prolonged power cuts in several parts of Gurgaon on Sunday morning. The development angered residents as agencies promised monsoon preparedness. In April, the Gurgaon Metropolitan Development Authority (GMDA) stated it is working on desilting stormwater drains and deploying tractor-mounted pumps and suction tankers in flood-prone areas along main roads. 'The civic body officials had already taken note of what needed to be done last time there was waterlogging. The estimates for constructing stormwater drains and deploying pumps were shared, and they had said they would get it approved, but it was all just big talk. No tenders have been issued yet. So, how will things improve? It is the same scenario every year; contractors just end up making money and leaving,' said Puneet Pahwa, general secretary of the Sector 45 RWA. Water entered homes in Sector 4's market and Neelkanth society areas, resident Yogita Katarya said. 'We are frustrated with the lack of action on constructing rainwater harvesting units and fixing drains. It has been pending for six years now and remains on paper. We cannot move around our homes or get out into the streets,' she added. Streets in Sector 4, 40, 43, 45, and South City 1 were also waterlogged. 'For both missing stormwater drains and barely functioning junction boxes (electricity), we have been going to the relevant departments repeatedly. But no action, and we have to wake up to power cuts, low voltage and streets filled with water. They tell us during storms we cut the power lines anyway,' Col (retired) Robin Sirohi, Sector 43 RWA president. There was no electricity from around midnight till 7 am at Sector 43 and Princeton Floor Society's M Block in Sector 51, too. Sushant Lok Phase 1 residents said the electricity has been out since early morning and is yet to be restored. Municipal Corporation of Gurgaon Commissioner Pradeep Dahiya said the civic body is in constant touch with resident welfare associations and speedily deploying its workforce to clear the stormwater in pending areas. 'In fact, I am signing a suspension order of a Sector 15 Junior engineer right now for not putting in place (suction) motors despite instructions,' he told The Indian Express. He added that the stormwater had been cleared swiftly in several sectors due to his officials' prompt and preemptive efforts. Even on May 2, the city had woken up to waterlogged streets and roads blocked by uprooted trees and branches after a spell of rain and thunderstorms had caught the authorities unaware. More than 100 properties in Sector 52's Ardee City witnessed overflowing water from the clogged sewers enter the ground-floor homes. All the main roads in Sector 40 were flooded as the rainwater harvesting and drainage systems took a beating, failing to keep up with the unseasonal rain. At the time, residents of Sector 45 had seen water reaching heights of at least 2 feet on the road, and the drains were clogged with silt that the civic body had failed to remove. Similar developments have been reported in Sectors 14, 21, 31, 41 and Palam Vihar. At the time, the RWAs urged the civic body to immediately finish desilting rainwater pipelines and sewerage networks and deploy sump pumps to clear the waterlogging. This time around, however, residents of Ardee City in Sector 52 said the issue of waterlogging, particularly near gate 3, had been satisfactorily resolved and speedily. 'Despite the rain, the water cleared in less than three hours,' RWA president Praveen Yadav said, praising the city's municipal corporation.
