8 fined for misuse of Rs 1.35L funds under MGNREGA in Palamu
Daltonganj: The Ramgarh block development officer (BDO) on August 14 convicted eight individuals under Section 25 of the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) in Bansdih panchayat under Ramgarh block of Palamu on charges of misuse of over Rs 1.35 lakh govt funds and imposed fine on each of them. The convicted were identified as mukhiya Sangeeta Devi, panchayat sachiv Suraj Kumar Singh, junior engineer with MGNREGA Pankaj Kumar Singh, and rozgar sewak Ravindra Ram. Each of these four was fined Rs 1,000 under Section 25 of the MGNREGA. Also, each of the four would have to pay the outstanding recovery amount, bringing the total to Rs 28,072 per person. The rest were Mahesh Singh, Aarti Singh, Rinki Devi, and Soram Devi — beneficiaries of the Birsa Harit Gram Yojna from Peerhay village under Bansdih panchayat. The amount to be recovered from each, including the Rs 500 fine, are Rs 8,622, Rs 9,975, Rs 4,561, and Rs 5,914, respectively. The eight were ordered to deposit the amounts at the earliest. The convictions followed the detection of irregularities in the Birsa Harit Gram Yojna by James Herenj, an executive committee member of the Jharkhand Social Audit Society. They had misappropriated over Rs 1.35 lakh before the corruption was uncovered by the executive committee member." The additional district programme co-ordinator of MGNREGA in Palamu and deputy development commissioner, M Jawed Hussain, said, "The contravention has been detected and legitimate actions drawn against all the eight." Couple gets 14-yr-jail for selling minor in Delhi
Gumla: A human trafficker couple has been sentenced to 14 years in prison and slapped a fine of Rs 51,000 each on them by the Simdega court of additional district and sessions judge I Naranjan Singh on Friday. Woman In Levirate Marriage, Where Widow Marries Husband's Brother, Entitled To Maintenance: HC
'Where a long-standing and socially accepted custom exists allowing such marriage, it may be treated as valid in law,' the court held In a significant ruling promoting social justice and gender equality, the Patna High Court (HC) has allowed a woman's plea for maintenance under Section 125 of the Criminal Procedure Code (CrPC), even though her marriage with the respondent was disputed and allegedly fell within prohibited degrees under Hindu Law. The court, in Sangeeta Devi v. Pawan Kumar Singh & Ors., set aside a June 2024 order of the Family Court, Kaimur, which had dismissed the woman's maintenance application on the grounds that she was not the legally wedded wife of the respondent. Justice Bibek Chaudhuri held that in maintenance proceedings under Section 125 CrPC, strict proof of marriage is not mandatory if the woman has been socially accepted as the wife and has lived in a domestic relationship, particularly where children have been born out of that union. The petitioner, Sangeeta Devi, claimed she married Pawan Kumar Singh in 2010 in accordance with the prevailing custom of her community, where a widow is permitted to marry her deceased husband's younger brother, a practice known as levirate marriage or kareva. The couple had two sons during their cohabitation. She alleged that Singh, a police constable, abandoned her and the children without financial support for the past six years. The respondent denied the marriage, stating that the petitioner was his brother's widow and therefore their union was void under Hindu Marriage Act provisions prohibiting marriage within certain degrees of relationship. However, the High Court emphasized that Section 5(iv) of the Hindu Marriage Act allows such marriages if they are sanctioned by custom. 'Where a long-standing and socially accepted custom exists allowing such marriage, it may be treated as valid in law," the court held. Justice Chaudhuri noted that the woman's plea of custom had been raised and needed proper judicial examination, not outright rejection. The court also relied on the past Supreme Court decisions, including Chanmuniya v. Virendra Kumar Singh Kushwaha and Badri Prasad v. Dy. Director of Consolidation, to hold that cohabitation and acknowledgment of children give rise to a strong presumption of marriage. 'Disregarding such a union would not only be legally unsound but would also send a regressive message to society, undermining the dignity of women and the security of children born from such relationships," the court observed. Calling the Family Court's rejection 'legally unsustainable", the High Court remanded the matter back for a fresh hearing, directing that both parties be allowed to lead evidence, especially on the question of custom and cohabitation. Man sentenced to life imprisonment for murder of railway employee
Sitapur (UP), May 22 (UNI) A man was sentenced to life imprisonment along with a fine of Rs 40,000 by a special court on Thursday for the murder of a railway employee in Mishrik area of Sitapur district here in Uttar Pradesh, prosecution sources said here. The sources said one Sangeeta Devi lodged an FIR on January 27, 2021 at the Mishrik police station that Hemendra alias Hemu Rathore called her husband Govind Prasad, a railway employee, on the pretext of a feast and murdered him in a planned manner. "It was alleged that Govind Prasad had lent Rs 4 lakh to Hemu to buy a tractor, which the accused was continuously avoiding to return," they said. The sources said based on evidence available on record the court of Additional Sessions Judge Vijay Kumar Azad sentenced the accused to life imprisonment and a fine of Rs 40,000 for murder and 3 years rigorous imprisonment and a fine of Rs 40,000 for criminal breach of trust. Woman beaten to death over dowry in Madhubani village
Madhubani: A 28-year-old woman, Sangeeta Devi , was beaten to death allegedly by her husband and brothers-in-law over dowry demands, following which they also tried to cremate her at Hatni village under Ghoghardiha police station in Madhubani district on Thursday. Tired of too many ads? go ad free now They, however, left her half-cremated body and fled the village along with her two children, seeing her maternal family members and villagers approaching the cremation spot at a mango orchard in the village. According to Sangeeta's family, she had called them just before her death on Thursday morning, informing them that she was being physically assaulted by her husband Ranjeet Sah and in-laws, including brothers-in-law Ravindra, Shiv Kumar, Arvind, Chotelal, Abhishek Kumar and Sushil Kumar over demands for a dowry of Rs 2 lakh. Distraught by her cries for help, her brother and father Jagdish Prasad Gupta from Heropatti village rushed to Hatni with other villagers to rescue her. However, by the time they arrived, Sangeeta was already dead, and her in-laws were allegedly cremating her in a mango orchard. Upon spotting Sangeeta's family and villagers, the accused fled the scene, leaving her partially burned body behind. Later, Ghoghardiha police arrived at the scene and seized the charred remains for a postmortem examination, before handing the body over to the family. Sangeeta's brother, however, said that after they received the distress call from his sister, the family repeatedly tried to contact the police helpline (112) as well as Ghoghardiha police station to report the ongoing abuse, but their calls went unanswered. "We tried to get help, but no one responded. By the time we reached, they (in-laws) killed her and were burning her body," he said. This newspaper's efforts to elicit a response to the allegations from the Ghoghardiha station house officer (SHO), Phulparas SDPO and SP on Friday bore no fruit as none of the officers responded to the calls made on their official cellphone numbers. Ghoghardiha SHO Sarvesh Jha said that an FIR was registered in this connection under the relevant sections of BNS.
