Plea in High Court Alleges ‘Edu Scam' Over Urdu School's Transfer
Nagpur: A writ petition was filed in the Nagpur bench of Bombay high court challenging the transfer of Aarefa Urdu Primary School from Khajanagar in Amravati district to Hatrun in Akola district. Justice Pravin Patil, hearing the matter on Wednesday, issued notices to the Maharashtra govt and other respondents, directing them to file their replies before June 24. The petition, moved by SK Sibghatullah Jagirdar, president of the Nagrik Sewa Sanstha, along with two other office-bearers of the same society, claims that the Saba Minorities Educational and Welfare Society, and Beacon Minority Education Welfare Society fraudulently orchestrated the transfer by fabricating documents and misleading the education department. According to the petitioners, the state education department's transfer order, dated September 27, 2024, violated govt resolutions issued on July 28, 2021, and July 2, 2013, which restrict school transfers to a distance of no more than 20km to avoid unhealthy competition. The newly assigned location of the school in Hatrun is 122km from Khajanagar, the plea states. The petitioners also allege that the rent agreement submitted by the respondent societies falsely claimed the existence of a school building on survey number 124 in Hatrun. "No building exists at the claimed site, and official reports were manipulated to justify this transfer," the plea contends. The petition highlights that Hatrun already has several established Urdu and Marathi medium schools, including the 70-year-old Zilla Parishad Urdu Primary School. It argues that the transfer not only violates state policy but also disrupts established educational institutions and violates the constitutional right to free and fair education. They have also sought the appointment of a commissioner to physically verify the existence of the purported school building in Hatrun. Further concerns have been raised in the plea about Iqra English School and Junior College, run by the same respondent societies, which reportedly received approval in 2019 despite not meeting mandatory conditions.

Boat's glass door cracks, girl in ICU as shards pierce her on ferry in Navi Mumbai
NAVI MUMBAI: An 8-year-old girl was severely injured after a glass door of a floating restaurant was shattered and glass shards pierced her all over the body. The girl's parents were celebrating their wedding anniversary on board the ferry boat which was sailing off Belapur jetty on Tuesday evening. Tired of too many ads? go ad free now The child, Sanvi Patil, sustained severe gashes on the hands and legs, has a cut on the lips, and also has minor injuries to the head. She is recovering in the intensive care unit of a private hospital. The girl was headed towards a wash basin located behind the 7-foot-high glass door which cracked, and the glass pieces fell on her. The girl's father, Pravin Patil, on Friday lodged a police complaint against against Rajesh Nair, owner of the restaurant Flodine Cruise. The girl's father has stated in the complaint that he had booked tickets for a two-hour cruise on the floating restaurant for the family — his wife, daughter and himself. At 6.30 pm, the ferry boat set out from Belapur jetty with around 25 passengers. Around 30 minutes into the deep sea, they cut a cake after which the girl was walking towards the wash basin when the glass door cracked and huge glass pieces fell on her, states the complaint. Hearing the girl's screams, the couple rushed towards the child who had fallen on the floor, big shards and smithereens embedded all over her, says the complaint lodged by the girl's father who is district president of NCP (SP) Navi Mumbai Machimaar cell "She was crying in pain due to a deep gash on the arm and below the knees... Her eyes were not hurt as she was wearing spectacles," the complaint says. The father has alleged that there was no first aid kit on board. I did not apply turmeric, but covered the wounds with a handkerchief to prevent excessive loss of blood," he has stated, adding that he requested the owner to arrange for a speed boat to reach the shore quickly, but he did not arrange for it. It took around 30 minutes for the ferry boat to reach Belapur jetty. When they reached the jetty, the boat owner had not even arranged for an ambulance, the girl's father has said, adding that he (the father) had by then contacted his relative, and the relative got there by a car. The family rushed the child to the hospital, the complaint says. The father said that while a ticket for the cruise costs Rs 1,350 per person, he had got them at a discounted price of Rs 650 per head. The owner of the floating restaurant has been booked for 'endangering life or personal safety of others', under relevant sections of Bharatiya Nyay Sanhita.

‘Convince customer as you convince hubby' remark no insult to woman's modesty: HC
Nagpur: In an important ruling on workplace conduct and criminal liability , Nagpur bench of the Bombay high court recently quashed chargesheet filed against a senior State Bank of India (SBI) official for allegedly making an "objectionable" comment to a female colleague. The court held that the remark — "Convince the customer as you convince your husband" — though inappropriate, did not amount to insulting a woman's modesty under Section 509 of the Indian Penal Code (IPC)."Considering the purpose of the review meeting between the complainant-woman and petitioner on August 11, 2021, and reasons to utter such words at that time do not show any intention of the applicant to insult the modesty of the complainant. Particularly, when the object and purpose of such conversation of the petitioner with the woman was to see that her performance should be improved while performing official duties," a division bench of Justices Anil Kilor and Pravin Patil bench observed that the statement, made by SBI assistant general manager during a staff performance review meeting, lacked criminal intent necessary to prosecute under Section 509 IPC, which deals with words, gestures, or acts intended to insult the modesty of a woman."The statement is undoubtedly disgraceful and in poor taste," the court remarked in its order. "...But considering the purpose and setting of the meeting, it does not appear that the petitioner intended to insult the modesty of the complainant. There is no material on record to show the statement was made with deliberate intent or knowledge to outrage her modesty," the judges complainant, a senior clerk at SBI's Bhandara branch, had registered an FIR on November 14, 2022 — over 15 months after the incident. She cited the August 2021 remark along with two subsequent alleged instances of misconduct — one in August and another in September 2022 — to support her claim of workplace arguing for quashing of the chargesheet, the petitioner's counsel AP Modak contended that legal ingredients of Section 509 were not satisfied. He emphasised that the statement was made in a professional context and lacked requisite criminal intent needed to sustain the plea, additional public prosecutor Mayuri Deshmukh and complainant's counsel advocate Ayushi Dangre maintained that language used was suggestive and amounted to verbal sexual harassment, warranting a court, however, disagreed and held that allowing prosecution in this case would amount to abuse of the legal process. It emphasised that criminal law should not be lightly invoked in matters that, though possibly requiring internal disciplinary action, do not meet the threshold for criminal culpability."Every inappropriate or unprofessional comment, while regrettable, does not necessarily translate into criminal intent," the bench added, underlining the need to distinguish between workplace misconduct and punishable offences under the Takeaways- Statement 'Convince the customer as you convince your husband' was made during staff meeting- Court held the remark, though inappropriate, lacked criminal intent to insult modesty- FIR was filed over a year later by the complainant, a senior clerk with SBI- Court said continuing prosecution would amount to abuse of legal process- Workplace misconduct doesn't always amount to criminal offence under IPC
