FIR against Bengaluru North University VC under SC/ST Act

The Kolar police have registered an FIR against Niranjana Vanalli, the Vice Chancellor (VC) of Bengaluru North University (BNU) under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) amendment bill 2015, and also under the Bharatiya Nyaya Sanhita, 2023. Following the directions of the district sessions court of Kolar, the police have registered an FIR. Manjunatha. R, guest faculty of the BNU had filed a private complaint before the court. The court directed the police to register an FIR, conduct an investigation and submit the report. According to the FIR, the complainant accused the VC of insulting him based on his caste. 'Though there were no complaints against me, the VC had placed an additional agenda in the syndicate meeting making false allegations against me and also tried to defame me. He is harassing me as I belong to the SC community,' the complaint read.

Andhra Pradesh government extends IPS officer Sanjay's suspension

Vijayawada: The state govt ordered the extension of senior IPS officer N Sanjay's suspension for a further period of 180 days, or until further orders, whichever is earlier. This decision was formalised through a government order (GO) on Tuesday. N Sanjay, a 1996-batch IPS officer, was initially placed under suspension on Dec 3, 2024. The suspension was based on allegations of misappropriation and misuse of public funds during his tenure as director general of the Andhra Pradesh state disaster response and fire services. He is also accused of irregularities while serving as additional director general of police, AP CID, specifically concerning funds allocated for training police personnel on the rights of Scheduled Castes and Scheduled Tribes under the Prevention of Atrocities Act, 1989. A criminal case was registered by the anti-corruption bureau (ACB) on Dec 24, 2024, under sections of the Prevention of Corruption Act, 1988, and multiple sections of the Indian Penal Code. The investigation remains ongoing, with several witnesses yet to be examined and key documents pending collection, as per ACB. In light of the pending investigation and potential risk of the suspended officer influencing the process, the review committee, which met again on May 21, recommended the extension of the suspension. Acting on this advice, the state govt extended the suspension.

Chandrakanth Bellad and his team make clean sweep in elections to Vidyavardhak Sangha

The faction led by incumbent president Chandrakanth Bellad made a clean sweep in the elections to Karnatak Vidyavardhak Sangha, the results of which were announced on Monday evening. The elections to the 135-year-old sangha, a representative body of Kannada and Kannadigas, evoked much interest this time, as candidates with affiliation to two national parties were in the fray forming two panels. While the faction led by incumbent president sought votes based on the work it has done, the faction led by the former MLC Mohan Limbikai accused the present body of not having done much for Kannada and Kannadigas and appealed for a vote for change. However, when the counting of votes concluded, it was evident that the electorate, which comprised writers, artistes, politicians, religious heads, professionals and people from different walks of life, has decided in favour of the existing office-bearers. Mr. Bellad managed to win the elections for the second time by defeating his opponent Mohan Limbikai by a margin of 550 votes. In the previous election held after the demise of veteran journalist Patil Puttappa, Mr. Bellad won comfortably with a margin of 1,650 votes. This time, Mr. Bellad, who is a former MLA, fetched 2,328 polls, while Mr. Limbikai polled 1,816 votes. Two other contenders Hanumakshi Gogi and Chandrashekhar Rayar got 204 and 39 votes, respectively. In the intense battle for the post of general secretary, incumbent Shankar Halgatti secured 2,488 votes against 1,929 polled by the former general secretary Prakash Udakeri. Incumbent executive committee member Sanjiv Kulkarni contested for the vice-president's post and won comfortably by securing 2,089 votes. His opponents Sharanappa Kotagi and D.M. Hiremath polled 1,349 and 952 votes, respectively. In the contest for working president's post senior advocate Basavaprabhu Hosakeri defeated journalist Manoj Gouda Patil by a margin of over 1,800 votes. Shankar Kumbi (2,573 votes) defeated Marthandappa Katti (1,777 votes) to become joint secretary, while Satish Turmari was elected as treasurer. Vishweshwari Hiremath got elected to the executive committee under woman reservation and Dhanwant Hajavgol under Scheduled Castes and Scheduled Tribes reservation. A total of 20 candidates were in the fray for the seven executive committee posts. Of them, all seven of the Bellad faction have won. They are Shailaja Amarashetti, Shivanand Bhavikatti, Jinadatta Hadagali, Guru Hiremath, Mahesh Horakeri, Veeramma Waddin and Shashidhar Todkar. After the results were announced, Mr. Shankar Halgatthi told presspersons that the voters have reposed trust in the Bellad panel. The new body will work towards realising the objective of the sangha, he said.

