Kathua case: Trial against eighth accused continues at snail's pace even after 2 years

Chandigarh: While the decision against the main accused in the Kathua rape case had come within a year of the start of trial in Pathankot, in the case of eighth accused Subham Sangra, the trial is proceeding at a snail's pace in the absence of any directions for a day-to-day hearing. The trial against Sangra has been pending for almost two years since June 7, 2023. The last date was May 29, when the case was at the stage of prosecution evidence. A total of 57 hearings have taken place over two years. Sangra is the nephew of the main accused, Sanjhi Ram, the caretaker of the religious place where the offence took place. He has already been awarded life imprisonment in this case However, the trial against seven other accused, in which six were convicted, started on May 31, 2018, and was completed on June 10, 2019. One accused was acquitted on account of the benefit of doubt. The accused, Sangra, is currently confined in Gurdaspur central jail and is presented before the court through videoconferencing during hearing. The matter is now listed for hearing on Friday. Lawyers privy to the case informed that because of absence of specific directions for day-to-day trial of the case from apex court, is the reason that the case has been pending for over two years. The case is being tried at Pathankot in view of the apex court's directions to shift the trial out of Jammu and Kashmir due to its sensitivity. The police have already submitted the chargesheet against Sangra for murder, rape, kidnapping, and wrongful confinement. On Nov 16, 2022, the SC ordered that Sangra be tried as an adult. The decision was passed by the apex court after allowing the plea filed by authorities. Sangra, the eighth accused, could not be tried after the juvenile justice board declared him a juvenile. After the Jammu and Kashmir High Court also declared him a juvenile, an appeal was filed before the SC. In this case, the allegations were that the 8-year-old victim was kidnapped and sedated before she was raped in Jan 2018. Former director of J&K tribal affairs dept, others booked for scholarship ‘scam'

The J&K anti-corruption bureau (ACB) on Monday registered a case against former director of tribal affairs department and others for alleged violations in implementing the post-matric scholarships for ST candidates, said officials. Former director MS Choudhary has now retired. The case was registered under section 5(1)(c) (d) and section 5(2) of J&K Prevention of Corruption Act, 2006 and section 120B of the Ranbir Penal Code (RPC), a spokesperson said. Along with Choudhary, others booked include Shanaz Akhtar Malik, Humera Banu, Firdous Ahmed, Sham Lal Targotra, Jaffer Hussain Wani, Parshotam Bharadwaj, Ramneek Kour and Puneet Mahajan. Most of the accused are officials from private institutes located in Jammu region. The spokesperson said the case was registered after allegations of gross violations of guidelines and release of crores of rupees to unrecognised institutes for unrecognised courses while implementing post matric scholarship. Under the post matric scholarship scheme, the Centre grants financial aid of ₹18,000 per student to ST candidates, along with ₹2,300 maintenance allowance. The private institutes located at Jammu district managed to get documents of ST students hailing from far-flung areas and submitted them to the directorate of tribal affairs. The officials, without verifying the institutes, disbursed scholarships worth crores between 2014 and 2018 into the bank accounts of these institutes, the spokesperson added. Further verification found payments were released to students who did not even apply for these courses. Though some students sought admission under the scheme, they never attended or partially attended the computer courses, the officials said, adding that the benefits were paid in full even against the names of these students. 'Some fake bank accounts were opened for ST students without their consent and knowledge as it was mandatory to fill account number in the form for maintenance allowance. A few of the institutes did not have accreditation, but fees were disbursed to them,' the official said, adding that the investigation is ongoing.

A day after J&K anti-corruption bureau named NC MLA from Budhal Javid Iqbal Choudhary in a land scam, he clarified that he was given clean chit long ago by the crime branch and income tax departments. The MLA added he will assist the ACB in their probe and provide all evidence. 'I have come to know that my name is being linked to a land allotment under investigation of ACB. This could be erroneous or mischievous, which I will have to ascertain. I want to clarify that I have never been a beneficiary of any such transaction and nor have I ever been a stakeholder of such land. I am also aware of a white-collar nexus, which is spending a good deal of money and other resources to plant fake stories against us,' Choudhary said in a post on his Facebook page. The ACB registered a case under section 5(1)(d) and 5(2)of the J&K Prevention of Corruption Act and section 120B of the Ranbir Penal Code (RPC) against Ravinder Sharma, the then Jammu tehsildar (settlement), Mohammad Bashir, the then Bahu tehsildar,Mohd Sarwar Lone, the then Bahu naib tehsildar, Mohd Rasheed Malik, the then Chowadhi patwari, and other beneficiaries for allotment of state land in favour of one Tara Singh from Deli Rakh Bandu in Jammu without fulfilling the conditions of a cabinet order. During the inquiry, it surfaced that allotment order was issued by the then Jammu PRO in 2013 to Singh as refugee allottee and ownership rights were conferred upon the allottee in violation of the cabinet order which says allottee has to cultivate the land personally within six months from the date of the allotment.

