Six months after Foster filed for divorce, the "Long Day's Journey into Night" star filed an amended complaint in the former couple's proceeding on March 18, according to a review of Davidson County Circuit Court records by USA TODAY on Sunday. Foster, who cited "irreconcilable differences" as the reason for his breakup with Prepon, accused his estranged wife of "inappropriate marital conduct" in the complaint, according to People magazine and In Touch. In response, Prepon detailed her own allegations of misconduct against Foster in a counter complaint on March 19, court records show. USA TODAY has reached out to representatives for Foster and Prepon for comment. Foster and Prepon married in 2018 after the pair's long-term friendship evolved into a romance around 2015. The actors share two children, 7-year-old daughter Ella and a 5-year-old son. Foster filed for divorce on Sept. 9, 2024, the same day the couple separated, according to court records reviewed by USA TODAY at the time. The Emmy-winning actor also asked the court to uphold their prenuptial agreement, "marital dissolution agreement and agreed parenting plan." While Foster didn't specify Prepon's alleged behavior, he reportedly described her conduct as "cruel and inhuman treatment" that makes living together "unsafe and improper." According to the outlets, Foster also requested that the court determine a joint custody schedule for the former couple and the amount of child support he will pay Prepon. Laura Prepon and her estranged husband Ben Foster are leveling new allegations at each other amid their ongoing divorce. Six months after they separated, Foster, 44, accused Prepon, 45, of 'inappropriate martial conduct' in an amended divorce petition obtained by PEOPLE, while the That '70s Show alum fired back with the same claim just one day later — along with accusations of the actor's 'habitual drunkenness.' In Touch Weekly was first to report the news. In the amended document filed in Nashville, on Tuesday, March 18, Foster, who originally cited "irreconcilable differences" as grounds for the stars' split, added 'inappropriate marital conduct' to his reasoning. (Their official separation date is Sept. 9, 2024, per court filings.) The conduct Foster is alleging — which is also referred to as 'cruel and inhuman treatment" — 'renders further cohabitation [with Prepon] unsafe and improper,' the petition states. A day later, on Wednesday, March 18, Prepon filed a response, also obtained by PEOPLE, denying her estranged husband's allegation that she is guilty of 'inappropriate marital conduct,' as she demanded 'strict proof' substantiating his claims. In the same document, the Orange Is the New Black alum also fired back with the same allegation as her ex, claiming that Foster 'has been guilty of such cruel and inhuman treatment.' She also alleged that the X Men: The Last Stand actor is 'guilty of habitual drunkenness.' Foster has also requested the court appoint he and Prepon joint custody of the exes' two young — a daughter named Ella and a son whose name has not been publicized — stating that both stars 'are fit and proper parents." Prepon, however, 'denies that both parties are fit and proper parents to be awarded the joint care, custody, and control of the parties' minor children and demands strict proof thereof,' the update states. She also requested that 'she be designated the primary residential parent of the parties' minor children," claiming, 'This is in the children's best interests.' Reps for Prepon and Foster did not immediately respond to PEOPLE's request for comment, nor did attorneys for the actors, on March 22. They then welcomed their daughter the following summer and went on to tie the knot in June 2018. The former couple, who welcomed their second child in 2020, were very private about their relationship and kids, but Prepon opened up about their home life on a segment of The MOMS in 2019. 'Ben and I are really great about if I'm at work, he's [at home], and if he's at work, I'm [at home],' the actress said at the time. '[But] I do feel guilty, and I just know that [Ella would] be proud if she knew. I've talked to a bunch of women [asking], 'How do you do this?' And they're just like, 'There's really no solution.
