Vedike demands suspension of Minister Priyank Kharge

The members of Zilla Nagarika Hitharakshane Vedike demanded suspension of Rural Development and Panchayat Raj Minister Priyank Kharge from the Cabinet for allegedly misusing his power for wrongful confinement of Chalavadi Narayanaswamy, Leader of Opposition in Legislative Council, at Chittapur town on May 21. Vedike members Ambaraya Ashtagi, former Mayor Vishal Dhargi, former Zilla panchayat member Basavaraj Bennur, who are also BJP leaders, jointly addressing press conference in Kalaburagi city on Thursday alleged that a group of rowdy elements those indulged in illegal sand mining at Chittapur taluk, nurtured by Mr. Kharge were responsible for disturbing law and order situation at Chittapur on that day of incident. Mr. Ashtagi claimed that the entire episode was the result of a planned conspiracy against Mr. Narayanaswamy; he claimed that a group of 30 to 40 people tailed the BJP leader from Kalaburagi to Chittapur and they carried black paint and eggs to attack him at Chittapur guest house. He also accused the police of lodging false cases under the SC and ST(Prevention of Atrocities) Act against N. Ravi Kumar, MLC. Mr. Bennur and Mr. Dhargi said that besides confining Mr. Narayanaswamy for five hours in guest house at Chittapur, the Congress workers and followers of Mr. Priyank Kharge have allegedly manhandled Mr. Ashtagi along with other BJP leaders – Pritam Patil, Nijagunagowda Yalgod and Shivu Ashtagi; and a case has been lodged against Arun Yagapur, Maruti Halagi, Shivanand Hongunti, Rafeeq, Uday Sagar and Nagaraj Kallak, he added. The Vedike members demanded suspension of Mr. Priyank Kharge from the State cabinet, stern action against the police officers for dereliction of duty in connection with Chittapur incident; they also demanded action against the Congress workers and anti-social elements for taking law into their hands.

The Karnataka High Court on Thursday granted interim protection from arrest to BJP MLC N Ravikumar, who has been booked for comments suggesting that a Muslim IAS officer who did not act in favour of a BJP leader during a Congress protest had 'come from Pakistan'. Ravikumar moved the court with a plea to quash the FIR registered against him on Monday, said his counsel, M Vinod Kumar. A vacation bench, which also ordered the issuance of notices to the state government and the complainant in the case, has posted the matter for hearing on June 6. The BJP MLC, who is accused of damaging national integrity, making deliberate statements to outrage religious feelings, and of atrocity against members of the SC/ST community, moved the high court after a special court did not grant him anticipatory bail on Wednesday. The special court is due to hear the anticipatory bail plea on Friday. The MLC also sought an interim stay on the investigation in the case filed under sections 197, 224, 299, 302, 351, and 353 of the Bharatiya Nyaya Sanhita and section 3(1)(R) of the SC and ST (Prevention of Atrocities) Act. A social worker in Kalaburagi, Dattatraya Ikkalaki, filed a police complaint against Ravikumar on Monday over his remarks that Kalaburagi Deputy Commissioner Fouzia Taranum 'might have come from Pakistan' and the MLC's alleged remarks against Congress minister Priyank Kharge and the Dalit community to which the minister belongs. In videos that went viral on social media on May 25, the BJP MLC was heard allegedly saying the deputy commissioner's office at Kalaburagi had lost its independence. 'The DC madam is listening to what they (the Kharge family) say. I don't know whether she comes from Pakistan or is an IAS officer here. Listening to your applause, I think she might have come from Pakistan,' Ravikumar said during a BJP protest on May 24. The special court for elected representatives in Bengaluru heard the BJP MLC's interim bail application on Wednesday but ruled that the state government must be heard before passing any orders since the provisions of the SC/ST Act had also been cited in the FIR. The BJP MLC has stated that he had apologised for the remarks made against the IAS officer. BJP state president B Y Vijayendra also said that Ravikumar had apologised for the incident. 'This is a closed chapter,' he said.

Bhopal: A division bench of the MP high court has reduced the sentence of a rape convict from 20 years of rigorous imprisonment to 5 years, holding that he sexually assaulted the minor girl but it was not rape. Hearing a criminal revision petition of a person from Annuppur, who was sentenced to 20 years of rigorous imprisonment by a sessions court, the bench of justices Vivek Agarwal and DN Mishra said the accused sexually assaulted the 9-year-old girl, but it was not "penetrative sex". Therefore, awarding him a maximum term under sections of the IPC, The SC and ST (Prevention of Atrocities) Act, and POCSO Act he was charged with was not appropriate. The appellant said he was being framed in a false case and lodged a complaint with the SHO of the police station before the incident, stating that he could be implicated under the SC and ST (Prevention of Atrocities) Act. It was argued on behalf of the convict that the girl, in her deposition before the trial court, said he went to her house, had a chat with her grandmother, and then left. The judges, in their order, said the girl told the trial court that the accused put her on his lap and touched her private parts. She did not contradict her statement since. The medical report says that there were no injury marks on the private parts of the girl. The act of the accused was not "penetrative sex", and therefore the charges against the accused are modified. In place of section 376 (a) (b) of the IPC, 3 (1) (w) (p) and 3 (2) (V) of the Prevention of Atrocities against SC/ST Act, and 5 (m)/6 of the POCSO Act, the convict is held guilty for the crime defined under section 7 of the POCSO Act, and sentenced to 5 years of RI besides a penalty of Rs 10,000.
