In a response to his estranged wife Jennifer Meyer's initial divorce filing from October 2020, the actor, 50, is asking for joint legal and physical custody of his son Otis, 15, according to documents obtained by PEOPLE. The former couple is also parents to daughter Ruby Sweetheart, who turned 18 last November.
He also asked that child and spousal support be determined through private mediation.

Meyer initially filed for divorce from Maguire in 2020, nearly four years after the former couple publicly split. Last September, Meyer announced that she is engaged to Geoffrey Ogunlesi, who is the son of Nigerian billionaire lawyer and investment banker Adebayo Ogunlesi.
After nine years of marriage, Meyer announced she and Maguire were separating in 2016 and said the two would continue to co-parent.
'After much soul searching and consideration we have made the decision to separate as a couple,' Maguire and Meyer said in a joint statement shared to PEOPLE. 'As devoted parents, our first priority remains raising our children together with enduring love, respect and friendship.'
In October 2016, a source told PEOPLE that the couple had "been living separate lives for a while."
"They have completely different interests and haven't seemed to be connecting," the insider said at the time. "He's extremely private and prefers to stay home, and she's very social and has tons of girlfriends."
"They haven't been happy together for a long time," the source continued, "but they are great parents and they love their children."
This past June, Maguire and Meyer reunited as they celebrated his teenage daughter Ruby's graduation from high school. "Congratulations Ruby!!!!! ♥️ Graduate of our dreams. We are so proud of you in every way. We love love love love love you baby 🥰♥️" Meyer wrote in the caption.
