Appeal against Selangor DAP Wanita leader's acquittal withdrawn
During today's proceedings at the High Court, deputy public prosecutor Noor Dayana Mohamad informed Judge Datuk Muhammad Jamil Hussin that the prosecution was withdrawing its appeal against the Magistrate's Court decision to acquit and discharge the 36-year-old on Aug 10, 2023.
'In light of the withdrawal, the prosecution's appeal is hereby dismissed,' said Judge Muhammad Jamil. Also present was Nalina's counsel, Farida Mohamad.
On Aug 10, 2023, Magistrate Nadia Othman acquitted and discharged Nalina after finding that the prosecution had failed to establish a prima facie case against her at the close of its proceedings.
Nalina was charged under Section 90 of the Police Act 1967 for allegedly committing the offence at the lobby of the Dang Wangi district police headquarters at 9 pm on Aug 19 Aug 2021.
Speaking to reporters outside the court, Nalina expressed gratitude to her legal team for their unwavering commitment and courage in defending her.

Govt files appeal against negligence ruling in Ivana Smit's case
KUALA LUMPUR: The government has filed a notice of appeal against the High Court's ruling that found the government and police negligent in their investigation into the death of Dutch model Ivana Esther Robert Smit. Attorney-General Tan Sri Mohd Dusuki Mokhtar confirmed the appeal when contacted today. "Yes, confirmed. We did file it yesterday," he said in a brief reply to the New Straits Times. Earlier today, in a statement released by the Smit family's lawyer, Datuk Sankara Nair, it was confirmed that the government, through the Attorney-General's Chambers (A-GC), filed a notice of appeal against the judgment delivered by the Kuala Lumpur High Court on July 29, in the civil action brought by Smit's mother, Christina Carolina Gerarda Johanna Verstappen, on behalf of herself and her late daughter. Sankara said the appeal was filed yesterday by the A-GC, on behalf of the inspector-general of police, investigating officer Faizal Abdullah, the home minister and the Malaysian government. "Our firm continues to act for Christina Verstappen in defending the High Court's decision, and we remain committed to ensuring that justice is pursued transparently and vigorously." On July 29, Christina Verstappen was awarded RM1.1 million in damages after the High Court ruled there was negligence by the police in handling the investigation into her daughter's death in 2017. Judge Roz Mawar Rozain ruled there were breaches in the duty of care by the authorities, including failures in crime scene management, evidence preservation and forensic procedures. Christina, who filed the suit as a plaintiff on Nov 20, 2020, had named the inspector-general of police, Faizal, the home minister and the government as defendants. Smit, who was at the home of American couple Alexander William Johnson and Laura Almazkyzy, was allegedly partying with the couple before she fell to her death. She fell from the 20th floor, and her naked body was found on a sixth-floor balcony at 10am. Smit, who had dual Dutch and Belgian citizenship, was the second runner-up in the Malaysia Supermodel Search 2014, when she was 15.

Dr Akmal, Hilman to be charged in court soon
KUALA LUMPUR: Merlimau assemblyman Datuk Dr Muhammad Akmal Salleh and Gombak Setia assemblyman Muhammad Hilman Idham will be charged in court soon, according to the Attorney General's Office (AGC). The AGC in a statement today announced that based on the evidence and statements obtained, the department has decided to file charges under Section 505(b) of the Penal Code (Act 574) against Dr Akmal and Muhammad Hilman Idham. 'This department has examined the investigation papers submitted by the Royal Malaysia Police regarding the statements made by Dr Akmal on the Facebook page 'Akmal Saleh' and Muhammad Hilman via the TikTok platform ' 'The statements made by the individuals were found to have threatened public order or constituted improper use of network facilities or network services,' the statement said. The same statement informed that charges will also be made against Chandrasegaran Subramaniam and Siti Hajar Aflah Sharuddin, in relation to the statements uploaded on the TikTok accounts 'cikguchandra3' and 'SHA_Abrienda' respectively. 'Siti Hajar will also be charged under Act 574 while Chandrasegaran will be charged under Section 233(1)(a) of the Communications and Multimedia Act 1988 (Act 588). 'All charges will be presented at the Magistrate's Court with local jurisdiction in the near future,' the AGC said. Meanwhile, Attorney-General Tan Sri Mohd Dusuki Mokhtar, when contacted, informed that Akmal Salleh will be charged at a Magistrate's Court in Penang in the near future. 'YB Akmal will be charged depending on his whereabouts,' he said. Meanwhile, Akmal Salleh in a post on his Facebook page stated that he is currently performing Umrah in Makkah and will return to the country to face charges on Friday at the Bukit Mertajam Magistrate's Court. Based on a review of the court system, Muhammad Hilman's case will be mentioned tomorrow before Magistrate Amira Abd Aziz, at the Criminal Magistrate's Court here.
