July 21 decision on whether Zayn Rayyan's parents to enter defence in child neglect case
PETALING JAYA — The Sessions Court here today set July 21 to deliver the decision on whether Zayn Rayyan Abdul Matin's parents, Zaim Ikhwan Zahari and Ismanira Abdul Manaf, are to enter their defence, or be acquitted of the charge of neglecting the six-year-old autistic child, to the point of causing physical harm to him. Judge Dr Syahliza Warnoh fixed the date after deputy public prosecutor (DPP) Raja Zaizul Faridah Raja Zaharudin informed the court that the prosecution would be closing its case today, having called 28 witnesses over the course of the 20-day trial, which began on Feb 4. 'The court has set July 21 for the decision, and if the accused are ordered to enter their defence, the defence trial will commence on the same day, and continue until July 24,' said the judge. The court also fixed May 23 as the deadline for written submissions, with reply submissions by June 6. Among the witnesses called during the trial were Faizul Najib Abd Munaim, the first person to discover the victim's body; the child's babysitter Auni Afiqah Abas; forensic consultant physician Dr Rohayu Shahar Adnan; three investigating officers; and two 10-year-old child witnesses. Earlier, Raja Zaizul Faridah announced that all 28 prosecution witnesses had given their statements, and that the prosecution did not intend to call any additional witnesses. 'There are no other witnesses to be called, and with this, we close the prosecution's case. We offer 23 witnesses to the defence, and the list has been provided,' said Raja Zaizul Faridah, who is handling the case alongside DPPs Aqharie Durranie Aziz and Nur Sabrina Zubairi. When asked about the number of defence witnesses expected to be called, should the accused be ordered to enter their defence, defence counsel Ramzani Idris said that they may call up to seven witnesses. The two accused are also represented by lawyers, Haresh Mahadevan and Lavanesh Haresh. On June 13 last year, Zaim Ikhwan and Ismanira, both 30, pleaded not guilty to a charge of neglecting their six-year-old autistic son in a manner likely to cause physical harm. The offence allegedly occurred along PJU Damansara Damai, between noon on Dec 5 and 9.55 pm on Dec 6, 2023. They were charged under Section 31(1)(a) of the Child Act 2001, which is punishable by a maximum fine of RM50,000, imprisonment of up to 20 years, or both, upon conviction. Zayn Rayyan was reported missing on Dec 5, 2023, and his body was discovered in a stream near his home at Apartment Idaman, Damansara Damai, the following day. Court to decide in July whether Zayn Rayyan's parents must enter defence
PETALING JAYA: The Sessions Court today fixed July 21 to deliver its decision at the end of the prosecution's case against the parents of deceased autistic child, Zayn Rayyan Abdul Matin, who are facing child neglect charges involving their six-year-old son in 2023. If the court finds that the prosecution has established a prima facie case, the couple - Zaim Ikhwan Zahari and Ismanira Abdul Manaf, both aged 30 - will be called to enter their defence. Otherwise, they will be acquitted. Judge Dr Syahliza Warnoh set the date after deputy public prosecutor Raja Zaizul Faridah Raja Zaharudin informed the court that the prosecution would not be calling any further witnesses. Syahliza also fixed May 23 as the deadline for written submissions, with reply submissions due by June 6. "I will deliver my decision on July 21. If the court orders the accused to enter their defence, the case will proceed on the same day to save time. It will be heard over three days until July 24, and, if necessary, continue from Aug 4 to 8," she said. The final witness called by the prosecution was senior investigating officer, Assistant Superintendent Mohd Hafizee Ismail, from the Petaling Jaya district police headquarters Criminal Investigation Department (CID). He was cross-examined by defence counsel Haresh Mahadevan and re-examined by Raja Zaizul Faridah. The prosecution closed its case after calling 28 witnesses over the course of the 20-day trial, which began on Feb 4. Raja Zaizul Faridah said the prosecution had served a list of 23 witnesses to be offered to the defence, in the event the accused are ordered to enter their defence. Co-counsel Ramzani Idris said the defence had identified seven witnesses to be called, if required. Also appearing for the defence was lawyer Lavanesh Haresh. Other members of the prosecution team included deputy public prosecutors Aqharie Abdul Aziz and Nur Sabrina Zubairi. On March 13, Zaim and Ismanira, as the first and second accused respectively, claimed trial to a jointly amended charge of child neglect. They are accused of committing the offence from 12pm on Dec 5, 2023 until about 9.55pm on Dec 6, 2023 in the vicinity of Block R, Apartment Idaman, Damansara Damai, and at a nearby stream. Among the witnesses was sales executive Faizul Najib Abd Munaim, who was the first person to discover Zayn Rayyan's body at 9.40pm on Dec 6, 2023, lying on a sandbank near a stream close to Block R. Forensic pathologist Dr Rohayu Shahar Adnan testified that the child's death was suspicious, prompting the reclassification of the case from sudden death to homicide. She said Zayn had died from ligature strangulation and sustained multiple injuries on his ears, with some extending to the back of his head and anus. Assistant Superintendent Mohd Zaidi Abu Hassan, a computer crime investigation unit analyst, said he had extracted WhatsApp text messages expressing frustration and stress from contacts named "Baby Sayang" and "Manja". These were retrieved from an iCloud account registered to Ismanira and a Google account registered to Zaim Ikhwan Zahari. Assistant Superintendent Nor Zaharuddin Sanip, meanwhile, denied claims that he and his colleagues were pressured by superiors to hasten the investigation in 2023. Dr Syahliza had also led a site visit to Block R, which included prosecutors, defence lawyers, investigators, prosecution witnesses, the K9 Detection Unit and the Forensic Unit. Two child witnesses, both aged 10, gave their testimony via in-camera proceedings. The media have been barred from reporting any of their details in order to protect their identities.
