Sabarimala women's entry issue: HC seeks govt's views on activist's plea to quash case against him

Kochi: High court has sought instructions from the state govt on a petition filed by activist Rahul Easwar, seeking to quash a case against him pending before the magistrate court, Alappuzha, for allegedly making provocative remarks during television debates related to the Sabarimala women's entry controversy, in 2018. The bench of Justice V G Arun adjourned the petition for consideration after 10 days. The case was registered in 2018 based on a complaint by the Alappuzha south police, alleging that Easwar had made certain statements during the controversy, including one to the effect that feminists would have to trample on his chest to enter Sabarimala. The police registered the case under Section 153 of the Indian Penal Code, which penalises wanton provocation with intent to cause a riot. In his petition, Easwar denied the allegations and contended that the alleged remarks would not attract the offence under Section 153 IPC. He submitted that the registration of the FIR and filing of the chargesheet amounted to an abuse of the process of the court, and that continuation of the proceedings would cause him injustice and hardship.