In its ongoing efforts to combat the terrorist ecosystem, the Srinagar Police is actively targeting associates of proscribed terrorist outfits as part of investigations under the Unlawful Activities (Prevention) Act (UAPA). The police are conducting intensified searches across multiple locations in the city to dismantle the terrorist infrastructure in the district. To date, searches have been conducted at the residences of several terrorist associates to target the support systems for terrorist activity. Recently, the Srinagar Police conducted searches at the residences of the following individuals: 1. Noor Mohammad Sheikh, son of the late Gh Mohammad, resident of Kanimazar, involved in case FIR No. 156/2023 under sections 7/25 of the Arms Act, and sections 13 and 23 of the UAPA. 2. Waseem Tariq Matta, son of Tariq Ahmad, resident of Rampora, involved in case FIR No. 46/2023 under sections 7/25 of the Arms Act, and sections 4/5 of the Explosive Act, and sections 18, 23, and 38 of the UAPA at Police Station Chanpora. 3. Anjum Younis, daughter of Mohammad Younis, resident of Kenihama, involved in case FIR No. 27/21 under sections 302, 392, 7/27 of the Arms Act, and sections 13, 16, 18, and 20 of the UAPA at Police Station Nowgam. 4. Bilal Ahmad Lone, son of Ab Rehman, resident of Syedpora Eidgah, involved in case FIR No. 51/021 under sections 302, 147, 148, 149, and section 13 of the UAPA at Police Station Safakadal. 5. Firdous Ahmad Dar, son of Gh Mohd Dar, resident of Ibrahim Colony, involved in case FIR No. 46/2023 under sections 7/25 of the Arms Act, and sections 4/5 of the Explosive Act, and sections 13, 23, and 38 of the UAPA at Police Station Chanpora. These searches were conducted in accordance with legal procedures, in the presence of Executive Magistrates and independent witnesses, under the supervision of officers from the J&K Police. The objective of these operations was to seize arms, documents, digital devices, and other evidence to gather intelligence and detect or deter any conspiratorial or terrorist activity against the security of the nation. The decisive actions taken by the J&K Police aim to dismantle the terrorist ecosystem in Jammu and Kashmir by identifying and prosecuting individuals engaged in anti-national and criminal activities. The Srinagar Police remains committed to maintaining peace and security in the city. Any individual found to be promoting violence, disruption, or unlawful activities will face strict legal consequences.

BENGALURU: Upa Lokayukta Justice B Veerappa unearthed large-scale irregularities in procurement of farmers' produce at the Agricultural Produce Market Committee's (APMC) yard, the ragi procurement centre (RPC) and a godown of Karnataka State Warehousing Corporation (KSWC) at Doddaballapur on April 7. The Upa Lokayukta registered complaints against APMC secretary Abida Anjum, Narayana HN, junior assistant, RPC, and others. The RPC and the godown are also on the APMC yard. According to a report, agents of merchants collected 10% commission from farmers for their produce and no receipts were issued. Thousands of farmers and merchants visited the APMC yard daily and Rs 10 collected from them for using toilets there. The toilets did not have regular supply and were not maintained properly. Moreover, the yard had no restrooms for farmers. The situation is no different at RPC and the godown. The Upa Lokayukta found uncalibrated weighing machines at the yard. Farmers suffered losses because of this. Employees at the yard declared cash in their possession while entering their offices, but not at the time of leaving. No movement register was maintained. The officials did not provide details to the Upa Lokayukta regarding registered agents, traders and licenses issued to them. Though space has been provided by the APMC for ragi procurement, the weighbridge there was not being used, the report said. When asked, Narayana informed the Upa Lokayukta that the weighbridge installed by the APMC at a cost of Rs 20 lakh on the main road is not accessible to farmers because vehicles could not reach the spot due to a drain. When farmers stated that they were deprived of various benefits, the Upa Lokayukta directed the APMC officials to address all issues. At the ragi godown of KSWC, each bag was found labelled 50 kg. However, when weighed, it was found that some bags contained only 43 kg, 48kg and 49 kg. But farmers should go there with ragi bags, each containing 52 kg instead of 50 kg. When Narayana's mobile phone was checked, it was found that more transactions were made through digital payment. The Upa Lokayukta sought statements of bank accounts of Narayana and Tanveer Sait, district manager.
