BENGALURU: High Court on Wednesday issued notice to the state government on a petition filed by Royal Challengers Sports Private Limited (RCSPL), which owns the RCB team, challenging an order passed by the Bengaluru Bench of the Central Administrative Tribunal (CAT). In its July 1, order, the CAT had observed that prima facie, RCB was responsible for the massive and unregulated crowd outside M Chinnaswamy Stadium, which led to a stampede on June 4, resulting in the deaths of 11 people. A division bench of Justice S G Pandit and Justice T M Nadaf issued the notice after hearing the petition, in which RCB contended that the tribunal had wrongly placed the entire responsibility for the incident on the franchise. RCB further argued that the CAT acted beyond the scope of its jurisdiction and in a colourable exercise of its powers. The tribunal, RCSPL said, should have limited itself to examining the validity of the suspension of Vikash Kumar Vikash, ACP (West), who had challenged the disciplinary action taken against him. Despite this, the CAT not only returned adverse findings against RCB, without it being a party to the case, but also did so without proper appreciation of the available evidence, the petition stated.

Bengaluru: The Karnataka high court on Wednesday issued a notice to the state government on a petition filed by Indian Premier League franchise Royal Challengers Bengaluru (RCB), challenging 'prejudicial observations' made against it by the Central Administrative Tribunal (CAT) in connection with the June 4 Bengaluru stampede. RCB's petition asked the high court to set aside portions of CAT's July 1 order that include the negative comments made against the IPL franchise, while quashing the suspension of one of the five Karnataka police officers suspended by the government after the stampede. RCB said the CAT wrongly held the franchise responsible for the stampede without giving it a chance to be heard. 'The observations are factually and legally flawed, premature, and could negatively impact other ongoing proceedings involving RCB,' the plea said. The June 4 stampede outside the Chinnaswamy Stadium during the victory celebrations of Royal Challengers Bengaluru's (RCB) maiden IPL trophy-winning campaign left 11 people dead, drawing sharp criticism over planning and crowd management. The state government ordered the suspension of Indian Police Service (IPS) officer Vikash Kumar Vikash and four other officers of the Bengaluru Police a day after the incident. Setting aside Vikash's suspension, CAT observed that RCB appeared 'prima facie responsible' for the chaos. It said that RCB and its event partner, DNA Entertainment Networks, did not obtain the state's permissions and failed to formally seek police approval or coordinate with authorities before announcing the event on Instagram. The observations, RCB contended, violate principles of natural justice.

The Karnataka government on Wednesday moved the Karnataka High Court against a Central Administrative Tribunal (CAT) order that struck down the suspension of IPS officer Vikash Kumar Vikash over the stampede near Bengaluru's Chinnaswamy stadium that claimed 11 lives last month. A bench of Justice S G Pandit is set to take up the matter on Thursday. Besides Vikash Kumar Vikash, then Bengaluru police commissioner B Dayananda, DCP Shekar Tekkanavar, and Police Inspector A K Girish were also suspended by the government on June 5. The tribunal objected to the 'mechanical' way in which the suspension order was passed, and said there was no convincing material that showed negligence on the part of the police officers. The order also raised the matter of Royal Challengers Bengaluru (RCB) inviting fans to its IPL victory celebration at the stadium on June 4 without obtaining police permission. The order also explained that the relief would apply to the other suspended police officers, stating, 'We also feel our duty to draw attention of the state government towards the settled principle of law that where a citizen aggrieved by an action of government department has approached the court and obtain a declaration of law in his/her favour, other similarly situated ought to be extended the benefit without the need for them to come to court.' The tribunal's order, passed by Justices B K Shrivastava and Santosh Mehra, was made publicly available on Tuesday.
