Can you start a business while working full-time in UAE? Legal do's and don'ts clarified
Navigating UAE's legal rules for starting a business while working full-time/ Representative Image Starting a business while being employed full-time in the UAE can be a complex issue, especially if your new venture is in a field similar to your current job. Many employees wonder if they can legally launch a company alongside their existing employment without violating any laws or contractual obligations. Here's a detailed explanation based on the latest UAE labour laws and expert insights. Establishing a Business While Employed : The Basics According to UAE law, a full-time employee may establish a new business or become a partner or shareholder in an existing company. However, this is contingent upon obtaining a No Objection Certificate (NOC) from their current employer. The NOC is a formal approval allowing the employee to pursue entrepreneurial activities legally while still employed. For example, if you work in the HR department of a company and want to start an HR consultancy, it's crucial to first secure this NOC from your employer. Without it, the new business may be considered unauthorized and could lead to legal complications. Competition and Non-Competition Clauses in Employment Contracts If your planned business operates in a sector similar to your employer's, like your case with HR consultancy, and your employment contract includes a non-competition clause, then starting this business could be problematic. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Mucus in Lungs? Do This if You Feel Breathlessness Neuracare Learn More Undo Article 10(1) of the Federal Decree Law No. 33 of 2021 on the Regulation of Employment Relations specifies that if the employee's job grants access to the employer's customers or business secrets, the employer may include a clause preventing the employee from competing with them during or after employment. Key points about the non-competition clause: It must clearly define the place, time, and type of work to protect the employer's legitimate business interests. The non-competition period cannot exceed two years after the employment contract ends. When Non-Competition Clauses May Not Apply There are exceptions where the non-competition clause may not apply, especially once your employment ends: If you and your employer have agreed in writing that the clause will not apply after the contract ends, the restriction is lifted. This is outlined in Article 12(4) of Cabinet Resolution No. 1 of 2022 concerning the executive regulations for Federal Decree Law No. 33 of 2021. The clause can also be exempted under certain conditions, according to Article 12(5) of the same resolution: If you or your new employer pay the former employer compensation not exceeding three months' wages (as per your last contract) and the former employer consents in writing. If the employment contract is terminated during the probationary period. If your profession falls under categories determined by the Ministry of Human Resources and Emiratisation as needed in the UAE labor market.

Boy's testimony jails elderly siddha doctor for 20 years in Pocso case
Chennai: The case was cracked not with forensics or CCTV footage, but with the testimony of a boy who refused to forget something he saw when he was just seven years old. Every morning, the boy and his eight-year-old friend, who lived above a Siddha clinic on a quiet Chennai street, would help the elderly doctor open up his clinic. For their efforts, he would hand them a rupee or two, maybe a chocolate. It was a routine they came to enjoy — until one day in May 2022, it turned into something else. The boy walked in on the doctor assaulting a girl. He ran home and told his mother. But what followed was anything but straightforward. Instead of taking the child to the police, the doctor's own daughter — also a Siddha practitioner — secretly took the girl to a hospital to assess her. Doctors there confirmed injuries. When the families came to know, it exploded into a heated confrontation between the women. Eventually, the girl's family lodged a police complaint. He was booked under the Prevention of Children from Sexual Offences (Pocso) Act. Still, the trial at the city's Pocso court rested on a fragile thread. The only eyewitness was the boy. His family, fearing backlash and court visits, left the neighbourhood overnight. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Mucus in Lungs? S Anitha, special public prosecutor, said, "But police tracked the parents through their mobile number and convinced them to bring the boy back. In court, the child stood firm. His testimony sealed the fate of the now 63-year-old doctor." The court on July 4, sentenced the man to 20 years in prison — based on the words of a boy who saw and spoke the truth. Judge S Padma, who penalised the siddha practitioner 10,000, ordered the Tamil Nadu govt to pay 2,00,000 as compensation to the survivor child.

Goa Sees 22% Drop in High-Value Cybercrimes Amid Increased Awareness Campaigns
Panaji: There was a 22% decline in high value cybercrimes — more than Rs 10 lakh — in the first six months of the year. Goa police said that there is a 45% increase in the lien amount of total financial frauds reported in the same period. The lien amount refers to the funds that police were able t o block by freezing the bank accounts of fraudsters. SP (cyber crime) Rahul Gupta said that the most prominent high-value frauds are digital arrest, investment frauds, and task-based frauds. He said that there was a 12% decrease in the number of cybercrime complaints. Gupta said that awareness is the biggest antidote. 'We are trying to raise awareness through our campaign 'Cyber Surakshit Goem' through various means. But people themselves should also be curious about this subject. They should read from authentic online sources and discuss among themselves,' he said. The SP said that all police stations have a network of Cyber Yoddhas. 'If any responsible citizen wants a cyber awareness programme to be conducted in any part of Goa, they can approach the local police station,' he said. Police reported that cyber fraudsters target Goa's unemployed youth by offering them online task-based jobs (such as writing reviews), and then, when they're paid for it, they lose the same money to the fraudsters after they gain their trust. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Mucus in Lungs? Do This if You Feel Breathlessness Neuracare Learn More Undo Gupta said that initially, the criminals pay up to Rs 20,000 for the completion of a task. 'Once the cyber fraudsters gain the trust of the youth, they lure them to invest in IPOs related to their companies and promise huge returns. The online job scam then turns into an investment scam. Once the victim invests and decides to withdraw, they direct victims to pay different types of fees, resulting in cheating,' police said. TOI reported that an investigation into cybercrimes shows that fraudsters target youth to ostensibly hire their bank accounts and SIM cards, using gaming apps as an inducement, and then deploy the personal information for criminal activities. Cyber fraudsters approach youth through social media and other platforms and persuade them to rent out their bank accounts and SIM cards to earn additional pocket money.

Texas Flood The death toll from the devastating flash floods in Texas has climbed to 59, with more fatalities feared, state officials said Sunday. We expect that to go higher, sadly,' Texas Lieutenant Governor Dan Patrick told Fox News. 27 girls still missing from flood-hit summer camp Rescuers continued a desperate third day of searching for 27 girls who went missing after floodwaters surged through Camp Mystic, a Christian summer camp along the Guadalupe River in Kerr County. Most of the confirmed dead were recovered from the camp site. Raging waters rose 26 feet in 45 minutes Authorities said the river rose by 26 feet in just 45 minutes before dawn on Friday, sweeping away homes, vehicles, and campgrounds. Questions raised about preparedness Authorities are facing scrutiny over whether sufficient warnings and evacuations were made in time. AccuWeather and the National Weather Service had reportedly issued flash flood alerts hours in advance. Still, many camps were caught off-guard. Survivors recall terrifying escape Camp survivor Elinor Lester, 13, described how she and other girls escaped with the help of rescuers using ropes to cross a flooded bridge. An 8-year-old girl from Alabama and a nearby camp director are among the confirmed dead. Barry Adelman recounted moving his entire family, including a 94-year-old and a child, into their attic. 'Nobody saw this coming,' say officials Kerr County Judge Rob Kelly called it a once-in-a-century flood. 'We know the river rises. But nobody saw this coming,' he said, adding that a proposed flood warning system had failed to materialize due to cost concerns. He said recovery efforts will now begin, calling it a 'long, toilsome task.'
