The tot was taken to the hospital and has non-life-threatening injuries, police said, but Guerra is facing a prison sentence for the accident. He said he saw his son walk into the room, but thought he had gone back to his bedroom when he heard a gunshot. Guerra is out of jail without bail, but is facing nine years in prison if convicted. The shooting comes months after another two-year-old shot his twin with a gun he found at home. It's not clear how the toddler got access to the weapon while at home on Robin Hood Lane in Hampton, Georgia. 'It was so scary, a terrible feeling', neighbour Melanie Pressley told local TV news station Fox 5. 'We knew something terrible had happened.' For hours, police searched inside and outside of the white bungalow, set back from the road, where emergency service vehicles were parked in a row. Toy cars and tricycles were lined up near swings in the garden where children might otherwise be playing. Guerra told investigators he saw his young son walk into the living room but believed the boy had returned to his bedroom. Roughly 30 seconds later, while still focused on his computer, Guerra said he heard a gunshot and turned to find his son bleeding. The child's mother told police she was in the kitchen at the time of the shooting and heard the gunfire. Officers later found the weapon under the couch. Guerra acknowledged to police that he was responsible for ensuring the gun was out of the child's reach and admitted to making a serious error. He was released from jail without bail to visit his son in the hospital. If convicted, he faces up to nearly nine years in prison. The Arizona Department of Child Safety has been notified and is conducting a separate investigation, AZCentral reported. Gun safety experts say the case stresses the critical importance of secure firearm storage, particularly in homes with children. 'They're not going to sit there and weigh the risk or benefit of handling a firearm,' Barret Kendrick, a gun safety consultant told AZFamily. 'Generally speaking, as a responsible gun owner, we need to make sure that we're preventing access to anyone who has not been trained or could not be trusted with that firearm.' She added that there had been a previous instance of Guerra leaving firearms out in the home and that they had discussed the need to keep the guns more secure, court documents said. Guerra was arrested and booked on one count of felony child abuse. According to court documents, he admitted to police that it was his responsibility to keep the firearm out of the child's reach and acknowledged it was a serious mistake on his part. The head of a Miami-based theft ring has been convicted of grand theft and dealing in stolen property, and now faces jail time and deportation. Oscar Guerra operated a ring composed of Cuban nationals that stole trailers, RVs, boats, campers, and other large vehicles, resulting in a total loss of more than half a million dollars, according to the state's attorney general's office. Guerra and members of the ring rented cars and then traveled upstate to commit at least 10 thefts in the Ocala area, according to state prosecutors. In one theft, Guerra's group stole a travel trailer from an 80-year-old victim and then sold the trailer in Flagler County. A jury found Guerra guilty of one count of grand theft of more than $20,000 and one count of dealing in stolen property, both are second-degree felonies. "This criminal alien took advantage of Floridians and our nation, and his behavior earned him some time with the Florida Department of Corrections," Florida's Attorney General James Uthmeier said in a statement. "He'll pay his debt to the people of Florida, and then we'll punch his ticket out of here." Guerra faces up to 60 years in prison and will be deported after his sentence is complete.
