Oklahoma man sentenced for shooting; says he was defending his cousin

TULSA, Okla. — A Quapaw man was sentenced in federal court today on a weapons charge. Charles William Pebeahsy, III. 53, was sentenced on Wednesday to 72 months in federal prison followed by three years of supervised release. Pebeahsy confessed in April 2024 to firing several shots from a semi-automatic rifle toward Colin Beattie on May 31, 2023, according to his plea agreement. Federal prosecutors dropped the remaining charges of assault with intent to commit murder and carrying, using, brandishing, and discharging a firearm during and in relation to a crime of violence – both in Indian Country. According to court documents filed by Pebeahsy's attorney, the victim, Beattie, has a significant criminal history and acted consistent with that history. During an evening with friends, Pebeahsy became highly intoxicated to the point of blacking out. At some point, Beattie physically assaulted Pebeahsy because he tried to stop Beattie from beating up his female cousin. Pebeahsy attempted to shoot Beattie, and when Pebeahsy ran outside, he heard a voice in the distance say something and fired several rounds in the air toward the male voice, which belonged to a neighbor. Prosecutors asserted the neighbor's residence had been struck by a bullet fired by Pebeahsy because of a hole found near the roof of the residence, but there is no evidence to support thisassertion, as no projectile was ever found, the motion states. Pebeahsy was overhead to shout, 'I'm coming for you, Colin.' A bloody and intoxicated Pebeahsy was arrested shortly after the incident and later told officers the fight started because Beattie had beaten up his cousin.
