Conservative legal group presses agency to act on Trump's voter citizenship mandate despite court injunctions
Pro-Trump legal advocacy nonprofit America First Legal (AFL) is calling on the federal Election Assistance Commission (EAC) to begin requiring proof of citizenship for all federal voter registration applicants after the president's effort to do so by executive order was blocked by the courts. AFL filed a petition on Wednesday with the EAC, calling on the agency to amend the national voter registration form to require applicants to provide any one of the following documents proving U.S. citizenship: a U.S. passport, birth certificate, consular report of birth abroad, certificate of naturalization, certificate of citizenship, state-issued REAL-ID compliant license, or other reliable government-issued identification. The move follows a March executive order issued by President Donald Trump, titled "Preserving and Protecting the Integrity of American Elections," which sought to compel the EAC to begin requiring a proof of citizenship requirement on the national voter registration form, in addition to other provisions pertaining to the prohibition of non-citizen voting. New York joins lawsuit over Trump's executive order on elections
ALBANY, N.Y. (NEXSTAR) — New York joined 18 other states in a lawsuit against President Donald Trump's March 25 executive order forcing the states to change their election procedures. State officials, including New York Attorney General Letitia James, say the order breaks the law and hurts New Yorkers. 'Donald Trump's attempt to control our elections, intimidate voters, and limit Americans' right to vote is unconstitutional, undemocratic, and frankly, un-American,' said James in a statement on Thursday. 'We are a democracy—not a monarchy—and this Executive Order is an authoritarian power grab. More Local News The order, 'Preserving and Protecting the Integrity of American Elections,' aims to enforce specific laws about Election Day and stop counting votes received later. The suit—available to read at the bottom of this story—challenges the order's demand that the federal mail voter registration form require documentary proof of citizenship. According to James and the other attorneys general, the order ignores the federal National Voter Registration Act and the Help America Vote Act. The suit claims that only state governments and Congress govern elections and asks the federal court in Massachusetts to declare the order void, permanently block it, stop its enforcement, and award the states their legal fees. It said the order forces the independent Election Assistance Commission to add a proof-of-citizenship requirement to the federal voter registration form, exceeding presidential authority. More: Latest News from Around the Tri-State The order would also make state and local officials verify that proof, allegedly conflicting with federal law. Plus, it directs the Defense Department to change the overseas voter registration form to require proof, too, again usurping authority unconstitutionally. That's according to the lawsuit, which further alleges that tying federal funds to state compliance undermines the states' constitutional control over their own elections. The order would also require attorneys general to enforce rules to stop counting ballots received after Election Day, contrary to the states' laws. Under current New York law, officials count ballots postmarked by Election Day even if they arrive later. And in New York, voters don't have to show identification at the ballot box. But the state does verify voter IDs when people register to vote in the first place. Republican bills target MTA, end congestion pricing In the lawsuit and elsewhere, New York officials argued the order would upend their system, requiring extra work, costing millions, and disenfranchizing voters. 'The executive order signed by President Trump is a blatant attempt at voter suppression that could disenfranchise millions of eligible voters,' said Assemblymember Latrice Walker, chair of the Assembly's Election Law Committee, on March 27. 'The order would create unnecessary barriers to the free exercise of the very cornerstone of our democracy—the right to vote.' But, 'I am thrilled to align with President Trump on the critical importance of safeguarding our electoral process,' said State Senator Mark Walczyk, the ranking Republican on the Senate Committee on Elections. 'The SAVE Act that I sponsor fits seamlessly with the President's vision for a transparent and accountable election system. We must ensure that the right of American citizens to vote is protected and that their votes are not diluted by illegal practices.' How the Pueblo County Election Office is responding to Trump's election executive order
The Pueblo County Election Department affirmed a commitment to fair and secure elections following President Donald Trump's signing of an executive order that could impact local elections across the country. "Preserving and Protecting the Integrity of American Elections" was signed by Trump on March 25. The order calls for stricter enforcement of voter citizenship requirements, increases the power of the federal government in managing elections, and orders the prosecution of those caught voting illegally, among other actions. A March 28 notice from Pueblo County Clerk and Recorder Candace Rivera, released in response to Trump's executive order, asserts that many practices outlined in the order are already practiced by the state of Colorado and the Pueblo County Election Department. Such practices listed in Rivera's notice include the requirements that ballots be received by Election Day, that a paper trail exist for every ballot, that voter rolls be maintained to only include eligible voters, and that non-citizens be prohibited from voting. "The Pueblo County Election Department welcomes conversation on election integrity, and we want voters to know that Pueblo County and the State of Colorado already meet or exceed many of the standards emphasized in the Executive Order," Rivera's notice reads. "Our election system is secure, transparent, and nationally recognized for its accuracy and accessibility." Rivera's notice also mentions aspects of Trump's order — like the order's citizenship documentation requirement for voters — that will "necessitate federal rulemaking" and "may face legal challenges." Under Trump's executive order, national mail voter registration forms will require voters to document their citizenship by providing a REAL ID driver's license, REAL-compliant state-issued card, or U.S. passport. "Pueblo County will continue to monitor developments and coordinate with the Colorado Secretary of State's Office on any required changes," the notice reads. During a March 27 interview with MSNBC, Colorado Secretary of State Jena Griswold said the executive order's documentation requirements could disenfranchise millions and disproportionally affect "women, people of color and blue-collar Americans." "Many real IDs actually do not show citizenship... it heavily relies on passports and frankly, passports are expensive," Griswold said. "They are like 160-plus dollars. Many people do not have them and people of color don't have them at a higher rate than the average American... Then, on top of that, women who get married well, then they have to jump through an additional hoop when they change their last names." When asked by MSNBC reporter Ana Cabrera about the possibility of Colorado suing, Griswold said, "We are in conversations, but I do think we will see litigation." Jefferson County Clerk Amanda Gonzalez, a 2026 Democratic candidate for Colorado secretary of state, expressed concerns about the executive order's legality, its potential for disenfranchisement, its potential for privacy violations through federal agencies having access to state voter rolls, and the efforts of the Trump administration to undermine state elections in an April 1 interview with the Chieftain. "This executive order and proposed federal legislation like it, really set up a false binary," Gonzalez said. "It is not the case that we can have accessibility or security. Colorado illustrates that we already have safe and accessible elections." Gonzalez said she will be monitoring any litigation efforts and would consider taking part if her experience as a county clerk can be useful in making arguments. Nationally, a lawsuit has been filed by the Democratic National Committee, the Democratic Governors Association, the Democratic Congressional Campaign Committee, the Democratic Senatorial Campaign Committee, Senate Minority Leader Chuck Schumer, and House Minority Leader Hakeem Jeffries. "This executive order is an unconstitutional power grab from Donald Trump that attacks vote by mail, gives DOGE sensitive personal information and makes it harder for states to run their own free and fair elections," a statement from the coalition reads.