Last Updated: Top court held that shared intent and joint participation are enough to establish liability in gang rape under IPC Section 376(2)(g) The Supreme Court recently observed that in cases of gang rape, even if the sexual assault is not committed by each individual personally, the common intention and joint participation in the act are sufficient to hold each person accountable. A bench comprising Justices Sanjay Karol and K.V. Viswanathan pointed out that Explanation 1 to Section 376(2)(g) of the Indian Penal Code (IPC) states that where a woman is raped by one or more persons in a group acting in furtherance of their common intention, each member of the group shall be deemed to have committed gang rape. The Court referred to Pramod Mahto v. State of Bihar (1989), in which it was held that in cases of gang rape, it is not necessary for the prosecution to produce clinching proof of the complete act of rape by each of the accused on the victim or victims. The bench further highlighted that in Ashok Kumar v. State of Haryana (2003), it was held that this provision embodies the principle of joint liability, with the essence of such liability being the existence of common intention. 'In view of this, it is very clear that in a case of gang rape under Section 376(2)(g), an act by one is enough to render all in the group liable for punishment, as long as they have acted in furtherance of the common intention," the bench held. It added that 'common intention is implicit in the charge under Section 376(2)(g) itself, and all that is required is evidence to establish the existence of that common intention." The Court made these observations while hearing an appeal filed by one Raju @ Umakant, challenging a judgment of the Madhya Pradesh High Court's Division Bench at Jabalpur. The High Court had upheld his conviction and sentence passed by the Special Judge under the SC/ST (Prevention of Atrocities) Act, Katni, Madhya Pradesh. He had been found guilty of offences under Sections 366 (kidnapping), 376(2)(g) (gang rape), and 342 (wrongful confinement) of the Indian Penal Code, 1860, as well as Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. For the offence of gang rape, Raju was sentenced to rigorous imprisonment for life. The co-accused in the case, Jalandhar Kol, was sentenced to 10 years of rigorous imprisonment under Section 376(2)(g) IPC. According to the prosecution, a man lodged a missing persons report on 24 June 2004 at the Kymore Police Station in Katni district, stating that his daughter had not returned home after attending a wedding procession (barat). Following the registration of the report, the police began an investigation. Four days later, on 28 June 2004, the girl was recovered from the house of the appellant's alleged wife. The recovery memo stated that the girl was initially kept at the appellant's house and was later taken by his alleged wife to her own residence. Based on the girl's statement, an FIR was registered on the same day. Subsequently, on 30 June 2004, another complaint was recorded after the girl appeared before the Deputy Superintendent of Police. Notably, there were discrepancies between the FIR and the later complaint. While the FIR mentioned only Jalandhar as the perpetrator and Raju as an accomplice, the girl's testimony in court stated that both accused had kidnapped and raped her. The Supreme Court found the survivor's deposition before the trial court to be credible and of such probative value that it required no further corroboration. The Court rejected the defence's argument regarding contradictions in the FIR and the later complaint, observing that 'minor contradictions in the evidence did not detract from her clinching testimony." The bench held that the girl had clearly, consistently, and convincingly deposed about the rape committed by both Raju and Jalandhar. It also noted that under Section 376(2)(g) IPC, the act of one member of a group is sufficient to make all liable if they acted in furtherance of a common intention. The facts of the case, the Court said, demonstrated that both accused had acted in concert with the shared intent to sexually assault the girl. Accordingly, the Court upheld Raju's conviction under Sections 366 (kidnapping), 342 (wrongful confinement), and 376(2)(g) (gang rape) of the IPC. However, it set aside his conviction under Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, finding no evidence to suggest that the offence was committed on account of the survivor's caste identity. On the question of sentencing, the Court modified the life sentence awarded to Raju and reduced it to 10 years of rigorous imprisonment, bringing it in line with the sentence imposed on co-accused Jalandhar Kol. Until March 2021, only 2,032 start-ups were registered in Tamil Nadu, and now, this number has increased to over 10,800 and nearly 50% of these are founded by women, Tamil Nadu's Minister for Micro, Small and Medium Enterprises (MSMEs) T.M. Anbarasan said. Delivering the valedictory address at The Hindu Tamil Nadu Startup Summit-25, the Minister said a regional innovation centre had been planned in Thoothukudi in this fiscal. 'In the last four years, regional innovation centres have been established in Erode, Tirunelveli, Hosur, Salem, Cuddalore, Thanjavur, and Coimbatore.' Mr. Anbarasan shared details of various projects that were executed in the last four years. 'Around 31,11,000 students studying in schools and colleges have been provided with entrepreneurship and innovation training. Over 205 start-ups have benefited under the TANSEED scheme (including 36 Scheduled Castes and Scheduled Tribes (SC/STs) start-ups). The government has given a total of ₹69.99 crore in funding,' he said. 'Launch pad programmes are being conducted to introduce new businesses. 'Pre Incubation Centres' have been set up in educational institutions across cities in Tamil Nadu,' he added. The Minister said that at the Global Investors Meet, which was held in January last year, around 5,068 memoranda of understanding were signed in the MSMEs sector. These agreements are expected to generate employment for 91,785 people. 'And of these, around 2,360 companies have already been launched, entailing investments of ₹25,097 crore. Work is in progress to launch the remaining companies soon,' he added. Mr. Anbarasan also mentioned how 59,584 entrepreneurs were created. This includes 21,281 are women, 9,224 are from SC/STs, 2,497 are from minority communities and 717 are disabled individuals. 'These initiatives have promoted entrepreneurship across all sections of society, ensuring equality and social justice, as envisioned by Chief Minister M.K. Stalin,' he said. Suresh Balakrishna, Chief Revenue Officer, The Hindu Group (THG), felicitated the Minister in the presence of L.V. Navaneeth, Chief Executive Officer (CEO), THG Publishing Private Limited, and Sivarajah Ramanathan, Mission Director and CEO, StartupTN.
