Agra: A 38-year-old man was sentenced to life imprisonment for raping a Dalit woman and circulating her obscene photos to her relatives. The SC/ST court in Agra, presided over by Judge Pushkar Upadhyay, also imposed a fine of ₹90,000 on the convict. Additional district govt counsel (ADGC) Hemant Dixit said on Saturday that the 30-year-old woman's mother, a farmer, had filed a police complaint against the accused in March 2022. "My daughter and the man were friends and used to speak regularly. After her engagement, we asked her to stop talking to him. But around Jan 2021, he convinced her to meet him one last time. During that meeting, he took obscene photos of her and forcefully did wrong things. My daughter returned home and told me everything. Out of shame, we didn't report it and got her married," the mother told the court during the trial. She added, "After the wedding, the man began sending my daughter's obscene photos to our relatives, including to the mobile phone of my brother-in-law's son-in-law. The pictures were sent to many relatives." Additional session judge at a special SC/ST court in Agra, Pushkar Upadhyay, on Friday sentenced 33 accused to five-year jail term in a 1990 case involving a violent attack by members of the Jat community on a Dalit locality in Akola Udar village under the Fatehpur Sikri area of the district. The incident left at least 100 people injured. The court held the accused guilty under sections 3(1)(x) of SC/ST Act, 452 (house trespass), 148 (rioting with deadly weapon), 149 (unlawful assembly), 427 (damage to property) and 504 (intentional insult provoking breach of peace) of the Indian Penal Code. Giving this information, Hemant Dixit, additional district government counsel (ADGC), criminal, special court (SC/ST Act), Agra, said a penalty of ₹10,000 each was also imposed on the guilty for offences under the SC/ST Act. Earlier on May 28, the court in its order had held 35 accused guilty. Of them, two accused did not turn up in the court and thus non-bailable warrants were issued against them. The court heard arguments from both prosecution and defence counsel on Friday and delivered its order on quantum of punishment. Out of the 74 people originally charge-sheeted in 1994, 22 died during the course of litigation, while 15 were acquitted due to lack of evidence. Two of the accused who were minors at the time of the incident were tried in a juvenile court. The chargesheet was filed in 1994 in a case registered at Kagarol police station of Agra in connection with the incident that took place on June 24, 1990, three days after the infamous Panwari case, another caste-based conflict in Agra district. The case was registered at the Kagarol police station after the dominant Jat community members allegedly attacked Dalits residing in Akola Udar village in Fatehpur Sikri area. The counsel for victims, Shamsher Singh, who was then a child, claimed to have seen his father facing head injuries in the attack. He was one of around 100 people injured. Earlier on June 21, 1990, there was a dispute in Agra's Panwari village over the 'baraat' (wedding procession) of a Dalit family. Administration and police intervened and provided protection to the baraatis amidst opposition. The violence later spread to other villages, with Akola Udar being one of them. Curfew was imposed in the aftermath of the violence. As the judgment came on Friday, it also brought back the memories of what happened in Agra around 35 years ago when the district was plagued by caste violence that took place in the presence of police and district administration officials. 'It all began over a 'barat'during a marriage at house of Chokhelal, a villager from Jatav community in Panwari village. Dominant Jat community members were against it while Jatav community members were adamant on it and the issue could not be resolved. Police and district administration reached Panwari village to resolve the issue,' recollects senior local journalist SP Singh who was in Panwari village on June 21, 1990. 'The barat reached the house but the village was surrounded by angry Jat community members while police and administrative officials were inside the village. Jats from nearby districts of Mathura and Bharatpur also moved in while Dalits from Agra moved towards the village,' claims Singh. 'The stalemate continued with the then DM and the SSP on the spot. In the firing that took place, two members of the Jat community died and the army was called,' he further claims. 'The incident polarised the dalit politics of Agra region after the Panwari incident. Mayawati, the then MP from Bijnor, visited Agra and raised the Panwari case in Parliament. The then leader of opposition in Lok Sabha, Rajiv Gandhi also visited Agra,' Singh claims.

Agra: Over three decades after caste violence broke out in Panwari and nearby villages in Agra following controversy over a Dalit wedding procession, a local court on Friday sentenced 32 men to five years of rigorous imprisonment (RI) in the case. Delivering the 97-page verdict, the special SC/ST court of Judge Pushkar Upadhyay also imposed a fine of ₹41,000 on each convict. Half of this amount will be given to the affected Dalit families as compensation. The sentencing came three days after the court convicted 35 men and acquitted 15 others for lack of evidence. Of the original 72 accused, 22 died during the prolonged trial. While 32 convicts were taken into custody on Friday, non-bailable warrants were issued against the remaining three for not appearing in court. The case, titled State vs Vipti Ram and others, relates to the violence that unfolded on June 21–22, 1990. The trigger was a Dalit groom riding a horse during his wedding procession in Panwari, which led to objections from a group of Jat men. An altercation followed, and the next day, both sides exchanged gunfire, resulting in the death of 50-year-old Soni Ram Jat. Several Dalit homes were torched in the aftermath. The violence prompted the heavy deployment of Provincial Armed Constabulary and police forces. A month-long curfew was imposed to bring the situation under control. Then-Congress leader and former PM Rajiv Gandhi, along with Sonia Gandhi, had visited Panwari village after the violence. A case was registered at Kagarol police station by then-SHO Omveer Singh Rana. Charges were framed under IPC sections 148 (rioting with deadly weapons), 149 (unlawful assembly), 323 (voluntarily causing hurt), 144 (joining unlawful assembly with a weapon), 325 (causing grievous hurt), and sections 3/2/5 of the SC/ST Act. Additional district govt counsel Hemant Dixit said, "At least 200–250 people were present at the spot in Akola. A total of 72 were named in the case, and 31 prosecution witnesses were examined during the trial." During Friday's hearing, the defence side argued for leniency, stating that the convicted men are now aged between 80 and 85, come from agrarian backgrounds, and have no prior criminal record. BJP MLA Chaudhary Babu Lal and seven others were acquitted in 2022 after key witnesses turned hostile and the original case diary went missing. Dixit countered the defence side's arguments, saying, "All the accused were young at the time of the incident. The violence in Akola was so brutal that it led to a mass exodus of Dalit families. Therefore, we demanded maximum punishment." Meanwhile, sources said that the convicts plan to move the Allahabad high court against the verdict. " No proper investigation was done after the incident. Things are peaceful now — the Dalit families who left have returned, built homes, and we live in harmony today," an associate of one of the convicts said.

The woman was alone with her children as her husband was working in his farmland and her in-laws had gone to Etah to consult a doctor. The accused then barged into her room, raped her and threatened to kill her if she spoke about the assault. He locked her inside and fled the scene. After her husband returned, the woman informed him of the incident and a complaint was lodged at Barhan police station. A case was registered the next day under IPC sections 376 (rape) and 452 (house trespass), along with relevant provisions of the SC/ST (Prevention of Atrocities) Act. The chargesheet was filed on Oct 10, 2016. "The accused was staying at his maternal uncle's house and preparing for govt exams.
