Software engineer dies in Ghodbunder accident; parents awarded Rs 49.46 lakh compensation by Tribunal
Representative image THANE: The Motor Accident Claims Tribunal (MACT), Thane, awarded a compensation of ₹49.46 lakh to the elderly parents of a 25-year-old IT engineer who died in a tragic road accident on Ghodbunder Road in January 2019. The incident occurred near the Hide Park bus stop when the victim, a resident of Thane, was riding his motorcycle and attempted to overtake a state transport bus. He lost control and collided with the bus, after which a truck coming from behind ran over him, causing fatal head injuries. The tribunal observed that while the young man failed to maintain proper distance while overtaking, the truck driver's rash and excessive speed was primarily responsible for the fatality. The tribunal exonerated the bus driver of any negligence. The deceased was a software engineer earning ₹30,000 per month and was the sole earning member of his family. His father, aged 56, and mother, aged 55, filed the claim under Section 166 of the Motor Vehicles Act, citing both emotional and financial loss. MACT member R.V. Based on the papers on record, the total compensation was calculated. Of the total compensation of ₹65.94 lakh calculated, 25% was deducted for contributory negligence, resulting in a net award of ₹49.46 lakh. The amount is to be paid with 9% annual interest, with a portion directed to be placed in fixed deposits for three years for the parents. The tribunal directed the truck owner and its insurer to jointly pay the compensation. The bus owner and its insurer were not held liable. Teen Maimed for Life Gets ₹16.4 Lakh Compensation Involving BEST Bus Accident
Thane: A 17-year-old student who was run over by a BEST bus in Santacruz six years ago was awarded Rs 16.44 lakh compensation by the Motor Accident Claims Tribunal (MACT) in Thane. According to the petition, the student was on her way to Podar Jr. College on July 3, 2018, when the accident occurred near Podar Signal on S.V. Road around 9:30 am. The BEST bus, travelling at high speed in a "rash and negligent manner," struck her from the left side, causing her to fall as the front wheel ran over her right thigh. The order, passed by MACT Member R.V. Mohite on August 7, was made available on Saturday. The case proceeded ex-parte as BEST's transport manager failed to appear despite being served summons. Desai Hospital before being admitted to Nanavati Super Specialty Hospital for nearly two months. She claimed medical expenses of Rs 8 lakh and continues outpatient treatment. The tribunal fixed her notional income at Rs 6,000 monthly with a multiplier of 18 for her age group, applying 40% future prospects as per guidelines. The award included compensation for loss of income at Rs 3,24 lakh, future prospects at Rs 1,29,lakh hospitalisation costs of Rs 9,04 lakh medical bills totalling Rs 2,15 lakh along with amounts for special diet and conveyance, pain and suffering, and attendance charges. The tribunal found sufficient evidence through the FIR and spot panchanama to establish the bus driver's negligence, with no contributory negligence by the victim. BEST has been directed to deposit the amount within one month, with Rs 5 lakh to be invested in a five-year fixed deposit in the student's name.
