1 2 Kendrapada: Additional district-cum-special judge (Pocso), Kendrapada, on Tuesday sentenced a 70-year-old man to 20 years of rigorous imprisonment for raping a 9-year-old girl in Nov 2024. Judge Pragyan Paramita Roul also imposed a fine of Rs 50,000 on the convict, a neighbour of the girl. Failure to pay the fine would result in another year of imprisonment. Special public prosecutor Manoj Kumar Sahu said the verdict was based on testimonies from seven witnesses, including the survivor, and medical reports. The court also directed the Odisha State Legal Services Authority (OSLSA) to provide compensation of Rs 6 lakh to the girl, who was then a Class III student. The crime came to light when the survivor's mother filed an FIR on Nov 29, 2024, alleging that the man had raped her daughter the previous evening when she was alone at home. The elderly man had allegedly threatened to kill the girl if she revealed the incident to anyone. Police arrested the man under sections 65 (rape on a woman under 16 years of age) and 331 (house trespass or house-breaking) of BNS, along with Section 6 of the Protection of Children from Sexual Offences Act, 2012.

1 2 3 Kendrapada: Ad hoc additional district and sessions-cum-fast-track special court in Jajpur on Saturday sentenced a 41-year-old scrap dealer to rigorous imprisonment for life for the rape and murder of a five-year-old girl in 2016. Judge Bijay Kumar Jena convicted the man under sections 376(2i), 302 and 201 of the IPC and Section 6 of the Protection of Children from Sexual Offences (Pocso) Act, 2012. The court also imposed a fine of Rs 10,000 on the convict, with an additional six months of imprisonment if he defaults. According to the prosecution, on Jan 3, 2016, the girl visited the convict's shop to sell empty bottles. Taking advantage of her being alone, he dragged her inside, sexually assaulted her and threatened to harm her family if she revealed the crime to anyone. When the girl threatened to tell her parents, he strangled her to death and disposed of her body in a sack near the railway line. The crime came to light the following day when locals reported a foul smell emanating from a sack near the tracks. Police investigation led to the man's arrest after witnesses reported seeing him carrying a sack from his godown. During interrogation, he confessed to the crime. Special public prosecutor Rajendra Prasad Nayak said that while the prosecution pushed for capital punishment considering it a "rarest of rare" case, the court maintained that the case did not meet the criteria for death penalty. The court has directed the Odisha State Legal Services Authority to provide a compensation of Rs 5 lakh to the deceased's mother. The verdict was based on testimonies from 35 witnesses and 15 documents, including the post-mortem report.

Judge Abhijit Palei also imposed a fine of Rs 50,000 on the convict, with an additional six months of imprisonment if he fails to pay the fine. The court directed the Odisha State Legal Services Authority (OSLSA) to provide a compensation of Rs 5 lakh to the girl. According to the prosecution, the girl was returning home from school on June 20, 2022, when the man, her neighbour, dragged her into his house and sexually assaulted her. He threatened to kill her and harm her family if she revealed the crime to anyone. The girl later confided in her parents, following which her father filed an FIR. Police investigation led to the arrest of the man, who was booked under Section 376 AB (rape of a woman under 12 years) of the IPC and Section 6 of the Protection of Children from Sexual Offences (Pocso) Act, 2012. Special public prosecutor Rajiv Mohanty said the conviction was based on testimonies from 17 witnesses, including the girl, and medical reports.

Kendrapada: A fast-track Pocso court in Jajpur district on Monday sentenced a 34-year-old man to 20 years of rigorous imprisonment for raping a 13-year-old girl last year. Special public prosecutor Partha Sarathi Ray said that on Aug 19, 2024, the convict, who was the girl's neighbour, scaled the boundary wall of her house and sexually assaulted her while she was sleeping. The perpetrator reportedly gagged the minor with a cloth during the assault. The girl's mother filed a complaint at the local police station the next day. The conviction was secured under Section 4(2) of the Pocso Act, 2012, based on the testimonies from nine witnesses, including the girl, and supporting medical evidence.

1 2 3 Kendrapada: A 36-year-old auto-rickshaw driver was sentenced to 30 years of rigorous imprisonment by the additional district-cum-special judge (Pocso), Jajpur, on Tuesday for kidnapping and raping a 12-year-old girl last year. The court also imposed a fine of Rs 30,000 on the convict. He will have to undergo an additional six-month imprisonment is he fails to pay the fine, the court ruled. Special judge Abhijit Palei also directed the Odisha State Legal Services Authority (OSLSA) to pay Rs 1 lakh as compensation to the girl. According to the prosecution, the convict, who regularly drove the Class VII student to school, kidnapped her on March 18, 2024. The girl's mother filed an FIR the next day at the local police station. After a month-long investigation, police rescued the girl from Bargarh district and arrested the accused. Special public prosecutor Rajiv Mohanty said the court relied on testimonies from 15 witnesses, including the girl, and medical reports, before pronouncing the verdict.
