
HC reduces sentence of rape convict
Bhopal: A division bench of the MP high court has reduced the sentence of a rape convict from 20 years of rigorous imprisonment to 5 years, holding that he sexually assaulted the minor girl but it was not rape.
Hearing a criminal revision petition of a person from Annuppur, who was sentenced to 20 years of rigorous imprisonment by a sessions court, the bench of justices Vivek Agarwal and DN Mishra said the accused sexually assaulted the 9-year-old girl, but it was not "penetrative sex". Therefore, awarding him a maximum term under sections of the IPC, The SC and ST (Prevention of Atrocities) Act, and POCSO Act he was charged with was not appropriate.
The appellant said he was being framed in a false case and lodged a complaint with the SHO of the police station before the incident, stating that he could be implicated under the SC and ST (Prevention of Atrocities) Act.
It was argued on behalf of the convict that the girl, in her deposition before the trial court, said he went to her house, had a chat with her grandmother, and then left. During cross-examination, in reply to a query, she said he put her on his lap and touched her private parts.

The govt counsel, however, said the victim was nine years old and has been sexually assaulted, and there should be no kindness shown to the convict.
The judges, in their order, said the girl told the trial court that the accused put her on his lap and touched her private parts. She did not contradict her statement since. The medical report says that there were no injury marks on the private parts of the girl.
The act of the accused was not "penetrative sex", and therefore the charges against the accused are modified. In place of section 376 (a) (b) of the IPC, 3 (1) (w) (p) and 3 (2) (V) of the Prevention of Atrocities against SC/ST Act, and 5 (m)/6 of the POCSO Act, the convict is held guilty for the crime defined under section 7 of the POCSO Act, and sentenced to 5 years of RI besides a penalty of Rs 10,000.

According to an official statement, the raids targeted residential premises of hybrid terrorists and overground workers linked to banned organisations like The Resistance Front (TRF), United Liberation Front Jammu & Kashmir (ULFJ&K), Mujahideen Gazwat-ul-Hind (MGH), Jammu & Kashmir Freedom Fighters (JKFF), Kashmir Tigers, and PAAF. These groups are considered offshoots of proscribed outfits such as Lashkar-e-Taiba (LeT), Jaish-e-Mohammed (JeM), and Al-Badr. The agency suspects these individuals have been aiding terror infrastructure by facilitating operatives, transporting sticky bombs and IEDs, managing funds, and handling arms, ammunition, and narcotics. 20 years imprisonment in POCSO case
The special court for POCSO (Protection of Children from Sexual Offences) Act awarded 20 years imprisonment to a youth on Thursday for sexually assaulting a minor girl. According to prosecution, Velayutham, 31, of Gopalasamudram under Munneerpallam police station limits sexually assaulted a minor girl in 2018 and issued death threat to her when she informed her parents about it. Based on the complaint from the victim, the Munneerpallam police arrested Velayutham, a history-sheeter, under the POCSO Act. Special Court for POCSO Cases judge Suresh Kumar awarded 20 years imprisonment and slapped a fine of ₹20,000 on Thursday. Velayutham has now been lodged in Salem Central Prison after being arrested in connection with a murder case.

The assaults happened multiple times from January to March this year, police said. Police have confirmed that all three have been arrested, and has been booked under different sections of the POCSO Act and the BNS, including gang rape. According to the police, the minor was gang-raped several times by her mother's boyfriend and his aide, both of whom are in their thirties, in Haridwar, Agra and Vrindavan between January and March this year. The men perpetrated the crime with her mother's consent and in her presence, the police said, adding that they also threatened to kill the minor's father if she disclosed it to anyone. On Wednesday, the Uttarakhand Police arrested Anamika Sharma and her boyfriend, Sumit Patwal, from a hotel in Haridwar after a medical examination confirmed that her minor daughter had been sexually assaulted. Haridwar SSP Pramendra Dobhal also confirmed that Patwal's accomplice, Shubham, was also arrested late on Wednesday night from Shahpur, Meerut. The matter came to light on Tuesday when the minor told her father about her ordeal, following which he lodged a police complaint. A case was registered against the trio under BNS Sections 70 (2) (gang-rape), 351(3) (criminal intimidation), 3(5) (criminal act) by several persons in furtherance of common intention) and relevant sections of the POCSO Act. Sharma was stripped of the party's primary membership once her name surfaced in the case. However, BJP sources in Haridwar claim that she has not held any party post since August 2024, PTI reported.
