PETALING JAYA: The Court of Appeal said it upheld the death sentence imposed on a former investigating officer for the murder of his lover 14 years ago to convey a clear message to all police officers of the need to uphold the law. Justice Wong Kian Kheong said all officers were required under Section 13 of the Police Act 1967 to take an oath. Advertisement 'By murdering the deceased, the appellant had betrayed his declaration to 'obey, uphold and maintain' the law,' he said, adding that the bench exercised its sentencing discretion to affirm the punishment on grounds of public interest. Last September, a three-member bench chaired by Justice Supang Lian, sitting in Kota Kinabalu, dismissed Ahmad Rizal Umar's appeal against conviction and sentence for killing Kartini Borhan, 27. Also on the panel hearing the appeal was Justice Collin Lawrence Sequerah. Rizal, who held the rank of inspector, committed the offence at an apartment in Taman Andika, Keningau, between 4am and 5am on Sept 29, 2011. Wong delivered his 37-page written grounds earlier this week, paving the way for Rizal, 43, to exercise his automatic final right of appeal to the Federal Court. The judge said Rizal had used violence and great force to kill Kartini with a knife leaving the victim suffering 10 injuries, including a horrific second stab wound. 'After the murder, he attempted to conceal the offence by alleging that Kartini had been killed by an assailant who broke into the premises to rob her. 'Worse still, he had the temerity to make the false police report and had not shown any remorse,' he said. He said Rizal used his police training and work experience as an investigating officer to conceal the crime. According to the facts of the case, Rizal was in Kartini's rented apartment on the day of the incident but made it look as if a robber had broken into the premises and attacked both of them. Wong said a forensic pathologist gave evidence that Rizal's injuries were self-inflicted and not consistent with the consequences of a combative encounter with a robber. The motive for the murder was a love triangle as the deceased was alleged to have been having an affair with another man. In mitigation earlier, lawyer Ram Singh, who was assisted by Chen Wen Jye, asked for Rizal to be imprisoned and whipped, saying he was a first offender and father to two children. TAWAU: Five foreigners who rammed a police roadblock while attempting to flee at the Megah Industrial Zone at 8pm were arrested after a 45km high-speed chase last Wednesday. District Police Chief ACP Jasmin Hussin said the suspects, aged between 29 and 43, included the male driver, two male passengers, and two female passengers. 'The vehicle was ordered to stop by a team from the Police Patrol Car Unit (MPV) and Motorcycle Patrol Unit (URB), who were conducting a roadblock operation. 'However, the driver defied police instructions and attempted to escape by crashing through the checkpoint, prompting our officers to pursue them,' he said. The chase continued through several main roads including Jalan Timur, Kem Pengakap Tiku, Jalan Bunga Raya, Jalan Chong Thien Vun, and Jalan Apas, before it was eventually stopped at Batu 12, Jalan Apas. Upon inspection, police found none of the occupants, including the driver, could produce any identification. The driver did not possess a valid driving licence or road tax. The case is being investigated under Section 26(2) of the Police Act 1967 for fleeing a police checkpoint and Section 186 of the Penal Code for obstructing a public servant in the discharge of their duties. Investigations are also being carried out under Section 6(1)(c) of the Immigration Act 1959/63 for unlawful entry and stay in the country without valid identification or travel documents. The driver is also being investigated under Section 26 and Section 23 of the Road Transport Act 1987 for driving without a valid licence and road tax. ACP Jasmin said none of the police personnel were injured and that the authorities view such incidents very seriously. 'We urge the public to fully cooperate with the police, especially during roadblocks,' he said. SEPANG: A retired police officer and two others were arrested to assist in investigations into the discovery of various Royal Malaysia Police (PDRM) equipment and paraphernalia, including fake firearms, in Cyberjaya, last Sunday. Selangor police chief Datuk Hussein Omar Khan said all the male suspects, aged between 29 and 64, were arrested after officers from the Cyberjaya Police Station, who were on patrol, spotted them behaving suspiciously while loading items into a Proton Waja. He said further inspection found various PDRM equipment, including various types of fake firearms. 'We found that they were not police officers from any police station or District Police Headquarters (IPD), but rather an independent film production crew for dramas and films with a police theme. 'Initial investigations found that the equipment was used to film a local drama without any written application from the Bukit Aman Corporate Communications Division,' he said at a press conference here today, which was also attended by Sepang district police chief ACP Norhizam Bahaman. Police also seized PDRM equipment from the suspects, including two police cones, two units of magnetic bacon lights with police written on them, three pairs of police operational shoes, six police vests, two weapons resembling HK MP5s, two toy weapons resembling M416s and six traffic police hats. He said they were all remanded for two days ending today to assist in the investigation. Hussein said possessing police equipment and equipment, including weapons that resemble real weapons, is an offence under Section 36(1) of the Arms Act 1960, Section 89 of the Police Act 1967 and Section 170 of the Penal Code. 'We view seriously the use of PDRM equipment, uniforms, and assets without official approval, especially in film and drama productions. KUALA LUMPUR: Selangor DAP Wanita secretary, Nalina Nair Rama Krishnan, remains acquitted of a disorderly conduct charge, for allegedly causing a disturbance at a police station here four years ago. During today's proceedings at the High Court, deputy public prosecutor Noor Dayana Mohamad informed Judge Datuk Muhammad Jamil Hussin that the prosecution was withdrawing its appeal against the Magistrate's Court decision to acquit and discharge the 36-year-old on Aug 10, 2023. 'In light of the withdrawal, the prosecution's appeal is hereby dismissed,' said Judge Muhammad Jamil. Also present was Nalina's counsel, Farida Mohamad. On Aug 10, 2023, Magistrate Nadia Othman acquitted and discharged Nalina after finding that the prosecution had failed to establish a prima facie case against her at the close of its proceedings. Nalina was charged under Section 90 of the Police Act 1967 for allegedly committing the offence at the lobby of the Dang Wangi district police headquarters at 9 pm on Aug 19 Aug 2021. Speaking to reporters outside the court, Nalina expressed gratitude to her legal team for their unwavering commitment and courage in defending her.

Prosecution withdraws appeal against acquittal of Nalina Nair for disorderly conduct

KUALA LUMPUR: Selangor DAP Wanita secretary Nalina Nair Rama Krishnan remains free of a charge of rioting and disorderly conduct at a police station four years ago. This is following the prosecution withdrawing its appeal against the Magistrate's Court's decision that acquitted Nalina Nair on Aug 10, 2023. Deputy public prosecutor Noor Dayana Mohamad informed High Court judge Justice Muhammad Jamil Hussin that the prosecution was no longer pursuing the appeal when the case was brought up in court here on Wednesday (May 7). "The prosecution's appeal is hereby withdrawn," Justice Muhammad Jamil said. Nalina Nair was represented by lawyer Farida Mohamad during the proceedings. On Aug 10, 2023, magistrate Nadia Othman acquitted Nalina Nair after finding the prosecution failed to prove prima facie at the end of the prosecution's case. On Aug 26, 2021, Nalina Nair was charged with rioting, disorderly behaviour or hurling insults at the lobby area of the Dang Wangi police headquarters here at 9pm on Aug 19, 2021. The charge was under Section 90 of the Police Act 1967, which carries a maximum of RM500 or six months imprisonment or both. A total of five prosecution witnesses were called to testify at the trial.
