Karnataka HC stays case against Arnab Goswami, BJP IT cell chief
The Karnataka High Court has granted an interim stay on criminal proceedings initiated against BJP leader Amit Malviya and Republic TV's Editor-in-Chief Arnab Goswami, in connection with allegations of spreading false claims that the Indian National Congress (INC) operates an office in Istanbul, Turkiye. Justice S Rachiah passed the order on Thursday while hearing petitions filed by both Malviya and Goswami, seeking the quashing of the cases lodged against them. The stay will remain in effect until the next hearing. Malviya is also facing a separate case over a controversial social media post in which he shared a morphed image showing half the face of Gandhi merged with that of Pakistan's Army Chief Asim Munir. The caption alleged that Gandhi was aligning with Pakistan's narrative, particularly in the wake of India's military offensive Operation Sindoor, in response to the April 22 Pahalgam terror attack. Malviya's post further questioned whether Gandhi was aspiring for the Nishan-e-Pakistan, Pakistan's highest civilian award. Both cases have now been stayed following petitions to quash them. The Congress had filed multiple complaints across the country, including in Karnataka, accusing Malviya and Goswami of orchestrating a "criminally motivated campaign" to spread fabricated claims that the Istanbul Congress Centre in Turkiye is an official Congress office. The party alleged that the misinformation was aimed at defaming the INC, inciting unrest, and compromising national security, particularly sensitive in light of strained diplomatic ties between India and Turkiye following the Pahalgam attack and India's retaliatory action. On May 20, Republic TV issued a public correction, stating that an image used in its digital coverage, which was purportedly linked to the alleged Congress office in Turkey, was mistakenly included by a video editor. The channel clarified that the image had no relevance to the broadcast content and was never aired on Goswami's primetime debate show. The error, the channel said, occurred after the live show had ended and was swiftly corrected. Republic TV extended an "unconditional and sincere" apology. The next day, a post on Malviya's 'X' handle reiterated that the Congress had opened an office in Turkiye in 2019, shortly after it voiced support for Pakistan on the Kashmir issue at the UN. He dismissed the legal actions as evasive and insisted the party had yet to provide a credible explanation. During Thursday's court proceedings, Senior Advocate Aruna Shyam, representing Malviya and Goswami, argued that the cases were politically driven and lacked substance. He highlighted inconsistencies in the application of legal provisions, particularly how an initially bailable charge under Section 352 of the Bharatiya Nyaya Sanhita (BNS) was reportedly upgraded to a non-bailable one under Section 353 after police approached a magistrate. Section 353 pertains to statements intended to incite public disorder. Shyam questioned the applicability of Section 353, stating, "He (Gandhi) is not a government functionary but the opposition leader," suggesting that the legal escalation was politically motivated. The State's counsel responded that the investigation was at a preliminary stage and only notices had been issued, with no intention of making arrests. He urged the court to allow the inquiry to proceed to ascertain the nature and context of the disseminated information.

Karnataka HC stays Congress's case against Amit Malviya, Arnab Goswami
The Karnataka High Court on Thursday stayed criminal proceedings against BJP IT cell head Amit Malviya and Republic TV editor-in-chief Arnab Goswami in a case related to allegedly spreading misinformation about the Indian National Congress operating an office in Turkey. The interim order in this case was passed by a single-judge vacation bench of Justice S Rachaiah. The matter is set to be heard again on June 20. Swaroop B N, the head of the Indian Youth Congress's legal cell, had filed a complaint in this case at Bengaluru's High Ground police station. The FIR under sections 192 and 352 of the Bharatiya Nyaya Sanhita, under charges related to provocation to cause riot and insult to provoke breach of the peace, had alleged that Malviya and Goswami had made an attempt to malign the Congress by circulating the claim that the Istanbul Congress Center building was the party's office. In his petition before the high court, Malviya urged that the case be quashed and the investigation be stayed in the interim. His counsel argued that the opinions expressed on the issue of the Congress having an office in Turkey during a programme were unrelated to the Istanbul Congress Center issue, with the image of the same having been inadvertently posted. In a corrigendum published on Tuesday evening on X, Republic TV said that 'an incorrect image was inadvertently used, erroneously depicting a building as the Congress office in Turkey by a video editor on the digital desk due to a technical error…The image had no connection to the content or context of the said video. This clip was not broadcast on Arnab Goswami's debate show on 15th May 2025 or thereafter, and was not taken on-air, nor was the said erroneous image in any way related to the subject matter being discussed.' Congress general secretary in charge of communication, Jairam Ramesh, had stated on social media that he hoped that the court would consider the damage caused by 'repeated and deliberate malicious acts of these habitual offenders'. The controversy broke out amid heightened tensions between India and Turkey, sparked by the latter's support for Pakistan following the Pahalgam terror attack and India's military response, Operation Sindoor.

Karnataka HC stays probe against Arnab, Malviya over reports on ‘Congress office in Turkey'
The Karnataka high court on Thursday stayed further investigation against Bharatiya Janata Party (BJP) IT Cell head Amit Malviya and Republic TV Editor-in-Chief Arnab Goswami following a first information report (FIR) filed against them over allegations of spreading misinformation claiming that the Indian National Congress (INC) had an office building in Istanbul, Turkey. Vacation judge justice S Rachaiah passed the order while hearing petitions filed by Malviya and Goswami seeking to quash the criminal proceedings initiated against them under section 192 and 352 of the Bharatiya Nyaya Sanhita (BNS) for the offences of provocation with intent to cause riot and intentional insult to provoke breach of peace, respectively. Malviya was also booked separately in a second FIR for posting an image of a face, half of which was that of Congress leader Rahul Gandhi and the other half was that of Pakistani Army chief Asim Munir with a caption alluding to whether Gandhi was echoing Pakistan's narrative on Operation Sindoor. The court stayed proceedings against him in the above case as well. Earlier this week, Republic news ran a segment implying that the Istanbul Congress Center convention hall was an office of the Congress. Malviya later reposted a clip by Republic Digital that showed the Istanbul Congress Center while Goswami asked 'did you know viewers, the Congress party has a registered office in Turkey?' Soon after, INC registered multiple complaints against both of them. The complaint in Bengaluru against Goswami and Malviya was filed by Indian Youth Congress legal cell head Shrikant Swaroop, accusing them of 'masterminding a criminally motivated campaign' to mislead the public into believing that the Istanbul Congress Centre is the INC's international office. Appearing for Goswami, senior advocate Arun Shyam argued that the claims made on Republic TV were opinion-based, questioning why a national political party would have an office in a country like Turkey, which has taken anti-India positions. Shyam added that an incorrect image was used inadvertently on Republic's digital platform after the broadcast and that a prompt corrigendum was issued. The state's counsel told the court that the accused had only been served notices seeking their cooperation with the probe, and that the state had no intention of arresting them. He urged the court therefore, to allow the investigation to go on. The high court however, rejected the state's request. It issued notices to the police and granted the interim stay order protecting both Goswami and Malviya. On May 20, before the said FIR was registered, Republic TV had published a corrigendum over publishing of the said image. The corrigendum stated that an incorrect image had been inadvertently used by a video editor on its digital desk, depicting a building as the Congress office in Turkey. The error was inadvertent and technical, the channel claimed. Shyam too reiterated before the court that the image for the digital version of the disputed content had been used inadvertently by a video editor.
